In this case, the evidence exists but the NPP wants to manipulate it. Now, the EC is bringing out different Pink sheets in some places which is alien to the ones given to the parties by the EC itself. Different pink sheets and so on.
This is why the NPP in cahoots with the EC are going for Mandamus so that the court will place the power in the hands of the EC but not the process laid down in the CI.
In this regard, the EC can manipulate the system in favour of the NPP thereafter ask the NDC to go to court if they disagree.
Now, the NPP is doing serious judge shopping for the Mandamus application to succeed.

It's Returning Officers not Presiding Officers. If the people who are talking about the EC trying to subvert the people are very much afraid of recollection. I say this because every valid vote cast in these disputed constituencies should be counted and I believe that is the will of the people. So if because of certain occurrences not all valid votes casted in these constituencies were included in the first collation and declaration why some people are scared for all votes should be included. Unless NDC is saying EC is lying because all votes from all polling stations were included in the initial declaration. So far I have not heard that, but the argument is legal and once I have been declared a winner even if the process was tampered with I don't care. Is that the will of the people?

The EC has already presented fake pink sheets and serial numbers alien to the process. They want to push these through on behalf of the NPP then after that tell the NDC to go to court if they disagree, by then the NPP parliamentary candidates are sworn in.

The High Court judge failed at the first hurdle for not allowing an affected party to be heard. This judge will not pass a first year Law exam with that attitude.
Torkonoo knew the obvious anomaly that is why she did not want anything to do with it and appointed Pwamang JSC to preside. Some of these cases are hot potato for judges because if they're not careful, it will follow them forever.
If Anin-Yeboah JSC retired speak today, he will be in serious problem because in his yearn to support the NPP at every turn, he made serious and fundamental errors with the law.
Atuguba JSC retired is able to speak today because you will hardly find his legal reasoning absurd. You can find a lot of this with Anin-Yeboah even from his days on the Appeals Court bench.

We all know this is an election petition disguised as mandamus because if it is election petition the original declarations will stand and the NPP and EC will have to wait until the results are gazetted and affected MPs sworn in before the petition can be heard by the high court pursuant to CI 127. It was a clever way the NDC wanted to take to defeat the EC and NPP but their men are still in charge of the courts. Interesting times ahead
