I tend to pity Ghanaians a lot because most of you are not seeing through the tricks of today's Politicians. They award a contract, then quickly turn around and cancel it. They then advise the Contractor to sue the Gov't so that they share the money. Both NPP and NDC are doing it. What we need is a new Party, new faces preferably from Ghanaians who have made it on their own from abroad.

Alfred Agbesi Woyome, the beleagured National Democratic Congress financier who was recently acquitted and discharged in a 51 million cedis judgment debt scandal, has shockingly revealed that the Attorney-General, Marrietta Brew-Oppong, benefitted from the monies given him (Woyome) by the state.

According to Mr Woyome, the Chief Legal Advisor to the President, while in private practice with the law firm firm of Lithur Brew and Co, received not less than $1m from the judgement debt monies illegally paid to him that the A-G "so much criminalize and want me jailed for."

In a statement signed by My Woyome and read on Asempa FM Monday, the self-styled NDC fancier, even as the state appeals his acquittal and discharge on two counts of causing financial loss to the state and defrauding by false pretense, insisted that Mrs Marrieta Brew-Oppong is biased and unfit to be the Chief legal advisor of the president and must either resign or step aside.

He disclosed that prior to being nominated for her current possition, the Attorney General and her firm benefitted from the 51million cedis judgment debt he (Woyome) was paid in 2010.

“I find it difficult to reconcile your decision to involve yourself directly in this criminal case and notice of appeal you have authorised to be issued and served on me.

“…It is a fact that you and clients received approximately $1 million equivalent in Ghana cedis from the said judgement debt you now so much criminalize and want me jailed for," the statement read by KABA host of Asempa afternoon political show, "Ekosii Sen".

But in a sharp riposte, the Attorney General fired back saying she has the support of the president and will thus not kowtow to the whims and caprices of Mr. Woyome.

Describing as “dishonest and unnecessary” Alfred Woyome’s call for her to resign, Mrs. Marietta Brew Appiah-Oppong, stated on the same platform that the call for her head is illogical.

“I’m not resigning, my president has instructed me to recover the money and I intend to pursue the appeal” she stressed and counseled Mr. Woyome to save his missiles “for the Court of Appeal”.

In fact the Supreme Court judgment which declared as illegal the contract (with Waterville) whose unilateral abrogation by the then Government of Ghana in 2007 resulted in the judgment debt paid to Woyome, has a lot of food for thought.
By our law, any contract with a foreign company (in this case, Waterville) must first be approved by Parliament. The contract entered with Waterville for the construction of the stadiums for CAN 2008 was never sent to Parliament by the Kufuour Government. The contract was duly signed by the Government of Ghana and Waterville for which Woyome was a financial engineer. Waterville mobilised and started the project when the Government of Ghana abrogated the contract and re-contracted it to the Chinese who actually completed the stadiums.
Woyome's claim which he sent to court was that, he had put-in so much money for Waterville before the contract wss abrogated and so must be compensated. The court saw it right to award him 51.2 million Ghana cedis and he was paid accordingly.
Now the Supreme Court is saying that, because the contract with Waterville did not get approval from Parliament as required by the law, it was an illegal contract. In other words, the Supreme would not have had any problem with the payment to Woyome had the abrogated contract been sent to Parliament for approval.
The question therefore is: Whose duty was it to send a Ghana Government Contract to Parliament for approval? I don't think the Supreme Court expected Woyome to do this. Why then should Woyome suffer for a failure he did not cause?

Mr. Analyst, from your own naration or comment: 1) Wayome was not even a party of the draft or planned contract between the Ghana Government and Waterville. 2) Woyome was a financial engineer for Waterville and not for the Republic of Ghana. 3) By Ghana`s law any contract between the Republic of Ghana and a foreign company must first be approved by the Parliament of the Republic of Ghana and this surely stated in the said contract which makes it binding to the contract partners in this case Waterville and his partners. This simply means the contract between Kuffour`s Government and Waterville is legally or by Ghana Law not in existence and therefore cannot be said to be abrogated by even Waterville to which a contract partnership has been promised. It is therefore a fraud for even Waterville to claim judgement debt for the abrogation of a legally non existed contract after change of Government. It is criminal for Wayome to his his knowledge of the promise contract decieve a court of law in Ghana to attain a default judgement forcing the Republic of Ghana to pay him any Judgement debt. Though it is the responsibility of the Government to have the contract approved by Goverment, yet a contract partner that starts work honouring the contract before its approval does so on his or her own risk without any legal right for the abrogation. A contract is only valid if and only if it is legally binding to all partners involved.
