The issue of who appoints the Chairman of the EC to is an issue of semantics but people are putting political colours to it. An advice may or may not be taken. It is not obligatory. The phrase 'The President shall ..' makes it mandatory for the President to appoint the EC chair and no one else. The phrase 'acting on the advice of the Council of State' does not say the Council of State will be responsible for the process of shortlisting and selecting the best candidate for the job. The advice in this context does not have a limit on what it should be. President could be advised on how, who or what to look for in appointing the EC chair. This to me is very simple. One thing we should not forget is that the CE chair only performs the duty of the returning officer for the presidential elections and he has no power to decide who becomes the president.

VCRAC, should be informed enough to differentiate between these two phrases. They do not mean the same thing. If he knows the difference and yet want us to believe they mean the same thing, then true patriots need to ask what is VCRAC's motive in trying to deceive us?
To act in accordance with means the President would merely rubber stamp the Council of State's choice. But to act on the advice of, means an entirely different thing. It means the President is the one who makes the choice and the Council of State merely tell the President whether his choice is good or not. In the final analysis, however, it's the President who decides who to appoint. This is what the constitution states. VCRAC should be careful lest he tarnish his reputation with this amateurish interpretation of the language of the constitution

Kuffour appointed 4 members of the same EC in consultation with his Council of State in March 2004 (Mrs. Adobea Dadzawa, Nana Amba Eyiiba I, Eunice Roberts and Eben Aggrey Fynn )and no one said anything. Now that it is time for Prez Mahama to appoint the Chairman of the same body all these senile judges and lawyers are coming out with some warped interpretation of the same constitution that gave Prez. Kuffour the power to appoint.
Can we please stop this nonsense? I wish the judge could also think and know that the duties of the C of S does not include making appointments. We have allowed politics to "eat up" our sense of reasoning, and that is so shameful.

How does it even make any sense for the President or any President for that matter, who is vested in the Presidential contest to select who should lead the country, by any stretch imaginable, be the one to appoint the referee that is the Electoral Commission Chairman or woman?
Where on earth would such a process happen? Even in the failed states and war-torn el dorado of lawlessness and impunity such as Somalia etc, etc, where governance is by strong arm tactics and the barrel of the gun and through decrees, brute force and whatnots, such a fallacious and outrageous preposition would not hold, much less a country such as Ghana.
It is only blocked-headed NDC footsoldiers and dimwits with defeat staring them in the face who would even dare to think of such, on the assumption that, the President can flout the constitution, appoint his preferred choice/candidate, and consequently save his neck at the polls.
This is not going to happen in this country. So for those who are hallucinating and tickling themselves that the President is vested with that authority, we have a message for them. They need to move to the planet Pluto.
Clearly, NDC knows it is on it's way out and would clutch at any and every straw to circumvent the wishes of the people. But they should remember what happened to Blaise Campaore of Burkina Faso who along similar lines felt, he could rewrite, amend and change the constitution so he could stay in power against the dictates of the citizenry. The whole world saw what happened in Burkina Faso. It is in the interest of John Mahama to allow the Council of State to do it's work and not pull a Burkina Faso on the citizenry, because it would not be countenanced in this country.
The appointment of the Chairman of the EC by the President is done on the advice and selection of the Council of State having consulted within and outside it's body, since the constitution creates space for that kind of consultation.
