Political Science Lecturer with the Kwame Nkrumah University of Science and Technology (KNUST), Dr. Richard Amoako Baah has challenged the ruling of the Supreme Court on the two ex-Guantanamo Bay detainees for the treaty to either be sent back to parliament for ratification or government deports them.
“All that Supreme Court has to do is to look at that law and say you cannot do this, therefore, throw them out. It is very simple not to take it back to parliament for approval” he opined.
“The court is looking at the British way of doing things. What kind of law is this and which system do we have “the political social commentator rhetorically asked on the holiday edition of Ultimate FM morning show.
“If you have a written Constitution it is the Supreme Court, not the parliament; therefore the agreement cannot be sent back to parliament for approval” he challenged the ruling of the apex court.
“You can give them a time that within three months they must be out of the country and that will be the end of it but you cannot send them back to parliament to approve it and that is why it is wrong with the whole ruling from my perspective”
According to Dr. Richard Amoako Baah, the order of the Supreme Court is needless since there are existing laws showing terrorists should not be accepted in the country.
“Why do we have to talk more troubles to our existing one in the name of compassion? This is common and we should know that Americans are sophisticated that they use us in protecting these terrorists”?
A seven-member Supreme Court panel presided over by Chief Justice Sophia Akuffo by six to one (6 -1) majority decision said the two in the country are illegal since the then government allowed them into the country without prior approval by Parliament.
Margaret Bamful and Henry Nana Boakye last year sued the Attorney General and Minister of Justice as well as the Minister of Interior, accusing government of illegally bringing in the two former Gitmo detainees, without recourse to the laws of the land.
Members of the NDC are daring the current government to deport them as it has always asked since the ruling has now gone in their favour. ???
