The Statute Law Review Commission says Parliament finds it difficult to pass the Insolvency and Bankruptcy Bills because members see the passage as threat to their qualification to enter the House.
Review Commissioner at the Attorney-General?s Department, Justice Crabbe, said the passage has been the potential of posing as a stumbling block, explaining that to be elected to Parliament, an MP should not be seen to be insolvent or declared bankrupt by the courts and intimated that if any MP were declared bankrupt it would automatically disqualify such a person to contest election to Parliament.
Mr Crabbe was interacting with the NETWORK HERALD over Parliament?s and Government?s inability to pass the Bill.
According to him, there was a provision in the Bill that made its commencement dependent on an instrument being crafted by the Attorney General.
Unfortunately, however, that instrument has never been crafted ever since making it impossible to operationalise any such laws.
