Petitioners’ case lacked legal basis – Tsatsu Tsikata

The lead counsel of the National Democratic Congress (NDC) in the just-decided election suit, Tsatsu Tsikata, has described the arguments brought forward by the petitioners in making their case as a hotchpotch.

He says no serious-minded legal analyst would have been convinced by the arguments.

“It is frankly a very unsatisfactory situation,” he said on Saturday, August 31, 2013 on TV3’s Hot Issues.

“I think this thing should have been addressed better,” he noted.

He said the manner in which the petitioners kept changing numbers with regard to the cited polling stations only weakened their case.

“Along the lines things kept changing and if you have that you do not have credibility,” he observed.

He said it was clear that the petitioners were double counting and that informed him, at meeting with the NDC Executive, to point out that the petitioners lacked arithmetic logic.

Mr Tsikata expressed shock at the absence of a single person to witness for the petitioners, noting that they only sat behind a computer to generate their figures.

He cited that his name came up in the petition but along the line it dissipated since, according to him, the petitioners knew no strong case can be made out of that.

The Supreme Court ruled on Thursday, August 29, 2013 in favour of the respondents, dismissing the petition filed on December 28, 2012.
