Legal practitioner, Godfred Yeboah Dame has described comments by the lead counsel for the NDC in the just-ended election petition case, Mr. Tsatsu Tsikata as “illogical and contemptuous”.
Mr. Dame told host of Adom FM’s morning show ‘Dwaso Nsem’, Captain Smart, on Monday that Mr. Tsikata’s decision to attack a single was “illogical” and contemptuous.
“Every judge on the Supreme Court was appointed somehow by the president, which is a fact based on Article 144 clause 2, as Ghana’s constitution stipulates, and it’s unfair for someone to attack a single judge after going through a thorough process before appointment and approval by Parliament,” Lawyer Dame stressed.
The NDC lawyer, who spoke on TV3’s Hot Issues programme on Saturday, accused Justice Anin Yeboah of allowing his political leanings to cloud his judgment.
The former Chief Executive of the Ghana National Petroleum Corporation also said Justice Anin Yeboah consistently took an opposing stance against the NDC’s arguments and position as far as the case was concerned, from the onset, because he was appointed to the Supreme Court by former President Kufuor.
Lawyer Dame pointed out that although Justice Anin Yeboah was appointed by former President Kufuor of the NPP, he dismissed half of the petitioners’ case and granted the other half so it was illogical to accuse him of being biased.
Mr Justice Paul Baffoe Bonnie, who was also appointed by ex-Kufuor, also dismissed five out of six claims by the petitioners, he added.
Mr. Dame emphasized that Justice Sophia Adinyira, who was also appointed by former President John Agyekum Kufuor, dismissed all claims filed by the petitioners, but this has not attracted comment from Tsatsu Tsikata.
Godfred Dame urged the Court to summon Mr. Tsatsu to explain his comments since they were potentially contemptuous.
“Supreme Court must invite Tsatsu Tsikata before the justices because his comment has gained national attention and therefore they must call him for explanation,” Lawyer Godfred Yeboah Dame demanded.
