It is manslaughter since he did not have intention to kill. Reading from the facts, he rather had intention to cause harm with the screwdriver. 5year is however too small for a homicide

5 years too lenient. this should not be manslaughter. perhaps, the change was internal to reduced the punishment. is that how law is supposed to work?
