With no proper address or identification systems in Ghana the only option for police officers is to impound the vehicles in order to compel the driver to appear to face justice .
For now and as it stand in Ghana the police will continue to use its discretion until the system works like other jurisdictions.

I think his directive came too early. He should have waited until the digitization process has been completed, and every driver has a permanent identity. That is what the developed world use to combat such minor offences. Nobody impounds any vehicles; rather the driver who causes the offence is is booked, and the law takes its cause.
Let us be circumspect when discussing these issues. The AG is concerned police resources are being wasted without anything accruing to the state. But if the police stop taking action against criminals, Ghana would be a sweet country to live in! They are two sides of the same coin. But Ghana has to win this duel!

That's why everyone now has ghanacard. Take ghanacard details. With car registration now linked to ghanacard govt can take fine from your bank or momo wallet without informing you if you fail to pay fines.
Dvla and police can freeze all your bank and momo accounts till you pay fine. GRA does it all the time even to hospitals till they pay tax and dvla can apply to court for same.
I travel every week and I'm about to right now. Half the cars on my route have no insurance but police take just 5 cedis and allow overloaded cars to pass. Friday as I birded bus my friend boarded a different one. More than ten trotro at the station didn't even have turn indicator lights. So how did they get road worthiness?
But police will let all of them pass if they pay as little as 5 cedis.

what is the best practice in dealing with these offenders ?
1.now everybody has a Ghana Card associated with their Driving License
The police can ask the driver to report at the nearers police station for citations.- If the driver fail to show up,- this is an avenue for the police to put the driver on their check list, it made the driver wanted on driving misconduct, so wherever that driver is been found could be arrested to a nearby police station for questioning and charge him or her for court. at this level the police has a good reason to impound the car, because the driver is been arrested. remember it is the driver who is been arrested not the car- so upon calling for somebody to bail the driver to appear before court, the car must be released to the driver, or if the driver cannot drive the car, it must be towed to a place of the drivers choice at the cost of the motorist

The court will for sure give me a penalty to pay and warn for further actions like 6 months ban from driving.
if it happens again the ruling of the court would be fully administered -
after the ban my drivers license would be given back in another warning.
this issue has been evolved due to lot of counter protest and argument.

most dangerous places and points there are speed and redlight cameras if crossed a redlight you would be flashed , the camera flashes your car Nr plate, and your fine would be post to your ADDRESS to go to post office and pay . if i refuse to pay the Bill , i would be taken to court.

And for anybody's info in Ghana its AG and its office that has prosecutorial powers but not the police service. And thats why in any prosecution from the poluce service the docket is sent to AG office for advice. And impounding a vehicle for a year or two because of the misdemeanour offence which in the end the maximum custodial sentence does not exceed 3 months. So if the case lingers on for say a year or two what do you think the condition of the car should be and people are suing the state for damage , theft and deterioration of their cars whilst at the custody of police. And in all honesty the police office officers do that as one of the tactics to extort monies from the car owners.

In any case, what offence does the vehicle commit? There are cameras at all intersections now so footage can be taken to court as evidence. The vehicle has no role to play in the prosecution of offending drivers. And have you thought of that fact that a driver may be charged wrongly (like I was) and could turn around and sue heavily for impounding his vehicle in addition to malicious prosecution etc? Which country today impounds vehicles for traffic offences? Drivers are only supposed to be summoned for court or given a fine to pay at the local court.

It is a good call. There must be an alternative regulation(s) to punish offenders such as spot fines, ticketing and/or others which will directly go into the law coffers and not the pockets of corrupt policeman or policewoman.
For example, the DVLA officers on the road has been doing spot fines and ticketing and it's a good practice (though there's they need to advance this style.
This will also, in a way, help curb corruption in the police system.

Because that so-called Attorney General cannot think of an effective way to address this issue, he has come out with this STUPID BLANK decision, so that the already lawless conduct of Ghanaian drivers and the killing spree will continue.
If children are given positions beyond their reasoning, this is the consequence. Childish ranting.
2. Impounding of cars used to commit Road traffic offence. This is a normal practice. Instead this childish Attorney General advising the Police Service to streamline this phase of their traffic control system, e.g., build or hire designated vehicle impounding yards, managed by either the Police or civilians who the cost borne by the traffic offender, this clueless Attorney General has once again used his authority for driver misconduct on our roads.
Lawlessness is this Akuffo Addo, his family and NPP's hallmarks. The have no clue what the whole governance is about. Tweeaaaa Attorney General.

I think such cautions are in the right direction. I think the ministry of road and transport should have a common digital platform that will entails every driver's licenses and the car documents and also equip the police with devices that can be scanned and gets the drivers and the car details at the spot.
In this case, police need to take any minor offender's details and issue thicket(fine) which will force the driver to pay his fines before he can renew his car or drivers licenses; fines issued could attract penalties for a period of months/ go to court if not paid in time.
The government can also install a lot of security/speed cameras at the various traffic intersections and parts of the roads which can track and capture overspending and jumping of the red light and fine would be issue as well. This can generate huge sums of money for the country since we have "goat" drivers on our roads. In this case police can get ample time to tackle others pressing crimes and also bring decency/ professionalism in the filed of duty.

Such directives are welcome but must be issued without ambiguity. First and foremost, our system must be improved in order for such minor offerders to be penalise with a spot fine. That way, the state will generate more revenue rather than the money going in to such unreasonable officers pocket.
Secondly, the spot fines must be craft in such a way that paying and receiving bribe out of it will be unattractive. For example if the state promulgate a law that says you'll pay 20 or 50 cedis for crossing a red light, it will be very difficult for an officer to receive 10 cedis out of it as a bribe. Unless such officer doesn't have any morals or discipline. And out of the 50 cedis collected from the offender, the state must pay a percentage to the collecting offer as a form of motivation. That is the way to go.

let me help you to understand the AG POSITION very clear.
somebody who has no valid insurance has committed a traffic offence but the best practice to deal with him is no impounding the car because such actions could be expensive to the government in the following grounds
1.your assessments of invalid insurance could turn out to be false- in this the owner of the vehicle has every Right to sue the government for huge damages.
what should the police do in such a situation
1. Ticket for violation traffic regulation
2. The police could take the Nr plate and tow the car to a place of the motorist choice at the cost of the motorist and ask him to produce an insurance cover or renew the insurance before the Nr plate could be given to him or her. in this solution the professional police officer has safe the government from any legal compensation

Louisiana may be flexible with their Traffic offenses but not jumping of a Red Light in Downtown Atlanta where the Police are everywhere. That is a source of revenue for the cities and towns, especially when is caught drunk and driving.

Has the AG been able to access the high risk in operating a vehicle without an insurance? If a vehicle without an insurance gets involved in an accident for an example and there are damage vehicles, properties and even death, who will bear the cost of damages and legal law suits?
Here in America in most states especially Texas if you operate a vehicle without an insurance, Police found you, immediately police issued you a ticket to go to Court, then the vehicle is immediately towed to the towing company’s storage. You have to find means of going to your destination. You have to get insurance coverage for your vehicle immediately before your court date. When you go to the court to prove that you have insurance coverage, you will pay judgment fines, court processing fees, then the Judge issues order of release for your vehicle. When you go to claim your vehicle, you will pay for the towing fee plus storage fees for the number of days the vehicle has been there before your vehicle is released to you. Sometimes people refuse to pay the towing and storage fees because the cost is higher than the value of their vehicle so is better to forget or tell them to keep the vehicle. After certain time if you don’t claim the vehicle, the company will auction itto cover the expenses.
So for AG to advise IGP on vehicles without Insurance not to impound them, is very rubbish and ignorant.
IGP educate AG on the high risk involved in this subject matter so AG will build a new sense of confidence for himself and his outfit.

What Dr, Bawumia is doing with the digitalisation Will help all of us in the near future to come. Those ghanaians who has travelled a lot outside the country will bear with me, only one example I'm giving. In a country called Qatar in the middle east where I have lived for years. Every information you give goes through their system which they call RP or your resident permit you will be arrested and charged at anytime if you don't have it on you, these permit is required every where you go it is always needed to transact business and even in certain shopping malls you have to give your RP or resident permit number. Qatar traffic police don't stress themselves to much, all over the country they have mounted cameras and digitalise everything you can be picked up at any little offence you commit your car number plate can be tracked at any time, when you cross the red light the police don't care but they will notify you with all the details and if doubt you will be call to their office and they will prove it to you, if you don't pay for your offence or charged you can't leave the country till you settle that amount, with the insurance the company will notify you earlier. Any time they came for a random check what they look for is expired driving licence or driving without a licence, RP or resident permit and drunkenness or having alcohol in your car without permit because we use a special permit that allows you to buy alcohol.

Good afternoon. I'm at a loss about the AG's directive. A driver, driving a vehicle without a Road Worthy Certificate. It simply means the vehicle is not supposed to be on the road. What should the Police do? Allow the said vehicle to be on the road? Since the vehicle has no Road Worthy Certificate, automatically, his Insurance is useless. Likewise if his Insurance is expired, but his Road Worthy Certificate is valid, the insurance is useless. If all the above is valid but the driver has no Driver's license, all the above is useless in case of an accident. So, do we allow the driver to continue driving his vehicle on the road if any of the above statutory documents are not valid? What happens when he's involved in an accident? What remedies are there for the victims, being occupants of the vehicle or any other person. I think the AG has to sit down with the IGP to find common ground on how to deal with such a driver and his vehicle. Blanket directive like this is not good for law enforcement. The Police can allow a vehicle without a Road Worthy Certificate , Insurance or driver without valid license to drive. But if an accident should occur, who suffers, is it the Police or the public. Don't forget no insurance company will not pay for claims for a vehicle without Road Worthy Certificate, Insurance or a driver without license. In any case, what is the purpose of all the above statutory documents? Driving through the red light and other such offences can be looked at in a different way without impounding the vehicle.
