Please Ghanaians, when there is a ruling, please take your time and read before you begin to chastise people and judges based on what you read online, having a little amount of non-standard products was not right and so was Opuni's rush to confiscate and burn the product without seeking legal mandate from the courts to do so. Thus, in as much as Dr. Opuni was in the right, he didn't have the power to determine what should be done to the products after seizure, if one finds a thief breaking into someone's home, do you kill the thief because you have the intention of stopping the thief from committing a crime? It's only when you may have thought of using the situation as an advantage to exercise your revenge or settle a personal vandetta, if not then Only the courts can determine, so the judge concluded that what Dr. Opuni did was unlawful though he was exercising his duty, and remember in law, even a procedural error can result in a no case ruling or even set aside a ruling after 50 years, so let's not chastise the judge but remember that even in the discharge of our constitutional mandate, we must always be guided by the law, the judge never stated, they found little sub-standard products so it was ok, NO, they ruling was based on the illegality of Dr. Opuni's actions.

Technically the courts MAY be right.....but I can assure you that Opuni KNEW something that you and I do not know and I dare say he exhibited his forthrightness by ignoring the appeal of the then president and Asiedu Nketiah because he knew that he was was doing the right thing and principle was on his side. I cannot pass moral judgement on Tobinco but neither can I castigate Opuni for doing what he thought was in the best interest of the collective when he took that decision. For Tobinco to grant this interview justifying "the small amount" of expired goods in itself is a HUGE problem. If I had was faced with making a choice between Opuni' s decision and Tobinco's statement I would side with the former any day. Our DNA is wired with too much corruption and we'll kill without remorse to make a few dollars.

So shouldn't he have consulted the Minister of Health in the first place, or sought the legal mandate from the court, we must not be seen to be doing the right things in the wrong way, we should always be guided by the acts that establish our various institutions and act accordingly, if we leave certain powers of determination in the hands of individual CEO's, trust me, things may get out of hand, Dr. Opuni was right but the approach was wrong, if he had acted cautiously, Tobinco would rather have been fined heavily instead of acting recklessly for us all to bear the cost. If one is hungry, it doesn't mean, you should eat with both hands, patience and being law abiding will take us all far

I remember an issue concerning two people who got injured on projects which were under the national security.
According to the National Security outfit then headed by Captain (Rtd.) Kojo Tsikata not to investigate the matter as a Labour Officer.
It was on record that the then Chief Labour Officer Mr. Obeng Fosu was driven out from the Blue Gate by the comandeos, who were guarding the place.
The Chief Labour Officer was stopped from conducting the investigation by the strong national security.
After two (2) hours Mr. Obeng Fosu called me to his office and narrated all what happened.
He added that he knew that I have had some military training in Cuba, so he is giving me the right to conduct the investigation.
I first visited the places where the accidents took place, which were the Unibrick Project at Dansoman.
I was so lucky to have meet the injured work man with the first phalange of his index finger cut off.
I also visited the State House which was then under renovation by the Chinese and got information about how the accident happened.
I then went to Korlebu to visit the second injured workman, who had his leg up to the ties smashed by a wall that he was pulling down.
With all those information, I then went to the Blue Gate, where I requested to see Captain Kojo Tsikata.
The commandos guarding the gate happen to know me and thought that I was an employee of the Bureau of National Investigation (BNI), so after a tough argument with them the let me enter through the Blue Gate.
Kojo Tsikata I was told has gove to the Castle, so I was instructed to see Dr. Don Arthur.
When I informed Dr. Don Arthur about my mission, his first statement was that the places the accident took place are security zones and no one is supposed to go there without authority.
He then threatened me with arrest, if I happen to set foot on those places.
I stood up, screeched my two hands forward and asked if he has a handcuff to put on my hand and take me to the police station.
Don Arthur said that he has nothing to do with me, and that he will not cooperate with the investigations.
I turned my back towards him before saying Dasvidanye, which is goodbye in Russian.
He then gave me a seat and we both had the issue resolved and the injured workmen were compensated accordingly.
To looks like Mr. Tobin was not in any case ready to cooperate with Mr. Stephen Opuni, having in his mind that he was then an executive member of both Ghana Employers' Association and Association of Ghana Industries.
But as I stated yesterday it was an Indian who informed me that Mr.Tobin went to buy from an Indian company drugs that the Ghana Health Service ordered.
So Tobin has used his connections with powerful people in power to get compensation from the Ghana Food and Drugs Administration through our courts.
The law gave power to every civil and public servant during and in the cause of his duties.
And I have narrated my use of that power to harass even the National Security.

Couldn't FDA differentiate fake drugs from genuine ones ? Per the judgement, Dr Opuni acted without taking the legal aspect of dealing with such cases into consideration. Now judgement debt is looming and Ghana is the looser because one man didn't discharge his duties professionally.
