  The natural law of CAUSE AND EFFECT must be applied here. At that hour of the night, everyone will act for self defence. Since only that lady ( passenger) was the only eye witness at that time and who clearly have interest in the case , can't be expected to speak the truth because of personal interests in the case. With all this said, this case must be thrown out for lack of substantial information as to what actually happened that led to the shooting at that material moment.
