  Even though the ruling by Bagbin ( and the precedent by Ocquaye ) two lawyers is quite idiotic considering the purpose of the clauses in Article 97, I don’t think the Supreme Court has the mandate to injunct Parliament.

  They cld have just gone ahead to make a constitutional interpretation of Article 97. And that wld have settled the matter . They can’t order Parliament around like that .

  The MPs have vacated their seats and therefore their parliamentary seats cannot be declared vacant. They are still MPs. The spirit of the Constitution is the the parties cannot whip them in line. So for eg. NPP no longer has ...

  The MPs have vacated their seats and therefore their parliamentary seats cannot be declared vacant. They are still MPs. The spirit of the Constitution is the the parties cannot whip them in line. So for eg. NPP no longer has the required number of MPs to claim majority caucus. It is not the same as if the MP has died. These MPs can still serve their constituents all be it as an Independent. Please the intent of the 1992 Constitution again. The Supreme Court has no authority in this matter period.
