According to the NPP, if an MP discloses an intention to go independent, he will automatically vacate his sit in the next parliament and not the current one. He knows he will automatically vacate his sit but will campaign and go into the contest, weather he wins or loses, he will still automatically vacate his sit. Is this not nonsense? If their constitution is not for the current situation, how can you vacate a future sit that you have not won.

This is a trap. Parliament rejected the writ. Technically it was not possible to serve parliament. If the Supreme Court raises this issue that they have no write to argue over something they did not receive, parliament will also say that well, since you agree that we did not receive it then case close. If the court fails to mention it and proceed with the case it will still come back to hunt them because it’s a fact that they were not served. That lawyer is extremely good.

ARTICLE 97, CLAUSES G & H:

(g) if he leaves the party of which he was a member at the time of his election to Parliament to join another party or seeks to remain in Parliament as an independent member; or

(h) if he was elected a member of Parliament as an independent candidate and joins a political party.

1. Why is NPP seeking to stop the same thing they did to someone four years ago? Karma is always at the corner.

2. Why is NDC pushing to utilize the same political game that is hunting NPP today forgetting Karma is also waiting for them. Lack of vision and patriotism.

3. Why is the supreme court getting itself involved in political gymnastics? Loyalty to the appointer not the nation.

The youth are watching your and lack of patriotism. Very soon they will take their future from your hands.

I find it strange that today you have not been able to express your view on the same matter.
Ofcourse,you alluded that the Fomena MP's case should have been a declaration from court.
Now we are in the Supreme Court,please say something.
As for me,Afenyo Markin can't challenge the Constitution and laws of which he is part of making them.
Going to court to challenge Article 97 as if he doesn't understand English is problematic.

Until the court dissolves the marriage, the couple are legally married. The final interpretations of the laws of the country lies with the Supreme Court. The Speaker has no right to reject the ruling. He has to appeal to full bench of the court. People should get this clear: the court suspended the speaker’s ruling to give the 2 parties chance to argue the case before them. The Speaker is not final arbiter for the laws of Ghana. That’s why he is going before them. Should the court rule against the speaker, what can he do? Can he Dissolve the Supreme Court?
