As a layman, my understanding of ARTICLE 97 CLAUSES (G) & (H) below reference MPs settles the matter beyond every reasonable doubt.

Why the Supreme Court needs to interprete this simply beats my imagination.

ARTICLE 97, CLAUSES G & H:

(g) if he leaves the party of which he was a member at the time of his election to Parliament to join another party or seeks to remain in Parliament as an independent member; or

(h) if he was elected a member of Parliament as an independent candidate and joins a political party.

What is so ambiguous about this simple English language for an interpretation from the Supreme Court?

As far as I know, none of the affected parliamentarians has joined another party during the current four year parliamentary session. Their intentions are for the next parliamentary session which begins in January 2025. Nowhere in the constitution does it say that they cannot switch party affiliations in the future parliament. For any parliamentarian to change affiliation, he/she has to formally notify the speaker and set in motion a process to change, and that only applies to the current parliamentary session. Bagbin should show us the letter of intent or the application from these MPs to switch.

The whole article 97(1) is about the 4 year tenure of an MP. And the clauses (g) and (h) is to prevent a situation where an MP who was elected by party A decides to do business for party B once they go to the House . That’s what they call cross carpeting. The NPP government during Adwoa Safos absence was struggling for numbers to pass bills . They cld have bribe some NDC MPs with ministerial appointments, cash or contracts to join them on the majority side. That wld have weakened the minority and destabilised Parliament . Besides that wld have been a betrayal of the mandate the constituents gave them . That is situation those clauses are to prevent.
It is not about the intentions of an MP in a future election. Because that wld have been an illegal curtailment of the MPs future political rights and freedom of association.
