That is the function of the Supreme Court ... which told him by its ruling to remain in his lane. Maybe, the problem is also with the 'constitutional provision' on the matter, which makes the process vulnerable in a polarised political space as ours.

The police can just not arrest you isn't it? Now, you are suspected of murder, should the police go to the Chief Justice to interpret the constitution before detaining you? Obviously NOT.
Even if there is a constitutional angle, the Supreme Court should deal with that constitutional aspect quickly than to say the police should stand down the arrest.
The legality at this stage is to go to the High Court.
Please you are rather looking at this issue with a political lens.The SC should have told Afenyo Markin to go to the HIGH Court which decision Toirkenoo herself have WRITTEN before.
All Tsatsu is saying is that if they wanted to depart from that obiter they should just say it but they cannot as they should give cogent reasons which they know they cannot.
Don't you see the senior NPP lawyers don't want to comment on this very issue?

If that is the case, then what was Bagbin's authority to vacate the four seats? Is Bagbin the High Court? Secondly, Tsatsu neglects the fact that Bagbin cited Article 97, which falls exclusively in the Supreme Court's mandate, to support his decision. Thirdly, if Tsatsu believes the issue properly belongs in the high court, then why didn't the Speaker refer it to that court for adjudication? It seems "legal luminaries" can also be blinded by political bias.

I don't know why lawyers are being so dishonest. The Supreme Court never said in their ruling that they have jurisdiction over declaration of vacant seats. What they they did was to give interpretation whether the speaker's ruling based on article 97 was constitutional or not which falls under their jurisdiction. Objective Ghanaians should know that there's no way Tsatsu will acknowledge that the Supreme Court did the right thing because it goes against the NDC. The same way he defended them in their election petition knowing well they lost the elections. That's part of the training of lawyers to know their clients committed a crime yet try to defend them in court and the media knowing deep down their hearts what the truth is. But, that shouldn't get to the level of trying to pull down the judiciary. It won't help anyone going forward even if the NDC comes to power in future. The NPP equally has the numbers to repeat this which to me is not the right thing to do. If the NDC wanted to respect the law, they would have gone to the high court to determine the case after the SupremeCourt directive. There's no short cut to justice. Untill that is done, you can't prejudicially set aside the orders of the Supreme Court and declare yourself majority. It could be possible that the high court declare those seats vacant but you don't say because you believe you're right you take the law into your own hands and became a court of your own. There has never been a case where a person who loses a case at the Supreme Court agrees with their ruling but it's always the case that the Supreme Court ruling is a law on itself and you must abide by the ruling unless steps are taken to reverse it.

Firstly, The negative/insulting response to Mr. Tsikata's comment on the Supreme Court's ruling are unwarranted and unnecessary. He is entitled to his opinion, just as any one.

Secondly, (and this is interesting), Mr. Tsikata's take on the case before the SC is about 'matters concerning parliamentary seat vacancies' which in his opinion 'lies solely with the High Court. Thus, he says the matter should have been referred to the High Court, (in line with previous decisions by the Supreme Court).

However, the SC had a different take on the case before it. To the Justices (and to some lawyers also), the case was about interpretation of the constitution, a responsibility which lies with the Supreme Court.

So the question perhaps to ask is, What was the case about?
Was it about vacant seats or constitutional interpretation?

I think it has become mathematics than law.
What could have happened if about 6 NDC MPs filed for Independent in this 2024 general elections?
Do you think NPP will allow them to stay in parliament?
Mind you,both NPP and NDC have equal seats of 137 with just 1 Independent in parliament.
Afenyo Markin ran to Supreme Court just to save NPP from going into opposition but not for any interpretation.
Just 1 member in parliament today is very significant because of the equality.
Therefore losing 2 NPP MPs and an Independent Member will shift the balance of power in favour of NDC.
That means the NPP will become opposition in parliament,infact that's their fears.
