The Clerk was surprised about this but that was his stand. Remember, he is still the speaker till new speaker is elected on the 6/7 of January. So he did not goof biaaa

  The outgoing Speaker of Parliament has nothing to do with swearing in the the 9th parliament. The clerk of parliament mandate is to sworn in all the gazetted MPs by the Chairperson of the Electoral Commission.
  So if EC disobey court orders, that is not the fault of the clerk. But Supreme Court will rather invite the EC Chairperson to explain why she disobey their orders

  No MP has been sworn until so far. The current parliament terms has not yet expired. The 8th parliament will resume on 2nd to try to pass the transitional budget. The current parliament term will expire mid-night on 6th Jan. Shortly after mid-night the new parliament( 9th) will be sworn in by clerk of parliament. The sworn in MPs will then elect/nominate speaker for the 9th parliament. So Bagbin remains speaker up to mid-night, 6th Jan. He is largely expected to to be renominated for the 9th parliament. Disputed MPs wont be sworn in until all legal issues have been resolved.
