  They were DISCHARGED, not acquitted. One can only be acquitted and discharged after the merits of the case have been delved into and the judge concludes that the accused was not guilty. However, if the case is withdrawn by prosecution, the accused is only discharged because the matter did not come to conclusion for the judge to determine whether or not the accused was guilty.

  Delivering a unanimous 5-Member Panel judgment, President of the Court, Justice Yaw Appau said the charges preferred against the accused persons did not meet the constitutional requirements of free and fair trial as provided for under article 19 and Section 122 of the Criminal Offences (Procedure) Act, 1960 (Act 30).
  
  The State had gone to the Supreme Court challenging a ruling of the Court of Appeal to the effect that the particulars of the offence levelled against Mr. Thompson were scanty.
  
  This case obviously did not start at the appeals court. So was the AG then not clutching on straws? . Either AG was incompetent or was harassing them because if you lose at high court lose at appeals court and lose at supreme Court...the pattern should be clear to you if you are sane
