THIS IS HOW THE DAILY GRAPHIC REPORTED SOME OF CHARGES LEVELED CHARLOTTES OSEI, BACK ON 2018!

From the findings we have made on the allegations made against Mrs. Charlotte Osei, the Chairperson of the Electoral Commission, it is clear she breached the Public Procurement Act, the committee stated.

In all the procurement activities which we had to investigate, the findings have been that Mrs. Charlotte Osei failed to comply with the Public Procurement Act.

"The procurement activities include the engagement of Sory@Law and Associates for the Commission, the award of several contracts to STL, the two contracts for the partitioning and consultancy service of the new office block, the three contracts awarded for the construction of pre-fabricated district offices of the Commission and consultancy services thereof; the two contracts awarded to Dreamoval Ltd, and finally the two contracts awarded to Quazar Limited from South Africa. Evidence before the committee showed that all these contracts were awarded by Mrs. Charlotte Osei contrary to the Public Procurement Act” the report noted.

“On this we disagree with Mrs. Charlotte Osei because we are convinced that procurement forms an important part of the core business of the Electoral Commission. Indeed, without procuring relevant goods and services, the Electoral Commission will find it difficult, if not impossible, to independently conduct free and fair elections in the country. In fact, procurement is so important to the Electoral Commission, that was why no less a person than the Chairperson is made the head of entity of the Commission.”The Committee said Osei was writing directly to seek approval from the Public Procurement Authority to do restricted and was also writing to companies to notify them of contracts.

The Committee thus contended further that “if procurement of goods and services was not part of the core business of the Electoral Commission as argued by Mrs. Charlotte Osei, why did she take over the above roles directly when there was a Procurement Unit with a Head in the Electoral Commission? We are of the opinion that Mrs. Charlotte Osei always knew that procurement was a very important part of the core business of the Commission, and that was why she personally took over the above roles.”

“On the whole, Mrs. Charlotte Osei’s persistent violation of the Public Procurement showed and in some instance incompetence as found in this report” the Committee stated.— Graphic Online: June 29 2018.

Charlotte Osei was exposed by her own deputies, including her own assistant Amadu Sule. Charlotte Osei was fired with her two deputies ( Amadu Sule and Georgina Opoku Amankwah)

Back then, some of the charges they brought against Charlotte Osei included breaching of the Public Procurement Laws : she was accused of shortchanging our country with inflated contract prices, hiring her own attorney Theodore Sory of Sory @ Law at the expense of the Ghanaian government. Changing the EC logo without due consultation with her deputies and other serious financial malfeasances.

It was also revealed that John Mahama released some GHC 44 million to be shared among the EC commissioners before the 2016 elections, but that amount was said to have fallen through the cracks — and kept by that stupid NDC hermaphrodite looking fool. So President Akuffo-Addo referred the case to the Council of State and former Chief Justice Sophia Akuffo ( Another NPP Turncoat) for consultations and adjudications respectively.

The Council Of State after carefully consideration recommended Charlotte Osei’s removal? So what did President Akuffo-Addo do wrong?

All the spoke person of the President said was, 3 petitions have been made against the Chief Justice and the President has forwarded them to the Council of State. When the Chair of Council of State and Former Chief Justice look a those allegation then advice the President to either throw them out ( Nana Addo , last year) or for the President to form a committee to look into it. Thats when Chief justice , you will be inform of those petitions.Even those processes have not been absolve yet, but Serwaa Essaaba, you are selecting Justices to hear this case on Aprol, 2nd already. Supreme court is a fast track court now, breath ooo breath.

She or her lawyers can go and state her case before the committee. Why is she trying to invent a different procedure apart from the one stipulated in the constitution at Article 146.
Give her copies to response to whom? Has anyone accused her of any wrongdoing for her to respond to that wrongdoing?. Since no prima facie has been established against her and no committee has been established to investigate her, her request for copies of the petitions now , is out of place.

This particular CJ, Gertrude Torkornoo is extremely corrupt and must not be allowed to stay in Office. She engages in naked rot and malpractices in the Judiciary without an iota of shame. The fact that a lot of people are endorsing her removal on social media and this very platform speaks volumes of her despicable actions and inactions as the head of the apex of the Judiciary. I am happy even key loyalists and highly respected persons associated with the NPP, like Ansa Asare, the former Director of the Ghana Law School essentially condemned her as not fit to occupy the position of the CJ. Nana Addo was very much noted for hand picking and putting people in positions they did not merit but at the same time was keen to expressly sack those with the requisite competencies and experiences he perceived as political opponents or sympathizers of the then opposition NDC.

My problem with this particular CJ, Torkornoo is not even about her competencies or experience but her conduct. She is synonymous with professional misconduct and ethical breaches against legal practices throughout her tenure as CJ. Some of the things she did in the judiciary and the Courts were not just corruption and corruption related practices but overt criminality in the Justice system, considering the extent to which she went to suppress or circumvent Justice in the interest of some corrupt high profile politicians and public servants. She invoked institutional structures and systems in the Judiciary and misuse her position as CJ apparently for selfish gains beyond politics and defence of a very corrupt regime under the erstwhile Nana Addo Presidency. This is a CJ who trampled on the fundamental rights, dignity and freedom of many ordinary Ghanaians who run to Court to seek redress for Injustice done to them. If you have a CJ willing to support the powerful and rich oppressing the poor and powerless in the Court , which is supposed to enforce the rule of law in line with democratic rights and constitutional order, then we are in trouble as a Country. A typical example is Government institution(s) represented by the AG seizing the license of an Employee, suspend him or her from work and terminate his or her salary with the backing of the Office of the CJ to suffocate and force the Employee out of the case as the Plaintiff in Court through crippling financial and economic sanctions to win a case through the backdoor, in no mean a Court but the Human Rights Court.All that Justice Torkornoo did was to willfully suppress the numerous petitions and formal complaints to her about interference with judicial processes and court proceedings in contempt of Court by the Defendants. If the CJ cannot ensure fairness and equity in respect of the law especially for a Self-Representative Litigant, who is a subordinate and being victimized by authority who were actually at fault , in unlawfully and illegally dismissing a subordinate who filed a suit in Court to challenge the violation of his fundamental rights, then she is not fit for purpose.
Choosing to suppress formal petitions against the Defendants who egregiously violated key provisions of the constitution, statutory laws, court rules and orders by justice Torkornoo both in her capacity as the Chief Justice and Chairperson of the General Legal Council was unprecedented and unheard of.

For CJ Torkornoo to allow the second Defendant in the case, the Ghana Medical and Dental Council which is a statutory body to predetermine a case, pass judgement and punish the Plaintiff severely with multiple suspensions on the same issues pending before the High Court for determination was incredibly shocking. In fact, the Ghana Medical and Dental Council with a Registrar as a Lawyer and Lawyer Lecturer, in the person of Dr. Divine Banyubala, did not just usurp the powers of the High Court but was essentially acting as an Appeals Court, when it is just a statutory body without the power of even a lower court, let alone a superior court of judicature, unfortunately with the fervent knowledge and support of Justice Torkornoo, who condone and connive in these illegalities and gross violation pf the law in support of the Defendants as public institutions. The representatives of the Defendants including the Ghana Health Service, the AG and the Medical Council constituted an illegal 'Appeals Court' beyond a Tribunal without the permission of the High Court to predetermine a case pending before the High Court with the tacit support of CJ Torkornoo. Is that the conduct of a CJ serious about her duties in maintaining law and order in line with her professional training, etiquettes and ethics?

Justice Torkornoo should cease talking and contesting her impeachment process. If the Government decides to publish or put some of the horrible things she did in the judiciary in the public domain, she will not be able to lift up her head and walk. It is a shame that she cannot even as a CJ effectively supervise over judicial administrative lapses that are significantly contributing to the moral decadence, malpractices and all manner of illegalities in our Courts, that are often design to oppress and suppress cases of vulnerable and powerless litigants, to circumvent justice in favour of the rich and powerful engaging in corruption and malpractices in public institutions. If you have a CJ who is startled, scared and compromised once a case involve top politicians, pubic servants and the State, then the safety of the justice system is not guaranteed in the interest of the ordinary citizens, as the majority of court users seeking accountability for some form of abuse and infringement of their fundamental rights by those wielding affluence and influence.

From where I stand, the incumbent Mahama Government cannot succeed with its anti-corruption crusade with Justice Torkornoo in Office. Initiatives like ORAL and the National Anti-corruption Program will backfire if she stays as CJ because Justice Torkornoo is a habitually corrupt person and professional.

It is obvious the NPP is fighting to keep her in Office to frustrate the efforts of the current Minister of Justice and AG, Dr. Dominic Ayine, who from all indications is doing a very good job in holding corrupt pubic officials of the erstwhile Nana Addo regime accountable for their
stewardship. The NPP with hindsight a lot more corrupt public officials of the regime involved in embezzlement of public funds will be exposed and eventually prosecuted, think they must necessarily keep Justice Torkornoo to do their bidding.

Unfortunately for them the Constitution is clear, in the exercise of executive powers at the prerogative of the President to dismiss a public official including the Heads of both the Judicial and Legislative arns of Governments. The President also have several historical antecedents to cite since the norm is that article 71 office holders are generally removed in consultation with the Council of State, when there are petitions against them on grounds of stated misbehavior or professional misconduct in Office. Since law is about authority, several article 71 Office holders hitherto have been removed from office when there are such impeachable petitions against them by the same process HE President Mahama is going by, as the standard and accepted norm in Ghana over the years. Why should the status quo change for Justice Torkornoo? She maybe a senior citizen but not a special person as far as the Constitution of Ghana is concerned.

In any case, why the panic action in the Supreme Court by the NPP and its functionaries just because they feel the bench or jury will favour them with loyalist Judges? It will turn up to be the opposite because there is now a Nationalistic and Patriotic feeling of duty to State with the resetting agenda for the Country under President Mahama, especially in the area of corruption fight in which Justice Torkornoo will end up disappointed in her audacious attempt to ride on the back of a Tiger. The skeletons that are being hidden in the Judiciary and beyond will be exposed at all cost.
