Otherwise what has Tokornoo done to call for her head? Even when Charlotte’s was thrown under the bus by her own deputies, a situation and case for removal that was bolstered by prima facie evidence of procurement breaches and abuse of power, to mention the least; that’s according to numerous Ghanaian newspapers and the result of credible investigations, but John Mahama wasn’t ashamed to defend her at the speech he gave at the CHATHAM HOUSE in 2023.

“The actions of Electoral Commission Chair Jean Mensa and her deputy commissioners, since President Nana Akufo-Addo ousted then-Chairperson Charlotte Osei, have undermined their independence and neutrality, former President John Mahama has said.  In a lecture on 'Africa's strategic priorities and global role' at Chatham House, London, Mr Mahama said he used the Charlotte Osei ouster to demonstrate how African leaders undermine institutions of democracy to entrench their stay in power. "Africa needs to build stronger institutions to address institutional and political decay", he said, explaining: "In building stronger institutions, civil society organisations (CSOs) in Africa must also be prioritised". 

On this note, Mr Mahama commended the "many CSOs on our continent that are holding governments accountable" since, in his view, "compounding the socio-economic malaise on the continent, is the erosion of public confidence in state institutions"— ..

My Take:

In so doing, John Mahama has already undermined any sound argument of discretion to remove the Chief Justice who has not committed any crime against the state: Be it financially, morally or politically.

Let me repeat! Kwaku Azaa’s argument doesn’t merit any case for removal, there’s not enough evidence to remove the head of the country’s Judiciary who is supposed to be independent, according to the Ghanaian constitution because of some personal sentiment of cacophonous American based technocrat!

1. Supreme Court Nominations:
Does the GBA support the Chief Justice personally selecting and submitting five names for Supreme Court appointment — contrary to Article 144(2) of the Constitution?

2. Nomination Criteria:
Will the GBA explain what criteria the Chief Justice used in choosing her five nominees — and whether it meets constitutional standards of merit, transparency, and fairness?

3. Usurpation of the Judicial Council’s Role:
Does the GBA condone the Chief Justice bypassing the Judicial Council, the body constitutionally entrusted with recommending nominees to the Supreme Court?

4. Backroom Deals on Judicial Appointments:
Does the GBA support secret backroom exchanges and entanglements between the Chief Justice and the Executive over who sits on Ghana’s apex court?

5. Reconstitution of Panels:
Will the GBA defend or condemn the practice of reconstituting Supreme Court panels to engineer preferred outcomes — a blatant violation of decisional independence?

6. Unconstitutional Directives:
Does the GBA believe the Chief Justice can lawfully issue administrative directives that bypass constitutional procedures and established checks?

Until the GBA meaningfully addresses these serious constitutional questions, it ought to suspend its resolution calling for the revocation of the Chief Justice’s suspension.

This is what happens when you get your association mired in previous matters that required plain honesty and patriotic duty to the entirety of Ghanaians. The GBA failure to carry majority of Ghanaians along is because of their group interests and disdain for others who don't share and agree with their extreme partisan postures. Over the years, these group of persons by virtue of professional acquisition, have assumed the position moral high grounds and virtually bullied those who don't belong to their Fraternity in condescending manner.
All they do, to those who don't belong to their Fraternity, is to wait and pray in the wings for their compatriots to get into legal troubles for them pounce on them under the guise of providing some protection if only they who find themselves at the wrong side of the law will pay for the service.
Where were they when Charlotte Osei, also a Lawyer, was taken through a very very opaque process of removal from the independent position of Electoral Commissioner? Association full of prevarications, hypocrisy and very very shameless.
Painful as it may be to them but the truth must be told.
Call out names of so called prominent lawyers identified with a particular political party and none comes without any form of blemish. All one has to do is a bit of "garden digging" and voila!

The Ghana Bar together with Torkonuuu has succeeded destroying everything about law in Ghana. To fix it, get rid of Ghana Bar then appoint new people to that place. Familiarise yourselves with trends and opinions and perceptions of the many ordinary Ghanaians and their their views on the chief justice! The majority of Ghanaians say she's that bad and under her leadership, the judiciary is seen as corrupt and not to be trusted. So the sanity of of judiciary, it will do all of us going if the current chief justice is in fact, leaves her current post. She needs to either resign, leave quietly or be sacked. The GBA, doesn't substitute the majority of Ghanaians who have lost confidence and trust in Madam Araba Tokorno. She needs to go or be sacked. To Mr President, please uphold the suspension and subsequently dismiss her. Thank you.

Rejoinder: Associates Ghana Rejects GBA's Call for Reinstatement of Chief Justice Torkornoo

Associates Ghana rejects the Ghana Bar Association’s (GBA) call for the reinstatement of Chief Justice Torkornoo as stated in their recent resolution. This position raises significant concerns regarding the interpretation and application of the 1992 Constitution, which remains the supreme law of our land.

We challenge the GBA to point to any specific provision in the Constitution that authorizes them to pass a resolution for the reinstatement of a suspended Chief Justice. The Constitution provides clear guidelines for the processes surrounding the suspension, investigation, and removal of public officials, including those in the judiciary. The GBA’s attempt to bypass or override these constitutional processes is deeply troubling. The GBA cannot assume powers beyond its mandate, particularly in matters that fall within the remit of lawfully established institutions.

The issues surrounding Chief Justice Torkornoo, like any other allegations involving public officials, must be handled by the relevant constitutional bodies. The GBA cannot, and should not, seek to interfere with or undermine the processes that have been laid down for such matters. To call for the reinstatement of the Chief Justice without proper investigation is to disregard the importance of due process and accountability.

Associates Ghana strongly believes in the principles of justice, fairness, and transparency, which are enshrined in our Constitution. Investigations into any allegations, including those concerning the Chief Justice, should be allowed to proceed in a manner consistent with the rule of law, free from external influence or interference. The Constitution provides for a framework to handle such matters, and this framework must be followed to ensure that justice is served and the integrity of the judiciary is maintained.

We urge President Mahama, as the sitting Head of State who has taken an oath to defend the Constitution, to ensure that all constitutional processes are followed to the letter. The investigation must be allowed to proceed impartially and in full compliance with the law, as the Constitution requires.

Associates Ghana calls on the GBA to reconsider its stance and to allow the legal processes to unfold as prescribed by the Constitution. The rule of law must be upheld, and no individual, regardless of their position, should be exempt from scrutiny. We stand firm in our support for the Constitution and in ensuring that all public officials are held accountable to the highest standards of justice.

I thought that in an association,it is free entry,free exit? And do two lawyers intemperate the law exactly the same?
