How long you will continue to stay is a separate issue mostly to be determined by immigration. I don't think you can apply for, or extend your visa while you're ALREADY IN the States. However, you can apply to extend the duration of stay.

If you are going to stay for more than 90 days continues, then u must apply for staying permit based on the visa the when u arrive in the country.

No that is not correct,in Ghana you get a visitor Visa for 60 days ,and you are allowed three 90 days extensions ,which means you can stay in the country up to 11 months in any one year.

We are conflating 2 things. Length of validity of visa and length of stay. A 5-year valid US visa does not mean you can go and live in the US for 5 years. Each time you enter the US (or any country) with a valid visa, you are given a length of stay. Usually 6 months or less. At the end of 6 months, you are expected to leave. Beyond this, you’ve overstayed and subject to deportation. The 5-year visa only means you can enter the US whenever you want during the 5-year period. But each time, you can only stay for so long. It sounds like Ofori-Atta’s valid visa expires on February 14th. But it appears his length of stay has expired. Hence his arrest by ICE.

If just applying for an extension of stay lead to detention then it means there is a higher prima faci case other than that of a visa extension cooking. Only people with criminal records gets detained by the ICE even whiles their visa is still valid. Given that Ken Ofori-Atta worked on Wall Street for a period and was educated in the United States, it is reasonable to assume he understands the U.S. immigration and investment landscape. It is therefore surprising that he does not appear to have qualifying investments that could support a pathway to permanent residency. Alternatively, U.S. immigration law allows for limited visa extensions on medical grounds which is temporary and capped at about 3 to 19 months, would not amount to an indefinite stay, contrary to some public assumptions.

Some of us Ghanaians don't care to know why the fugitive Ofori Atta has been detained by the US ICE authorities. All we know is that Ofori Atta is wanted to answer questions of corruption allegations against him fo which he's been evading until now.

Secondly, his arrest has served as notice to all others who think they can use their ill gotten wealth to hide in the United States of America and avoid being arrested. Whether Ofori Atta's detention is in connection with his visa extension application or not, temporal detention is where he rightly belongs to.

This must serve as warning to African leaders who are fond of stealing monies, that irrespective of their wealth and status in society, they aren't different from others and cannot always get away with their evil deeds against their citizens.
