Those who see a judge are those requesting refugee status establishment. In the context of U.S. immigration, Notice to Appear (NTA) is a formal document issued by the Department of Homeland Security (DHS) to initiate removal (deportation) proceedings against an individual in immigration court.

It is never in respect of an application to extend one's stay in the US. Indeed the ICE cannot deport Ken upon his arrest. They will need to go to court for that official order and that is what they are doing with the 20th January 2026 court appearance.

You claim Ofori-Atta has applied for an adjustment of immigration status in the USA, but was he honest enough to disclose that he's facing criminal charges in Ghana for corruption? That looting Ofori-Atta thought he was playing tricks on Ghana authorities by stating that he was going to voluntarily return to Ghana to face the charges against him all the while deviously trying to use the USA immigration process as a way to keep from being returned to Ghana. Ofori-Atta ran to the USA right after his party lost the election, and he did so to evade the Ghana authorities that he knew would come after him for his looting ways. The US immigration authorities should deny his request for status adjustment because he's deviously attempting to escape the long arm of the Ghana law that wants him back in Ghana to account for his criminal conduct while he was Ghana's Finance Minister. Nor should the US immigration authorities overlook the fact that there's an active warrant for Ofori-Atta's arrest issued by the Ghana Police, as well as a resulting extradition procedure against him in the USA.
