Supreme Court dismisses Wesley Girls' Board application in religious rights case

A seven-member panel of the Supreme Court has dismissed an application by the Board of Governors of Wesley Girls’ High School seeking to strike out a suit over alleged religious rights violations.

According to a starrfm.com.gh report on Wednesday, April 29, 2026, the Board had argued that it is not a juristic person and therefore cannot be sued, urging the court to dismiss the case.

The plaintiff, led by Abdul Aziz Gomda, and the Attorney General, represented by Deputy Attorney General Justice Srem-Sai, opposed the application and asked the court to dismiss it.

They maintained that even if the Board lacked the capacity to be sued, it would still be responsible for enforcing directives from the Ghana Education Service (GES), which is a party to the case.

Delivering its ruling, the panel chaired by Chief Justice Paul Baffoe-Bonnie held that the Board can be sued, and therefore dismissed the application.

The substantive case was filed by private legal practitioner Shafic Osman, who is challenging some policies of the school, claiming they violate the rights of Muslim students.

The suit is asking the court to declare as unconstitutional directives that allegedly compel Muslim students to take part in Christian worship and restrict their ability to practise Islam.

Earlier proceedings saw the court grant the school’s Board time to respond to the claims.

The Board, however, raised objections, arguing that the proper party to be sued is the Trustees of the Methodist Church, which owns the school’s land and assets.
