Thomas Partey did not physically appear in the Federal Court in Ottawa. His legal team handled the judicial review in the courtroom on his behalf. Under the Canadian Immigration and Refugee Protection Act, a foreign national who is denied a visa from outside the country is completely entitled to file a legal challenge—called a Judicial Review. This allows their lawyers to argue the case in a Canadian court to overturn the refusal without the applicant needing to step foot on Canadian soil.
