The judge can reject the deal – Amaliba reacts to Wontumi plea bargain

NDC stalwart, Abraham Amaliba has revealed that any plea bargaining agreement reached in Chairman Wontumi’s case will still require judicial approval.

He explained that the court is not obligated to accept every agreement negotiated between prosecutors and an accused person.

“The judge has the right to refuse to adopt a plea bargaining agreement,” he said on TV3’s New Day.

According to Amaliba, the court may reject an agreement if it believes the arrangement does not meet the required legal standards.

He also noted that the court has given the parties 30 days to complete discussions relating to the plea bargain.

“When the period expires and no agreement has been reached, the court will proceed with the case,” he stated.

Amaliba added that negotiations can continue while court proceedings are ongoing and can later be presented to the judge if an agreement is reached.
