An Accra High Court has dismissed a submission of no case filed by former Ghana Infrastructure Investment Fund (GIIF) Chief Executive Officer, Solomon Asamoah, and former Board Chairman, Professor Christopher Ameyaw-Akumfi, in the ongoing Sky Train trial.

According to the Deputy Attorney General and Minister of Justice, Dr Justice Srem Sai, who confirmed the development on his Facebook on Thursday, July 2, 2026, he stated that the court ruled that the prosecution had presented enough evidence for the two accused persons to open their defence in the case involving an alleged US$2 million financial loss to the state.

He noted that the court rejected the defence argument that the Republic had not provided sufficient evidence.

He said the court has now ordered the accused persons to respond to the charges against them.

“A while ago, the High Court dismissed the submissions of the two Accused Persons in the case The Republic v Solomon Asamoah & Prof Christopher Ameyaw-Akumfi. The two gentlemen made a submission that the Republic has not provided enough evidence to the Court,” he disclosed.

“The Court has since directed them to open their defence and give reasons why they should not be convicted for causing US$ 2 million loss to the nation,” he added.

The case, The Republic v Solomon Asamoah and Prof Christopher Ameyaw-Akumfi, relates to a US$2 million payment made in 2019 for the proposed Accra Sky Train project.

According to the prosecution, the money was paid by the Ghana Infrastructure Investment Fund for an equity stake in a project development company set up to develop the rail system.

Additionally, the prosecution believes that the payment was made without proper board approval, and the Sky Train project was never executed, leading to financial loss to the state.

The two accused persons are also accused of conspiring to cause financial loss and misapplying public funds.

However, lawyers for Asamoah and Ameyaw-Akumfi had earlier filed submissions of no case, arguing that the prosecution had failed to present enough evidence to require them to open a defence.

Prosecution wraps up case in Accra Sky Train scandal

The defence argued that the US$2 million was not meant for the construction of the Sky Train itself, which was estimated at about US$2.6 billion, and therefore did not amount to direct project funding.
