Supreme Court to interpret Article 66 in three presidential term-limit cases

Deputy Attorney General and Minister for Justice, Dr Justice Srem-Sai, has confirmed that three separate cases are currently pending before the Supreme Court seeking an interpretation of the presidential two-term limit under Article 66 of the 1992 Constitution.

In a post shared on X on Friday, July 10, 2026, Dr Justice Srem-Sai said the cases are Azubila E Salam v Attorney-General (J1/4/2026), filed on December 23, 2025; Kenneth K A Kuranchie v Attorney-General (J1/20/2026), filed on June 30, 2026; and Ganiwu Alhassan v Attorney-General (J1/21/2026), filed on July 9, 2026.

According to him, all three suits seek the Supreme Court's interpretation of whether the constitutional provision limiting a president to two terms applies only to two consecutive terms or to any two terms, whether consecutive or otherwise.

"I can confirm that these cases are pending in the Supreme Court on the broad question: Whether the two presidential term limit clause in Article 66 of the Constitution means (a) two terms back-to-back only, or (b) any two terms, whether back-to-back or not," Dr Justice Srem-Sai stated.

His comments come amid growing public discussion over the constitutional interpretation of presidential term limits.

The Supreme Court is expected to hear the cases and provide a definitive interpretation of Article 66, a ruling that could clarify the constitutional position on presidential tenure in Ghana.
