Wontumi Case: Only Supreme Court interprets the constitution - Kwesi Botchway Jnr

Lawyer and NPP member Kwesi Botchway Jnr says Chairman Wontumi’s legal team has identified about 20 grounds on which they intend to challenge his conviction and sentencing.

Speaking on Joy Prime, on July 25, 2026, he said he had met with Chairman Wontumi’s lawyer, Leonard Samoah, who was preparing to file a notice of appeal.

“I was with him last night. So far, he’s been able to deduce about 20 grounds of appeal. I am very sure that on Monday, God willing, he’ll be filing a notice of appeal at the Court of Appeal,” he said.

Botchway Jnr said one of the key issues to be raised concerns constitutional interpretation.

“The first point is the matter of the constitutional issue that learned counsel for Chairman Wontumi raised in the matter,” he said.

He argued that the authority to interpret constitutional provisions rests exclusively with the Supreme Court.

"It is settled law and a matter of constitutional jurisprudence that the obligation or jurisdiction to interpret provisions, statutes and other laws is the sole preserve of the Supreme Court under Article 130 of the Constitution," he stated.
