If a property has a document saying: this property belongs to person A and person B, then whether they are FRIENDS, BROTHERS, MARRIED,etc, that property belongs to BOTH.

In short: as long as the name of the wife was lawfully (not forged) on the ownership document, the property belongs to both.

The fact that this lady got married to the present husband while still married to another man should have nullified the marriage making her marriage illegal. Yet the court which should have known better and applied the law decided that the lady has a share in the house and therefore she is entitled to half of any revenue generated from the sale of the house . The fact that both couple’s name is on the property does not mean that the woman has a share in the property. That was an illegal marriage and anything about it should have been declared illegal by these so called learned judges . Our traditional chiefs would not have arrived at the same decision as these judges .
