Most of these judges were appointed by the NPP when they were in power and some of them are related to or are very close to Kuffour and Akuffo Addo.
If anybody has to be complaining, it has to be the NDC and not the NPP.
The NPP cannot continue with their shenanigans.
They are taking their members and in fact all Ghanaians as fools but no ,Ghanaians are not that ignorant.
They wanted the whole case to be broadcasted live but as soon as they realise they have a problem, they decide to have certain issues heard in camera.
They continue to show how ignorant and stupid they all are.
These educated fools should stop the shenanigans now. It's pathetic, riddled with desperation and driving nails in the NPP's coffin.
Ghana needs a credible party to be in opposition and from what we see so far, the NPP is currently not that one until they get rid of all these ignorant 'chew and pour' graduates.
It’s about time the clever one in the NPP stood up against Nana Akuffo Addo and his mob, who are slowly killing the NPP ,embarrassing their members who voted for them and indeed our dear country.
Ghanaians do not want the NDC to have a field day in the parliament and indeed the next election.

Apak is very right. Not only are we going to import Justices, but this case will drag in court for years. Many of those Supreme court Judges has one link or the other to the NPP, so if the the NPP thinks our Judges do not have the credibility to detach their social connections from professional judgement, then all NDC will do is to also object to any panel until all the judges have been discredited. I beat you this tussling will take considerable time before the substantive case is heard.
After that we may then import Judges may be from Afganistan to hear the case.
One question bothering me is, if the NPP claimed they have such indisputable evidence, then why should they be nervous about the type of panel?

NPP Is Anti-Rule of Law Party

Until recently, I held the belief that when it comes to the tenets of democracy and the ethos of rule of law, the parties from the Danquah-Busia tradition including the NPP stood high above all other parties in Ghana. Sadly, I have had to review this position after a critical examination of actions of the two governments that have been formed by the UP or Danquah-Busia tradition and their attitudes towards the rule of law particularly, judicial decisions that were against the two governments. These were the governments of the Progress Party led by the late Prime Minister Dr Kofi Abrefa Busia and the National Patriotic Party under former President John Kufuor.

The best example that comes to mind was the first government of the Danquah-Busia tradition under the Progress Party government. That was the infamous “No court”, “No court” in the “Apollo 568” Supreme Court Judgement. For those who are unaware of the case, the Busia government summarily dismissed 568 public workers without reason in pursuant of Section 9 (1) of the Transitional Provisions under the 1969 Constitution. The Transitional Provision granted that, all positions “established” by the then National Liberation Council (NLC) government (the military junta that overthrew Nkrumah’s government in 1966) will be discontinued no longer than six months of coming into force of the Constitution.
Mr Sallah was appointed GNTC Manager by the NLC and was therefore one of the dismissed public servants. As a victim of the 568 he challenged the legality of his dismissal and the case went to the Supreme Court. The Supreme Court by a majority decision ruled against the government. To the surprise and disappointment of those who believed in true democracy, the rule of law and respect for the judiciary, Prime Minister Busia in a highly emotional radio and television broadcast on the night of April 20, 1970 attacked the judgement of the Supreme Court, boasted and stated emphatically that, “No court could enforce any decision that sought to compel the government to employ or redeploy anyone”.
The Busia government tried to defend its rejection of the Supreme Court judgement by claiming conflict of interests involving two of the Justices. Prior to the hearing, the Attorney General at the time raised a preliminary objection to the composition of the Court. The State objected to Justices Apalloo and Sowah being empanelled because the former was alleged to be a close friend of Mr Sallah and the latter’s sister was married to one of the Apollo 568 victims and the sister had asked him (Justice Sowah) to intervene on her husband's behalf, which Justice Sowah did (as per the then Foreign Minister’s affidavit). However, the objection was overruled. The issue at stake was whether a GNTC Manager appointed by the NLC came under the ambit of section 9(1) of the 1969 Transitional Provisions. In my view, a GNTC Manager was not a position “established” by the NLC but existed prior to NLC and so predated the NLC itself. Mr Sallah was merely appointed into an existing position and not into an “established” position. Though the conflict of interest was valid, the outcome could have been the same without Justices Appallo and Sowah.
For a government that boasted of a strong belief in democracy, the rule of law, the separation of powers and the independence of the judiciary and also led by no other person than Busia who the present NPP claims to be the doyen of democracy in Ghana and Africa, it was the worst form of abuse of Executive powers and total disregard for the separation of powers. Even some of his own supporters and party followers including the late Prof Adu Boahene were disappointed by Busia’s response. This is how Adu Boahene described the response at the time, “the speech did not only shock the bench but also those who have read Busia’s work on Democracy in Africa, the Rule of Law and the Theory of Separation of Powers”.
Under the NPP government, Ex-President Kufuor was also accused of allegedly manipulating the Supreme Court to reverse an earlier judgement that went against his government by appointing pro government Justices to the Supreme Court, instead of accepting the original judgement of the Justices. It was also alleged that in the case of the State vs Tsatsu Tsikata, the Judge was influenced by the Executive to give her judgement unexpectedly in the absence of his Attorney. These fragrant abuse or misuse of Executive powers cast a slur on the democratic credentials of the Danquah-Busia tradition, particularly, in the area of rule of law, separation of powers and the sanctity of the judiciary.
The third example was an article that appeared on Ghanaweb on January 5, 2012, an alleged Press Statement by the current Attorney General in response to a statement by the former Attorney General under the NPP administration regarding the payments of various judgement debts under the NPP administration (see How Kufuor & Co Caused Ghana Trillions of Cedis). From the statement it appears the NPP government simply refused, disregarded or ignored the various judgements by competent courts of jurisdiction in Ghana to pay judgement debts against the state. In fact, NPP government contested some of the claims up to the Supreme Court and lost, yet ministers refused to comply with the court judgements. The total disregard for the judiciary was tantamount to breach of the Constitution, negligence of duty or abrogation of duty by the government. It is unbelievable that a government of a party full of “legal luminaries” who portray themselves as a party of law and order with a firm belief in democracy, rule of law and respect for the judiciary could show such utter contempt towards the judiciary.
It is the prerogative of every government to review and or reverse decisions of previous administrations including termination of agreements and contracts entered into on behalf of the state. This happens globally at local, regional and central government levels and even at organisational levels for whatever reason/s. However, any revision or termination of existing agreements and contracts must be done within the spirit of the terms and conditions of such agreements/contracts, otherwise breach of agreement/contract may occur, which could result in the other party to the agreement/contract to claim or sue for compensation. I am not an expert on Contract Law but one does not need to be an expert to know this common sense principle. I also know from experience of managing contracts, including over £16 million per annum public contract in the UK that sometimes terminating legally binding contract without due regard to the terms and conditions could be more expensive than allowing the contract to run its full time.
I am therefore not questioning the decision of the previous NPP ministers to review revise and terminate or refuse to honour agreements and contracts entered into by the previous NDC government, which they had the right to do so but their total disregard to follow the due processes for such matters as well as their disrespect for the judiciary. The fact is that, having breached by their unilateral and illegal decisions which resulted in the other parties to the agreements/contracts exercising their legitimate rights to claim or sue the state for compensation, the same ministers did not only fail to defend their actions and omissions in courts or their defence fell short of reasonable explanation, but also failed to abide by the court judgements. These are matters that beat my imagination and which led me to question the party’s, especially its leading members’ belief in the rule of law and the judiciary. For example, how could the ex-NPP government and its Attorney General/s justify the decision not to honour the agreement with Calf Cocoa of $1.8 million resulting in additional cost of $1.75 million to the state after Calf Cocoa sued the government and won? Why in 2007 after the then Attorney General failed to file a defence in court when Rockshell successfully sued the state for compensation also refused to pay the judgement debt that now allegedly stands at about $87 million (which has been negotiated to $35 million?). Why in 2001 did the NPP government refuse to pay a judgement debt of $10 million to City and Country Waste Ltd after a Supreme Court judgement, that the state is now paying $29 million? How could the NPP administration defend their decision not pay a judgement debt of GHc 50, 279 in 2003 which now stands at GHc 6 million?
The above are examples of the Busia-Danquah tradition’s disdain towards the rule of law and the judiciary. The actions of the NPP were either incompetence at its highest order, negligence or sheer arrogance by ministers of the administration. Perhaps, they thought they were above the law but by their incompetence, arrogance and disrespect for the rule of law, Ghana is paying a high price for such irrational behaviour and abuse of Executive powers. Their actions and omissions on these matters are legally reprehensible and morally “contra bonos mores”. I have no doubt that such negligence of duty by the previous NPP government could be criminal. Though I am not a fan of the crime of “causing financial loss to the state”, as it could be abused by politicians against their opponents, there is the need for those who made these decisions, especially the then Attorney General/s to account for their actions and omissions. These are the very people who are today accusing the NDC administration of incompetence and doing anything and everything to seek the mandate of Ghanaians again. They claim some were excellent Attorney Generals. The fact is, there were incompetent and arrogant ministers in NPP administration and not only NDC ministers are incompetent.
Another example is the ongoing “Woyomegate”. As far as the Woyome saga is concerned, it does not make sense to me and appears to me that there is insanity at certain level of government in Ghana but that is not the subject of this article. A former Finance Minister under the NPP administration is reported to be refusing to submit himself to the Economic and Organised Crime Organisation (EOCO) to answer questions regarding judgement debts against the state during the NPP administration. The NPP as a party has “cleverly and conveniently” issued a statement that because the President rejected a suggestion for an independent commission to investigate the matter instead of EOCO, it has advised its members not be part of the EOCO investigations. Why do I say cleverly and conveniently? NPP claims that the President’s order to EOCO to investigate the payment to Mr Woyome contravenes the constitution because it is only Parliament that has powers to deal with matters arising from the Auditor General report. If that is the case, then, why did the same NPP call on the President to set up an independent commission to investigate the payment and would such action by the President not contravene the constitution as he would have usurped the powers of Parliament as is being claimed by the party?

The answer to the earlier question is that, NPP cleverly and conveniently wants a Presidential Commission because those who appear as witnesses before a Presidential Commission are granted automatic immunity from prosecution as was the case in the Ghana@50 Inquiry. NPP is scared of some of their leading members including former ministers being found wanting and being prosecuted, so they want to avoid accountability at the courts. Clever, isn’t it? But sadly their luck of misusing the judiciary to their advantage may have run out this time because the President has learnt his lessons from the Ghana@50 Presidential Commission and not repeating it to give a blanket amnesty to those who by their actions, omissions and negligence have contributed to the financial burden on the state. If NPP believes in democratic institutions then they should support democratic institutions such as EOCO to do discharge their responsibilities unimpeded instead of undermining it by refusing to cooperate with it. As Obama said, “we need stronger institutions”.

In my opinion, the Danquah-Busia tradition is anti-rule of law and no friend of the judiciary. In fact, they play the judiciary to their parochial interests but pretend to be defenders of rule of law and the judiciary in Ghana. That is far from the reality. Sadly and sometimes naively, some leading members of the NDC make public pronouncements that are anti-judiciary such as the “there are many ways of killing a cat” and the accusations of corruption against judges, whilst on the other hand, NPP leading members portray a public image of friends and defenders of the judiciary when their actions in the past are anything but pro judiciary. Of course, the treatment of the judiciary under the PNDC era is also a reminder of the anti-judiciary image of the NDC but frankly speaking, NPP also has disrespect for the authority of the judiciary in Ghana.

The “legal luminaries” within the NPP including the former Attorney Generals should respond to the matters raised herein and persuade me that, the Danquah-Busia tradition including NPP is not anti rule of law party. Please do not remind me about the responses of other past governments such as Nkrumah’s responses to judicial decisions because we know such governments were undemocratic. I am questioning the validity of a postulate that is supposedly rooted in a strong belief in democracy, rule of law and respect for the judiciary and not dictatorships.

This suggestion came to being, as the contesting NPP are in a state of confusion; it's not ready in its argument to proceed or reject its initial intent. It is however fair to say, the Party got shocked on the results; it had no concession speech besides the prepared acceptance note. He had to throw in something, to looked he was message; a readiness that does not exist or in records!
As each day is wasted, thanks to DEMOCRACY, the Party looks much weaker in support as well as on strategy.
Shut the Party down and rebuild from the bottom up with help from the ever growing dessidents within.

The NPP cannot lose an election which has been widely acclaimed by both domestic and international observers as transparent, free and fair and then file a bogus lawsuit to challenge the EC’s presidential results at the Supreme Court and again arrogantly tell Ghanaians who should sit on the panel and who not. They are provoking a situation where the government or president Mahama will use his executive powers to quash their stupid petition and then they turn around to blame him. It is the same old modus operandi. They did it to Nkrumah, to Limann and now Mahama. They hold this country to ransom each bloody time they lose elections thereby creating unnecessary tension and fear so that they set their rumour machines in operation.

Ghana would have been by now in the league of nations like Singapore, Malaysia, Taiwan, South Korea were it not for these nation wreckers who arrested our development in 1966. The Mate Mehus are a hindrance to our economic Freedom as well as social Justice. They hate Ghana which is why they boycotted our independence celebration. Fifty years later in 2007 they celebrated lavishly for missing out on the real thing of March 6, 1957. What a bunch of idiots!

The Supreme Court is not a special request or yours for the asking radio station. The NPP cannot cherry pick the judges as they wish. Who they want and who they dislike. The NPP gambit of playing chicken must be met with the same gamble head on. Who made these sycophant elephants the guardians of Maame/Daavi Ghana? Their lawsuit gimmick in order to save their bruised faces through backdoor exit is so transparent and childish. They started this comedy in the media when they lost and now given it a notch by making a mockery of our justice system. The NPP slapsticks are not funny anymore. The must go off the center stage and stop abusing our judiciary system.

The NPP has the right to go court but not the right to be prejudiced or reject of any Judge who does not fit into their current bias concept. They should bear in mind; the constitution has also a section which also condemns such attitude of the NPP. Besides, the constitution has also a section which authorizes the president seek first the tranquility and security of the Ghanaians and the nation. This section of the constitution must be applied. Period. End of discussion.

The American Supreme Court consists of nine members who are liberal, moderate and conservative. They were appointed by various presidents depending on a conservative or democratic president. The Judges are appointed for life or until they choose to quit on health grounds. Nonetheless, it will never occur to any American, party, group or whatever to question the integrity of these members. Their judgment is final.

If the NPP has qualms with Mahama appointed Judges then all those appointments made by Kufuor must also be under NDC radar for scrutiny. If the NPP continues on this path then there will be no Judges sitting on the panel and their bogus lawsuit will be declared null and void. For where there is no Judge to oversee the proceedings a judgment cannot be passed. Bring it on NPP. Let’s play chicken!

The world and the ICC are watching these knaves from NPP. Akomea, Jake Obetsebi, Ken Agyapong and Akufo Addo should never dream they are above the Ghanaian laws and that of the International Criminal Court. Should these knuckleheads try to instigate any upheaval with their incitement laced proposed thank you tour that would throw the country into turmoil then they will be in for the shock of their lifetime. The rule of law means the security forces must maintain law and order at all times. This whole Mate Mehu NPP primitive behavior can be traced to the birth of our motherland Ghana. They were against everything and anything that did not fit their myopic minds. It is in their DNA and we the good people of Ghana will not surrender to the juggernaut of this appalling medieval bunch.

The patience of discerning Ghanaians are running over. We have had enough of this NPP silly drama. The NPP is fighting a losing battle. This is why even if Jesus presided over their lawsuit they will still crucify him. NPP will lose this ill conceived case at the SC before it gets wings to fly.

This is Nkrumah’s Ghana; what Kwame Nkrumah has meticulously pieced together; no Mate Mehu shall put asunder.

Honestly speaking, importing Justices to sit on this historic political case would have been satisfactorily the best for transparency and fairness in judgement.

I think, Ghana have to look to the Commonwealth Judiciary for justice in this case as Ghana is hugely tribally divided that expectantly, every Ewe and some Northerners will go for NDC and every Ashanti/Akan will go for the NPP as the true political indicates clearly that we did not vote on substantive issues but strongly on divisive tribal lines which resulted in every party receiving 5 million votes plus.

We have to be careful and do not take this trials as a joke as it could degenerate our country into yet another unfortunate violent political troubles like Kenya and Ivory Coast.

I would make some suggestions: I would humbly suggest, in order to reduce the import costs, that we import our president from our closest neighbours, i.e., Togo, Burkina Faso and Ivory Coast. Nigeria would also be an ideal choice, because it is a Commonwealth state.

These NDC apparatchiks still don't get it! Justice W.A. Atuguba has blood ties with Dr. Raymond Atuguba, the Executive Secretary of John "Sledge Hammmer" Mahama and makes him a complete DQ from the panel. It's plain and simple! He can decide to belong to NDC's defence lawyers that is acceptable, but not part of the justices before whom the election fraud case has been put.

There should be absolute neutrality in this case. Election fraud is a serious case and those whose motives are to subdue the will and voices of majority of the Ghanaians electorate should not take things lightly. Ghanaians are eager to correct all wrongs in our electoral system. A critical observation in towns and cities will tell you the mood or pulse of Ghanaians.

I asked family and friends about their the mood and preparation for the Christmas, and the answer wasn't encouraging; most families didn't enjoy the yultide; most traders in around the country complained of declined sales and lack of patrons' enthusiazm. The kind of emotionalism associted with Christmas was completely absent this December although it seemed others were busy about their Christmas shopping, there was nothing in the lizard's stomach.

Most people were emotionally depressed; the election had been rigged and there was no joyous mood; there was nothing to celebrate!

The NDC better understand that they've been rigging elections since 1992. Nobody had the courage to challenge them in court until now; this time around the NPP has gathered the right courage to halt the canker associated with our election. The corruption within the EC's outfit has been exposed.

Imagine a sworn-in President through falsification and massaging of ballot figures with the help of some electronic or IT company or whatever. Some people believe that once the thing has been stollen and the result declared, it's too late---let it pass; let it go, until next time. To them election fraud is something normal; it happens in every country. It is so, then one may ask; why then do we waste time money and resources to go to the polls to choose our leaders?

Election fraud is a very serious case punishable by jail term and those who think otherwise should begin to sit up right. Truly, election fraud is criminal and it's serious. We cannot and should not encourage or institutionalise corruption in our electoral system. Cheating in an election is wrong and we must stop it!

If the NDC rigged the election, why is the NPP opposing their application to be party to the proceedings? At least let them in and show the world how the NDC in collaboration with the EC rigged the election. You cannot allege fraud without providing the evidence and when the party accused of fraud says I want to be in court to answer your charges, you say no.
Talking about cheating in elections, even Dan Botwe bribed constituents.
When you win the elections; then it is fair and Afari Gyan is a hero. When you lose, then it was rigged and the Electoral Commissioner is evil.

How do you expect to govern the country when you refer to Northerners as cow herders? How did Akuffo Addo become Presidential candidate? Through violence and intimidation of opposing candidates. The problem is not the electoral process. It is your candidate and your party's arrogance.

Who says being cousins means belonging to same party??Bawumia's entire family is NDC.Is somebody aware of this?If his brother were a member,would that be in thier favor. I agree with the last portion of an earlier article which enjoins us not to tag the justices as NDC/NPP even if we know it for a fact.It is a hearing and logical conclusions by the lawyers which will bring the jugments(may still be partial).Whatever we do,someone is married to or went to school with the wife's brother/sister of another person's husband's younger brother's mother/father. If both the CJ and Atuguba didnt see anything wrong with his inclusion,then we should leave it at that,if not,then NDC will also take a look at Justices that they think/know are NPP and object publicly and then we are back to where we started from.NDC will also want to go into history and see who is related to NPP and raise objections.What about that? Lets leave those people to decide.They may take money and decide in any direction but that is what we have now.Even when God and the angels come to sit on this case,some people will raise objections;i can bet my LEFT VENTRICLE on this!!!

I dont know why these guys hide behind their academic credentials to speak such nonsense. Ghana is NOT the only country to have lawyers question sitting judges. In fact, in our ordinary court proceedings in Ghana, judges recuse themselves are asked to get off the case because of their biases. NPP has the right to file for Justice Atuguba to recuse himself or taken off the panel not because he cannot be fair but because of the appearance of impropriety which could be unfairly inferred by people who do not wish Ghana well. NPP has said it will accept the courts verdict but as at this point, the NDC has refused to make the same statement. In any case, if Atuguba is truely sure of the independence of the judiciary and the fairness of the court, he should not worry, the other justices can do the job. The fairness and independence of the court is not in his bossom. Apaak is not serious on this issue. Considering the potential of this case destroying Ghana, I am happy the NPP party is willing to make all meaningful Ghanaians follow and agree to the decision of the court. With the justices familial relationship with the newly appointed Executive Secretary of the Prez, his participation here is not appropriate. Mark it here, very soon Justice Atuguba will be asking to for the Chief Justice position.

Clement Apaak’s misguided suggestions for Ghana to import foreign justices to hear this case is an insult to Ghanaians who laid down their lives for Ghana’s independence. Kwame Nkrumah must be turning in his grave. Apaak’s statements imply that the Supreme Court is incapable of rendering impartial judgment in the case brought before it by the NPP. The justice in question shouldn't recuse himself because his cousin has just been appointed the Executive Secretary to the president. The NPP cannot cherry pick who should hear their case. They know every well that the NDC will also demand the exclusion of any justice they deemed to be sympathetic to the NPP. I think this is a face-saving ploy to bow out gracefully from this baseless petition.

Justice,no matter how meagre others see is should never be compromised. I would agree with the NPP in their quest fpor the exclusion of Justice Atuguba in the rigging appeal. Let usface it, today Justice Atuguba's political appointment makes him liable to tember justice with Prez Mahama hence justice would certainly be contaminated to the detriment of NPP at the end of the day. Better now than later that Justice Atuguba leaves the sterile legal battle field.
