If the crimes are against humanity and include mass murder, and if the court is in Ghana, this is eminently possible. For the Ghanaian Courts to be dickering whether these criminals might in fact be refugees is absolutely absurd. Only an NDC court, the product of a (former) system of one-man dictatorial rule, would ever consider that it's neighbor dictator's henchmen could escape justice by the simple expedient of terming them refugees. Refugees from justice, that is. Shameful!

Ivory Coast needs reconciliation and not trials and arrests. Both sides are guilty so Ghana needs to be neutral as Ivory Coast has always treated Ghanaians badly.
