You must concern yourself with how your lot will be able to comply with the herculean task of providing names and codes of the 4,709 polling stations, constituencies and regions. You should have asked yourself; why the NPP was praying the court to restrain the respondents from that request. Just relax wit the confidence level. It is so high and can dig your graves after judgment is pronounced. The SC's verdicts, so far are very very balanced. You do not realise that. This time round the courts are not going to be on your side. Time will tell.

The ruling will be based on law, and not on what some illiterates believe. If the evidence of rigging is proved and it is substantial Mahama will be removed. Make no mistake about that. The law is law, and not a bilief !!

Going by the Supreme Court's ruling, this case will suffer a technical judicial deficiency for “lack of evidence beyond all reasonable doubts”.
E.C will definitely present the Supreme Court “with detail records of persons abroad who voted in the elections", but this will not suffer any setback, as it is well known that elections are not 100% free from mistakes, which the highest court of the land will concede to. What next? Then, the "further and better particulars" with respect to the names and codes of the 4,709 polling stations, constituencies and regions where alleged electoral irregularities took place will be the “onus of proof” which the petitioners will have to battle with. Joe, you are right that the opposition against applications from and by all parties will only delay the petition. The petitioners have the right to the information being requested from the EC and the respondents also have the right for the particulars being demanded from the petitioners for a fair trial. The objections were exercises in futility.

I blame the lack of ineffective case management within the Judiciary in Ghana that delay cases and make access to justice very expensive and beyond the reach of the poor. All these matters could have been resolved through effective Case Management or through pre-hearing where all such issues could have been dealt with at a go and not in piecemeal as we are witnessing.

Now that the Petitioners have amended their originating petition, the respondents may also ask for more information and further particulars. That may also require another hearing if the petitioners oppose such request. This is disappointing and probably, both NPP and NDC prefer the case to drag on as long as they want.

It will be interesting how the EC will get the over 200,000 voters registered from 'official' Ghanaians abroad.

Ironically, the Republicans knowing my "conservative" views on crucial issues on the ballot sent letters to my address urging me not to abandon my principles for party interests. And of course I have voted on issues, and not on party "endorsements". I believe I voted on same principles in Ghana. The point is the voters' register is a public information, at least to the political parties and whoever cares. What data protection are you referring to? And what law do you think we need in Ghana to "protect" information in the voters' register? If you claim you are resident of Fankyeneko and have the right to vote there you think nobody must have a "right" to verify if you actually lived there? during voting parties are authorized to challenge any voter who they know, or even believe, does not live or hail from the area. You may be required to prove your residency per the law. Data Protection exists in Ghana. If you worked in GCB or SNNIT or Apeeno, you may not just go and provide information about customers' bank accounts, employees SNNIT contributions, or Apeeno's soap formulae to the public or competitors because that information is protected. If you are jailed in the US child pornography for example your records can be accessed by the public. It may contain data about how many children have fallen victim to you. The children's names would not be in there. The Voters' Register is a public document in Ghana that is required to be made available to ALL the political parties involved in the elections

the EC can explain if there were any over or under voting abroad,in that this could be not under his control and so definately bound to have a degree of uncertainties.the blame could be shifted in any direction.law is not rigid,its flexible and whoever explains himself with facts and circumstance wins.to me,the burden of proof first lies on the plaintiff,ie the Npp to proof beyond reasonable doubt that the offence really took place.in the absence of that,the case cant go furthrer.the NDC at this point has an upper hand,ie if the evidence is disclosed,they can then prepare to defend themselves properly.one important thing worthy of note is,even if the npp is not asked by the sc to disclose the evidence,in court and in such a case as this,when the Ec is asked any question,he can ask for time to examine and come back to court to answer.u need not answer a question of certain nature if cross examination could be done before answering.one thing is,if the Ec gives a better explanation of all the things the npp dnt know and is satisfactory,the npp case will be thrown away.

Before the NPP complies it says it has further evidence that the number of illegal votes is 11,000 not 4,500. Logically the NDC and the EC will go back to the SC and also add that the NPP must provide evidence of the 11,000 illegal votes and not just the original 4,500. You see how simple logic can be, at least for this macabre joke of a court case?

1. No where on this forum did I claim this was a CRIMINAL case ie. I mean the request for 'further and better' particulars. I challenge you to prove me WRONG. Secondly, your use of the word 'predict' even tells me you don't have the wherewithal to comprehend intellectual discourse.

2. I again challenge you to quote me or prove to this forum readers where and when I stated the supreme court will not grant the request. This is what I stated among others on January 23rd: "Can you answer me on the issue of "Subject matter relevance"? My point is that in complex cases of such nature the plaintiff CAN withold certain documents or evidence and when a motion is filed prompting disclosure the judge has the right to either GRANT or DENY it. What is difficult to comprehend about this?"

Where in the foregoing did I state the SC will not grant the request? No wonder you're a supporter of a party that has designated positions for PROPAGANDA. When you think you have been wronged, does it make any sense to go before a court that knows nothing of God's ways instead of a family of Christians? 2 The day is coming when the world is going to stand before a jury made up of Christians. If someday you are going to rule on the world's fate, wouldn't it be a good idea to practice on some of these smaller cases? 3 Why, we're even going to judge angels! So why not these everyday affairs? 4 As these disagreements and wrongs surface, why would you ever entrust them to the judgment of people you don't trust in any other way? 5 I say this as bluntly as I can to wake you up to the stupidity of what you're doing. Is it possible that there isn't one levelheaded person among you who can make fair decisions when disagreements and disputes come up? I don't believe it. 6 And here you are taking each other to court before people who don't even believe in God! However, since you're very "knowledgeable" in the Bible I also want to bring to your attention these biblical quotations....Matthew 7:4-5 & Luke 6:41-42.

One cardinal mistake of Christians today is the issue of taking God's word out of context. Next time you read your bible make sure you ask the Holy Spirit to direct you into what the word or passage is about and try to do some research to understand the context in which something is said or stated.

1. The bible verse you quoted (1st Corinthians 6:1-11) in the first place is questioning the rationale why BELIEVERS (emphasis believers) take one another to court to be judged by the unrighteous. In this instance it is admonishing believers to refrain from having issues among them settled in courts but rather allow the Spirit of God to speak to their hearts to have amicable solutions of their problems or better still take the high road and just take it as being wronged by a fellow Christian.

2. Now let's juxtapose that to the situation at hand. Are the NPP and NDC Christian organizations? NO. They are political parties. Are they bound by the same standards as Christians or Churches for that matter? NO.

3. The expression "the battle is the Lord's" as used by the NPP is just an affirmation of their hope in the God of Justice that HE will not sit down for HIS children to be aggrieved and that HE will render favorable jugment for them through the mortal men who have been appointed as earthly judges to deliberate cases of such nature.

So my sister as Matthew 7:4-5 states please learn to take the plank out of your eye first so you can see clearly to remove the speck from your brother's eye. Just as the Bible admonishes us not to just pray but also pray with UNDERSTANDING I'll also suggest that you don't only read the Bible but ask for the Holy Spirit to open your eyes to the TRUTH in the word so you'll gain a better UNDERSTANDING. The passage was specifically to believers who chose the courts for their differences and not "unbelievers" or political parties who are fighting each other over supposed political injustice. So next time around don't come across as debunking ones statement when you don't even have a firm grasp of what you're using to counter his/her position. Will love to read your 'rejoinder'....Thanks.

It appears to me that it is the NDC party that errorneously believes that majority of Ghanaians in diaspora are NPP sympathisers, hence their stance on this issue! Evidently, this group (Ghanaians in diaspora) are an enlightened lot (generally) and will vote on issues rather than being partisan. If one has nothing to hide but has the interest of Mother Ghana at heart, in mind and in deed, one will have nothing to fear this group. If you want me to refresh your memory on what transpired between us on that day here's a comment I made and tell me if it's inconsistent with what the SCOG just did.

"Can you answer me on the issue of "Subject matter relevance"? My point is that in complex cases of such nature the plaintiff CAN withold certain documents or evidence and when a motion is filed prompting disclosure the judge has the right to either GRANT or DENY it. What is difficult to comprehend about this? I'm only stating that making emphatic statements in cases of such nature to say it is out of place for a plaintiff to do so (withold information) is unimformative. Is that a crime to bring an opposing knowledge to a subject matter? Geez!!!"

Now please tell me from the preceeding paragraph where I deviated from the subject matter. 1. You till date failed to answer or shed your lawyerly knowledge on "subject matter relevance". Why? 2. Didn't I state that the Court had the right to either deny or grant the request? 3.I stated that you making emphatic statements questioning why the refusal without acknowledging that a plaintiff in certain circumstances had the right to withold information was from a so called lawyer disingenous and uninformative.

You should go back to all that you wrote under that news item. The core issue, as far as I was concerned, was the merit of Akuffo Addo's opposition of the EC request, not some ancillary comment which you rightly hazarded. I stated that Akuffo Addo was exposing himself by opposing EC's request, and that he was ignorant of prevailing law. The SCOG unanimously agreed to the unmeritorious nature of his opposition. Therefore I was right in saying that Akuffo Addo exposed himself by bringing up such a weak opposition to the EC request.
Now I was giving you the opportunity to redeem yourself, but like a hen whose head has been cut, you keep on gyrating. I leave you to your conscience...and your convolution.
As regards subject matter relevance, your submission is moot. SMR, in this context, has to do with how related a particular piece of evidence is to a cause of action, and how it advances a claim or defence. There is no question that the EC request for further and better evidence is visceral to the case. And this was stipulated to by the parties....
A judge does not have to intervene at every step of a discovery procedure to determine whether parties must acquiesce to a discovery request, no matter how complex a case is. So here too, you are wrong. Requests are strictly between parties, and the court intervenes only if one party refuses to cooperate. The procedure is called "motion to compel".
You can acquire the humility and wisdom to know when you goof. Some of us see ghanaweb's potential as a learning tool; that is why we engage in discourse with all manner of people. Strictly speaking, there is no merit in arguing if you are just stuck in your illusion.

One Boateng made an unenquivocal statement that AA would lose the case because of the rules governing discovery. I countered his argument that making such emphatic comments wasn't educative because there are also instances relating to SMR where a plaintiff can withold information and it will be up to the court to either grant or deny the request. Then you jumped in and made the same emphatic statement as Boateng which I found disappointing coming from a so called lawyer because there are case laws in the country which I live in which I believe shouldn't be different from Ghana's whereby the opposite has been upheld.

Since you've already branded me as someone stuck in my illusion and one who keeps gyrating I guess there's no more need for me to continue on this path-to-nowhere. Thanks Mr. Learned Lawyer and hope you can provide us your real name so we can secure your services should the situation arise.

They have become so easy and accustomed to it that they won't blink an eye to try to steal the ballot. What a shame! They [NDC] think it's so cool and okay to steal the ballot or falsify the ballot count in their favour. That was way back then; things have changed forever. Nana Akufo-Addo & Co., should be congratulated for being bold to challenge the December elections. Election fraud is a serious case that is punishable by jail sentence. I say people ain't seen nothing yet! Especially NDC apartchiks who think it's just jokes at the Supreme Court, the highest court in Ghana. Some even think they can intimidate the noble Justices with all kinds of words. Hmmm! We're dealing with the most powerful court or hand in governance, no only in Ghana but linked with ICC and the UN. The process at the court is nothing to be taken lightly, or in secret, as some folks seem to believe. The case is truly a serious case!
