If you read the report carefully, you'd have realised that even natural justice demanded that Sweater & Socks deserved not only their property back, but also compensation for the unjustifiable confiscation of their property by the AFRC junta. You dare compare this to the recent fraudulent judgement cases ala Woyome? Please, NDC fools should stop insulting Ghanaians. The state must pay the money. Nonsense!

  When Rawlings was in power, there was not anything like judgement debt. Because NPP are prfessional gangs and thieves brought all over the world to rule Ghana, they came out with corrupt strategies to dupe the nation.

  It is regrettable that some personalities within the judiciary cared less about the country and would collude to wrench the gut out of the nation’s coffers. The Attorney-General (AG) and Minister of Justice, Mrs Marietta Brew Oppong Appiah, is on the right tract to challenge and annul this absurdity which has become a white collar cancer in higher places of government.
  
  It is alleged, the plaintiff, Sweater and Socks and seven occupants of its factory whose assets were confiscated by the state through AFRC Decree 38 in 1994, dragged the Attorney-General to court. This raises three issues
  
  1. Firstly, did the then AG or indeed anyone within the judiciary at the time challenge this ridiculous judgement?
  
  2. Is the present AG right to challenge this judgement?
  
  3. To determine whether or not at the country was under constitutional rule at the time of assets confiscation; if not, why a claim, let alone grant it under constitutional rule when the judges knew members of the AFRC were immune from prosecution? If so, should country be held liable for their failings?
  
  The country at the time was under military rule, the government overthrown and the constitution suspended. By reasoning, some of the things that took place then were unconstitutional as far as the state was concerned.
  
  DECREE
  AFRC Decree 38 1994 was an official order issued by the ruler or authority backed by the force of law. Official because the military rulers imposed themselves as the authority and even the court of the land had to obey their orders. This is why leaders of failed coups are executed and charged with treason for their attempt to usurp power. When they succeed, they are equally liable for prosecution for their crimes or misrule under the constitution.
  
  CONSTITUTION
  This is a body of fundamental principles or established precedents by which a state is governed and affirms our democracy and guarantees the rights of individuals to challenge the highest authority in the land.
  
  
  DAMNING INDICTMENT
  AFRC ceased power, suspended the constitution and ruled by decree - powers not underwritten by the people. It would be a gross miscarriage of justice to hold the people or country liable when the constitution was suspended literally the country was held to ransom by the military with guns to the head. This is the reason why the AFRC sought through parliament and the constitution never to be prosecuted for their misrule. Foolishly, parliament passed that into law to protect them. What were the legislators thinking? Where were the so called luminaries of the judiciary at the time? Could no one speak out then?
  
  Similar to the misguided Argentine warship ruling by the High Court, why did the judges in this saga entertain let alone rule favourably on April 08 2003 and August 15 2012, when they knew the true culprits were immune from prosecution under the same constitution? The country or the people should not be held responsible for offenses committed at a time when the constitution was suspended. The state must be held accountable for offences committed during constitutional rule, because the government is mandated by the peopl e. Ghana should not and will not be an easy target for those who choose to collude and skew the law regardless.
  
  The governor BOG and Dr Wampah should not be charged with contempt of court, when judges mis-carry justice. The judgement given in favour of the plaintiff in April 08 2003 and the garnishee order absolute asking BOG to pay out US$ 28,595.00, were flawed and should not have been entertained. At best the unlawful confiscation of properties must be returned to their rightful owners where they can be identified and proven, but the country should not be held accountable.
  
  A serious review is required and those judges exposed for their skewed judgement and heir part in what could today have been possible loss to the country.
