In fact, they are raising wild alarms about the consistent use of different initials by the defendant, as though they are talking about the same persona. Are we talking about "W.A.D. Akufo-Addo, or "W.E.B. Akufo-Addo"?

Since this is an official response to a petition, it is clear Nana Akufo-Addo is begging the question put to him. If they are asking you about W.A.D. Akufo-Addo, why do you respond with another name? What do you have to say about W.A.D. Afufo-Addo?

Here is the original petition's wording of the name, as reported in the press. Where is the mistake coming from?

"The former Supreme Court judge is pleading with the court to grant a perpetual injunction restraining Nana Akufo-Addo from holding himself out as a lawyer competent to practise in Ghanaian courts or anybody regarding him as such.

In a statement of claim accompanying the writ of summons, the retired judge also accused former President John Agyekum Kufuor of complicity when his government knew or ought to have known that Nana Akufo-Addo was not on the roll of lawyers but appointed him as Attorney-General and Minister of Justice who, by the provisions of the 1992 Constitution, must be a lawyer in good standing.

It also indicated that Nana Akufo-Addo never signed the matriculation book at the Ghana School of Law, which was evidence of enrolment in an institution.

According to the plaintiff, the defendant was not known to have changed his name, neither had he been installed anywhere in the country within the meaning of the 1992 Constitution and the Chieftaincy Act.

According to the statement, the defendant was impersonating W.A.D. Akufo-Addo, who is on the roll of lawyers as number 1190.

It said claims by the defendant that he obtained his early education at Government Boys’ School and later Kinbu before proceeding to the UK for his Ordinary and Advanced Level certificates implied that he obtained his Ordinary and Advanced certificates in the UK.

It said Nana Akufo-Addo returned to the UK to read Law and was called to the English Bar (Middle Temple) as Number 1190 on the roll of lawyers in Ghana."

Again you guys have got it all wrong. Akuffo-Addo hasn't substantially answered Kpegah's suit. Don't you guys find it odd that Akuffo-Addo WAS THE ONLY PERSON CALLED TO THE BAR ON THE DAY HE WAS ALLEGEDLY CALLED TO THE BAR? Assuming he even qualified abroad, there is no evidence that he took any conversion examination.

Yes the law may ask Kpegah to prove his case but if I were Akuffo-Addo with my reputation as a public figure at stake, I wouldn't even hide behind that but rather produce every document to debunk Kpegah's claim.

Ghanaians aren't stupid. Until Akuffo-Addo produces every and all documents, Ghanaians will remember him as the CON OF HIS GENERATION--with its attendant ramifications.

Personally, I learnt about this allegation that day his "other" wife Ursula was called to the Bar TOGETHER WITH OTHERS including my family member and he Akuffo-Addo was present to offer some support to her. After the function, there was this talk among the newly-minted lawyers when he tried to socialize with them. The names of BJ da Rocha and Sam Okudzeto, both kingpins in the erstwhile Progress Party and bigwigs at the Law School, came up for mention as the facilitators.

The irony of the whole issue is that those who are now very senior legal practioners but who are also aware of this fraud are maintaining "a blue wall of silence." This has unfortunately allowed those who have also obtained their professional law certificates in murky circumstances to mount unconvincing and unintelligent defense on Akuffo-Addo's behalf.

No wonder Ghanaian legal practioners these days don't make any sense to even Ghanaians with their utterances. Politics has become their shortest route to amass wealth.

I hope Kpegah's action will embolden other Ghanaians to use the courts to reveal wrong doing in high places. This is one way to ensure only men of integrity will aspire to be our leaders.

Let me place on record what a friend did when Justice Kpegah filed his suit. I reproduce below his findings:

“… But you know this is a serious problem. I have had the chance to see the book of roll of lawyers... one W.A.D. Akufo-Addo was called on 8th July 1975. He was the only person without any colleague of his called on that date. It is strange..... No one has been called alone on the call to roll of lawyers..... The book too was not signed. Furthermore, we all officially know Nana Addo as nana Addo Danquah Akufo-Addo, not William Addo Danquah Akufo-Addo. Those two names are very different.

Whoever that was why didn`t he sign the book? Addo should produce the certificate from the law school he attended.

He went to England to study for his O?Level and A?Level examinations. He returned to Ghana in 1962 to teach at the Accra Academy before going to the University of Ghana in 1964 to read economics. After graduating as an economist, he went on to read Law in the UK and was called to the English Bar (Middle Temple) in July 1971 and then the Ghana Bar in 1975.

Of course, one can't expect the logic taught in the NDC School of Propaganda to be sufficient to know the difference. A while ago, NDC goons managed to bring evidence that Nana Addo attended Oxford University briefly, although he himself never made a fuss about it or even put it on his CV. What stops you from writing to the Inns of Court School of Law (now City Law School) for the evidence?

The principle of natural justice suggests that one cannot be compelled to give self-incriminating evidence. It's for Kpegah to provide that evidence that Nana is a fraud, failing which he will be severely punished. When the latter happens, I hope you the same people crucifying Nana won't call him vindictive. In fact, if I were Nana, I'll be preparing a completely different suit against Kpegah for defamation and false accusation (especially on his murder allegations). Kpegah must be so dealt with he wouldn't utter such nonsense again.

Which of these is so difficult for your thick skull to absolve? This is pure common sense. You don't need a Supreme Court Judge to explain/confuse matters for you. Interestingly, you agree without realising it that Justice Kpegah lacks common sense. Even as a non-lawyer I could easily punch holes in his writ because it lacked both common sense and legal merit. Not surprisingly, some of the weaknesses I pointed out on this very forum about the Kpegah writ are captured in the affidavit filed by Nana's lawyers. What does this say about Justice Kpegah? Either his legal competence has deteriorated with age or he has been so completely blinded by personal hatred he has lost any sense common to sane human beings.

Akufo Addo's responds makes me believe Kpegah the more. These are people who would always fling papers around to support their cases, like what they took to court on the election issue. Yet they fail to provide a single document to prove Kpegah wrong or otherwise.

What baffles me most is why would Akufo Addo, coming from Ghana, study in UK but never practised in UK but rather went to work in France. Has he ever studied French? naturally England or Ghana should have been where to start practising. When he was called to bar who supervised investiture into the Ghana Bar? Where there other students or people with him on that day.

Can he call any of his classmates in London and Ghana (Makola) as a witness in this case? The question of burden of proof does not arise, knowing Akufo Addo, if Kpegah is wrong he would have taken him to the washers by now.

Why was he asking the court to throw the case out, instead of saying i am ready to prove to the world that I'm a genuine person not a fraudster.

Please, no insults i just want answers to the issues raised by Kpegah, because the integrity of my country and its judiciary is at stake.

Justice Yaonansu Kpegah

Nana Addo Dankwa Akufo-Addo has described the recent action taken against his integrity by Justice Francis Yaonansu Kpegah as not only frivolous and vexatious, but one unworthy of hearing by the High Court.

He said Justice Kpegah should be punished for his frivolities in instituting the action.

This was contained in a legal response to the issues raised by the retired Justice of the Supreme Court against him; an action which made disturbing headlines and whose motion would be heard on April 23, 2013, according to a notice of motion filed on behalf of the 2012 flag bearer of the New Patriotic Party (NPP) by Davies & Davies Legal Practitioners & Notaries Public.

In an affidavit supporting his position, Nana Akufo-Addo rubbished the allegation of the retired justice which sought to imply that he is not the bearer of the name which appears in the General Legal Council register of legal practitioners in the country and is therefore an impersonator.

Abuse Of Process

While further regarding the position of the retired justice of the Supreme Court as an abuse of the process of the Court, Nana Addo added that it is devoid of a reasonable cause of action.

“I am further advised by counsel and verily believe same to be true that the Plaintiff’s action fails to canvass facts necessary to form the basis of any issue worthy of a proper hearing by this Honourable Court”, the supporting affidavit stressed.

While rubbishing the position of the retired Supreme Court justice in paragraph 5 of his pleadings that he (Nana Akufo) “was impersonating one W.E.D Akufo-Addo who was called to the Middle Temple on 22nd July, 1971 and is on the Roll of Lawyers in Ghana as No. 1190”, the NPP leader wondered why in another breath of the same pleadings the plaintiff claimed that “the person I am impersonating is not W.E.D Akufo-Addo but rather a certain W.A.D. Akufo-Addo who is also on the same Roll of Lawyers with the same No. 1190.”

The foregone, according to him, smacks of frivolity and founded on mischief, since “I cannot be impersonating two persons with the same number on the same Roll of Lawyers in Ghana.”

Contradiction

Picking what he regarded as another instance of contradiction, Nana Akufo-Addo stressed “that in paragraph 15 of his statement of claim, plaintiff concedes the fact that I, Nana Addo Dankwa Akufo-Addo, was called to the English Bar (Middle Temple) in the same year as the person(s) bearing the no. 1190 on the Roll of Lawyers in Ghana, that he claim I am impersonating.”

The defendant/applicant points out that he is William Addo Dankwa Akufo-Addo but has always been known as Nana Addo Dankwa-Akufo-Addo, adding that he has been constantly been referred to in his professional life as Nana Addo Dankwa Akufo-Addo.

“Nana Addo Dankwa Akufo-Addo and William Addo Dankwa Akufo-Addo are one and the same person.”

Professional Career

Regarding his professional career in the supporting affidavit, Nana Akufo-Addo stated that he studied law in England and was duly and specially admitted to the Honourable Society of the Middle Temple, one of the four inns of the Court in England, on January 13, 1969 as William Addo Dankwa Akufo-Addo.

Continuing, he explained that on July 22, 1971, after passing the English Bar examination, “I was duly called to the Utter Bar of the Middle Temple and have since been a properly qualified member of that Honourable Society, as admitted to by Plaintiff in paragraph 15 of his statement of claim”.

Post Call Programme

Dismissing the allegation of impersonation, Nana went on to state that upon his return to Ghana, he undertook the post-call law programme required of lawyers who have qualified abroad and was duly called to the local bar on July 8, 1975, as William Addo Dankwa Akufo-Addo, exhibit of which he attached as Exhibit “NADA 2” being a certificate of the General Legal Council.

“That I have since 1975, been on the Roll of Lawyers in Ghana, always been a lawyer in good standing and was even appointed validly to the office of Attorney-General of the Republic in accordance with Article 88 of the Constitution and other laws of Ghana,” he went on.

Bad Faith

There are several lawyers in the country who he stated do not use the whole of either the names they were christened with or their names as appearing on the Roll of Lawyers in Ghana—a practice which he noted is not unlawful.

The affidavit concluded on a fiery note thus: “The instant action is brought in utter bad faith, inspired by mischief of the deepest dye and a gross abuse of the process of this Honourable Court, and accordingly ought to be struck out” with punitive costs, he added.

The retired Supreme Court justice who provoked a national conversation about the motive for his action, had cynics wondering whether it was politically motivated given the timing.

It is coming on the heels of the commencement of a petition brought against the Electoral Commission by Nana Akufo-Addo, Dr. Mahamudu Bawumia and Jake Otanka Obetsebi-Lamptey at the Supreme Court.
