Afari Gyan is right. The EC is named in the suit not him and so it's the EC's lawyer(s) who need to be there not the Commissioner unless the Commissioner doubles as the lawyer of the EC.

I wonder why Justice Dotse didn't ask for President Mahama's whereabouts too? He is of course the Ring Master! Those who advised the President to put up a defence instead of pleading immunity should be ready to mind the stands, as the boisterous audience howl popcorns at him when he took the stand (dock) to be questioned.
