Where is Justice Dotse in hurry to go? The work of a lawyer is to surprise and attack and that`s what Mr.Lithur is doing.

That`s a real lawyer speaking.

Believe it or not most of the comments proceeds from uninitiated minds hence the attack and irrational analysis. The old sayings that "little drops of water makes a mighty was activated and employed.
The unseen numbers which could deceive many had been unraveled. Polling Agents do not fill pink sheets therefore signing a pink sheet does not negate an illegality.

Because the allegation now is that the Presiding Officer acting in concert with the Electoral Commissioner and the first Respondent and his Agents stuffed the ballot boxes with foreign material. Never mind the fact that the ballot boxes were and transparent and there were umpteen observers watching each voter push he or her ballot through the slots.

And what if to expedite proceedings, these witnesses rather than attend Court and be cross examined chose to swear affidavits that it was a genuine error and they had nothing to hide?

The petitioner is asking for the annulment of over 4 million votes and Judge Dotse is concerned that the cross examination is laborious. If he cannot sit in Court he is welcome to go and relax at the beach. The NPP is running a LET MY VOTE COUNT campaign. So every single pink sheet must be subjected to the utmost scrutiny. You do not provide your opponent with your questions before hand and accept already prepared answers. That is not cross examination.

The petitioner on every pink sheet submitted must be able to identify whether it forms part of his evidence and not escape with a wishy washy answer of "I believe it is part of the pack I struck out." We are not in court to believe. The Court deals with FACTUAL matters. If he struck it out why did he tender that document in as evidence to the respondent.

The NPP is acting on the hoof and making its evidence to fit its case as it gets along. DIABOLICAL!!

What is over voting? Over voting is a case in which people who voted at a polling station are more than those on the register. Thus it is improper when and election official's documents show that he or she sent ballots less than the registered voters at that particular polling station or less than the number of members of an organization that are conducting elections for their executives.
Thus if Chokor GPRTU have 1200 members and you are conducting elections for them you must first know the number of people in the union's register, the positions being contested and with that you make the ballot paper. It could be one ballot paper with the names and positions being contested on it to be marked or tomb printed. That is to make the voting process go faster. The other on is a ballot for each position and the ballot should be the number of all those who are eligible to vote.
In a national election the ballot should be the number of all eligible registered voters. Thus in the ballots that was printed represented all the eligible voters in the country and at the end of the exercise 75.5% of that voted meaning that meaning that 24.5% of the registered eligible voters did not vote.
Therefore there was no over voting during the 7 - 8 December, 2012 general elections. In 2008 there was 130% votes in some constituencies in the Ashanti Region, and the less was 110%, yet the votes from those constituencies were not annulled.

You have taken the global view which is correct. But the definition of over voting according to the NPP is the difference in figures between issued ballots and ballots counted. The two should tally except in cases where the Presiding officer was under the impression that rejected ballots (included in the total count) should not be recorded as ballots "validly" issued. The NPP do not accept this as an error but a deliberate ploy to rig the election and have completely ignored the matter of registered voters.

We can argue whether this is an administrative error or not. But if the winning margin is over a 100 votes it seems absurd to argue that 7 votes labelled as over votes would have made a difference to the outcome of the results in that polling station.

Folks I am confused with the definition Dr Bawumia is granting the inconsistency between cast votes or ballots as against registered voters or those who really showed up to vote.In my understanding of the term "over voting" means an individual on the voter list having had the opportunity to cast more than one ballot either at the same time or with time intervals, returns to same polling center to cast another. A practice I believe wouldn't have been tolerated by the agents and the verification machine as well. So I should think the right term could have been over stuffed ballot box. I stand for correction.

Because on the face of the pink sheet is logic that the adding was wrong due to adding spoiled ballots to register's ballot issued. Because, if it was intentional to steal, it would be different. My question is, how do they want legal voters who managed to have time to vote to be punished for some officer's errors by asking for their votes to be annulled? I don't see why these legal voters should suffer the consequence of presiding officers errors.Those errors could've been fixed if one of the agents raised any complaint but obviously all of them thought it was right.
