A smart person is some one that thinks beyond the narrow scope the everyday person uses to reason, and comes out with a more and better prepared answer to a question or problem. It has nothing to do with being an NPP or NDC. It is a state of mind that is on a higher level than the average.

Bill Gates, in my books is a smart business man, but he dropped out of university - didn't even get a bachelors.
Your argument that only smart people has PhD is totally hollow, if that were the case Ghana should be among one of the best run countries in the world, with so many people holding PhD. But look at us, most of our past leaders had PhD with even one of them being a Professor, yet we are still a beggar nation totally dependent on IMF. This shows that perhaps Ghanaian PhD holders are only as smart as JSS graduates.

Oh I see! I am now beginning to understand you. Yours is a simple logic that says a person is either smart or stupid (foolish as you put it). That is where I fail to agree with you, in my opinion humans cannot be categorized into two simple groups like that. Majority of humans may not be classified as smart or foolish, they may just be your average person in their ability to acquire knowledge and retain it, analyze, rationalize, deduce and debate, but they can still acquire a PhD under the right combination of circumstances.

Also, you argue that what a person does after the PhD does not matter to you. I turn to defer, if you are truly smart, it should not end on the day you acquire your PhD. It should reflect in your actions and behaviour, and your contribution to society, it should be a lifelong smartness, not just when you are smart in your ability to pass exams and acquire degrees.

A right is something given legally and as such is backed by law.. For example, the right to own property, belong to a group and even form union and even to demonstrate, the right to education especially the right to attend elementary school in Ghana.
A privilege on the other hand, is not a right. This is because it is given at will and can be taken back. For example, the privilege to be employed. Know that you may be well educated, but ushering you into the job is only a matter of privilege and not a right. In fact, a privilege is also a risk as you've correctly suggested!
What I understand about Justice Atuguba's comment is this.. DR. Bawumia has sworn by the Quoran to speak the truth and nothing but the truth.... this aspect is backed by law. However, if after swearing this oath but decides not to speak the truth, it now become a matter of CHOICE which is in fact, a privilege to lie or not to speak the truth and there could be some consequences for that action of his. Simply put, he could perjure himself (perjury)and charged.

The illegality is stated and established that EC's returning officials did not sign the pink sheets as required of them. Whether NPP polling agents signed or not, there's no illegality there as they signed to as required of them. Tsatsu should be sensible at least if not intelligent. Is there any substative violation of results by NPP agents other than EC returning officials, who commissioned the elections? Oh, Tsatsu is failing outright!

Perjury is a serious crime. What exactly Justice Atuguba means by the witness has the privilege of incriminating himself " is difficult to. Surely he does not mean that the witness has the privilege or indeed that the Court will take it lightly should any witness present false information or seek to mislead the court. Incriminating here perhaps means the witness has the privilege to entangle himself in the thicket of evidence presented.
That aside, Judge Atuguba's presiding abilities exposes him to future criticism. He has attempted to liven up proceedings with interjections such as the "biometric machines have broken down" to announce adjournment. This is a serious constitutional case not to be trivialized by joviality. He needs tot ooze gravitas and command the court with eloquent and elegant expression.

Reporters reporting on the court proceedings must give accurate reports and not throw dust into the eyes of the Ghanaian public. The Sc is supposed to be independent and impartial judiciary, and if Atuguba is found to be supporting Tsatsu Tsikata, or for that matter EC and NDC, in this case he can be thrown off the bench and charged. Tsatsu must be warned by the SC not to intimidate, threaten and disrespect the witness (Dr.Bawumia). Please Doc, stand your ground. Mr. Phillip Anderson, continue to be vigilant. So far so good !

It is my understanding that the justices of the Supreme Court are there because of their supposed knowledge in the law. They are not in the Supreme Court because of their expertise in morality. I believe if it is about knowledge in morality, those members of the Supreme Court will not find a place at the Supreme Court.
The people of Ghana are therefore expecting the Supreme Court to rule on the current election petition using the law and nothing else. Ruling based on morality can be done better than moral society of this country.
In this regard I wish to remind them that an agent can bring a principal into contractual relationship with a third party if the agent meets certain conditions. And also to remind them of the legal parlance that ignorance is not an excuse before the law.
Thirdly, the authority the 1992 Constitution gives the Electoral Commissioner to formulate laws/rules( CI) in the conduct of elections does not take away citizen right to vote if they only qualify according to the law. All measure introduced by the EC to over the years were to facilitate the conduct of elections. Electronic verification is not the only means to identify persons for who they claim they are. In this country, it is the common practise to identify people with an acceptable means of identification like the passport, the voters ID, driving license etc. These are sources of ID commonly used in the bank where I work. These have been accepted over the years. Those seeking to pursue their parochial interests should not try to rewrite the laws of Ghana.We expect them to come forward with issues which will advance the course of the country.
Even though I am not legally trained person, I have always cherished the conduct of legal pracice and I have said in the past that I declined the advice of my Senior House Master in the secondary school to read History and Literature to enable me read Law in the future. I am proud today to say that I did pure science in the secondary school and proceeded to read Accounting in the almighty School of Administration. At this level I read company law, business law,commercial law etc and have always wanted to read before I leave this earth. I have good appreciation of law to date.
NPP has just decided to drag the country behind because of this baseless petition. But I can assure them that they have found their match. I will do the little I can to assist the NDC defend themselves well to enable Ghana continue with the ''better Ghana agenda''.

OTTAWA - The integrity of Canada's electoral process is at "serious risk" due to rampant procedural errors made by polling officials, a report commissioned by Elections Canada says.

The report blames overly complex rules and poorly trained polling officers for "serious errors" in 54 per cent of the paperwork filled out during the 2011 federal election for electors who needed to prove their eligibility to vote.

The report, by former British Columbia chief electoral officer Harry Neufeld, includes the results of a national audit of the documentation filled out for electors whose names were not on the list of registered voters or who failed to bring the required identification with them to their polling stations.

In those cases — about 15 per cent of electors — polling officials were required to administer special procedures, such as the swearing of oaths or having someone vouch for the voter's identity.

The audit found serious errors — the kind that can lead courts to overturn election results — in 12 per cent of voter registration paperwork and in 42 per cent of vouching paperwork.

"The audit indicates that the applications of specific legal safeguards, in place to ensure each elector is actually eligible to vote, were seriously deficient in more than 165,000 cases due to systemic errors made by election officials," the report says.

On average, that amounts to more than 500 serious administrative errors in each of Canada's 308 ridings.

"Obviously, this is unacceptable," Neufeld concludes. "Aside from legal concerns, public trust in proper administration of the electoral process is at serious risk if these errors are not addressed."

Still, to keep the problems in perspective, the report notes that more than 12 million Canadians cast ballots on May 2, 2011, and irregularities occurred in only 1.3 per cent of the cases.

Elections Canada commissioned the report six months ago amid controversy over myriad procedural irregularities in the Toronto riding of Etobicoke Lakeshore.

Borys Wrzesnewskyj, the Liberal incumbent who lost in 2011 to Conservative Ted Opitz by a mere 26 votes, challenged the results in court. The Ontario Superior Court found the irregularities sufficiently widespread that it declared the result null and void.

However, the Supreme Court of Canada subsequently reversed that decision.

Neufeld says there are multiple causes of all the errors, among them the reality that "200,000 election officers need to be recruited and trained, most often for a single day's work that happens only once every few years."

That said, the "widespread consensus" among those interviewed by Neufeld was that the rules governing special voting procedures are much too complicated.

Over the long term, he says the entire voting services model needs to be overhauled. But since that can't be done in time for the next federal election in 2015, he suggests some interim steps be taken to simplify the process and ensure greater compliance with the rules.

Among other things, Neufeld recommends a campaign to encourage electors to ensure they're on the voters' list prior to election day; putting a supervisor in charge at every voting site; simplifying written instructions for poll officers and better training for election officials.

In a written response to the report, chief electoral officer Marc Mayrand accepts Neufeld's findings and says Elections Canada is working on solutions.

"The compliance review (by Neufeld) has highlighted the vital role that accuracy in electoral administration plays in public confidence in our electoral system and the results it produces," Mayrand says.

"Elections Canada agrees with Mr. Neufeld's finding that significantly improving rates of accuracy among election officers administering procedures on election day requires a fundamental redesign of the current voting services model."

Under the Fifth Amendment to the Constitution, a person cannot be forced to give any information which would tend to incriminate himself/herself. Thus, he/she can refuse to answer any question which he/she feels might be a self-accusation or lead to information which would be so.
