When did Mornah realise there was something unconstitutional about the Court sitting on public holidays etc? And the timing for the ruling here perfectly paralleled the current Election Petition. And go down further to look for the political leanings of Mornah and the potential political sympathy of his counsel. Thirdly see the potential wrangling the nation faces whatever direction the final verdict goes providing one side puts the breaks on and say it's ok "I give up, I accept for the sake of the nation." Otherwise, we all would be sitting on tenterhooks. Appeal and counter-appeal could clog the wheels of economic progress and breed unnecessary social unrest and tension.
Even if Arthur K were not an NPP scribe one should still objectively see logic in his observation and wonder aloud with him, why all this confronting Ghana? Are we going to see an end to this sort of saga so soon?
I personally wish no one ever had any cause to substantially doubt the declaration of the 2012 Election! Unfortunately that's a wishful thinking. the reality is different!

The complaint about the impact of public holidays in the expeditious discharge of the petition is a red-herring! Public holidays are few and far between, and the ruling will have negligible impact.
Arthur Kennedy is profoundly wrong on the timing of the decision. The Justices need to be just all the time, not some of the time. If it is the constitutional right of the citizen of Ghana to appeal to the decisions of the Supreme Court, why should any decision by the Supreme Court be made to be an exception? Why deny them that right now? What are the Justices there for, if not Justice?
It is ridiculous for Dr. Kennedy to suggest that because "the ongoing petition was affecting the confidence of President Mahama, Nana Akufo-Addo, the entire Ghanaian populace, as well as Ghana’s international image. It also creates avenues to prolong the case which is inimical to Ghana’s development agenda."
Does Dr. Kennedy imagine that future litigations arising out of this ruling will "improve" the confidence of the sitting President? Why the postpone the ruling?

Now he is suggesting the "timing was wrong". Does he still maintain that the "ruling in favour of Mornah's petition" was "wrong"? And in any case this motion was put to the court in the aftermath of, and in relation to the current election petition in court.
Why on earth should the case not be heard now and why should it be "for the future"? Is this the kind of democracy that Arthur Kennedy believes in, or is prepared to accept? This is disappointing coming from him. By all means you can have your disagreement with the ruling (if it does not go your way) but "with all due respect" you cannot seek to know better than the supreme justices who considered the case? How much does Dr Kennedy know of the law?

Akuffo Addo lost elections in 2008 and conived with the Chief Justice and hurridly convened a kagaroo court on a public holiday to subvert the will of Ghanaians. Later, it came out of Attah Akyea's mouth that the Judge then was not their 'own'. The same Akuffo Addo lost another election and he is druging Ghana's reputation in the mud. Arthur Kennedy should be bold enough to tell Akuffo Addo that he is becoming a nuisance. He can stand for 100 elections and he will loose all because he is not a Presidential material. He is being deceived by the few sycophants around him but the rest of us don't really classify him that high. He has become an object of ridicule as a result of Kpega's case. How can Akuffo addo say his certificate is missing and then think everyone in Ghana is that dummy to swallow such a lie. Kpegah might have lost the case but the damage done to Akuffo addo's reputation is gagantuan. The same old Akuffo Addo has drug allegations hunging as albatros on his neck. Indeed, working on a public holiday can be never be unconstitutional. Apart from even the doctors, police, and many other workers, all work on public holidays because situations demand that these people work on the public holidays. So if a situation is demanding that the Supreme Court sits on a holiday, what is wrong and unconstitutional about this? Parliament can equally be called to sit on a public holiday whenever the need arises. In the unfortunate event of a president passing on on a public holiday, will the Parliament not be called to sit to swear in the Vice President as President? In such a situation are we going to wait until the public holiday(s)is/are over? The Supreme Court must review its own judgement on this. The judgment was indeed not good for the general well being of the nation.

It has been the tradition for long time that certain establishments work on week ends and holidays, example: hospitals, prisons, police, fire service personnel, the army, electricity company, gas stations, etc. they all work on week ends and public holidays. How come the judiciary cannot work on these days? Even the Angels work on holidays. All the developed countries work on holidays and week ends. Even those who work on holidays are paid time and a half and those who work on week ends are given a day off within the week. So Ghanaians must wake up.

Arthur K, Gabby Otchere Darko and other NPP apologists would have a very difficult time understanding how a common "Bernard Mornah" has succeeded in shutting upon them the backdoor they were trying to use to impose a defeated Nana Addo on Ghanaians. It was tried in 2008 and failed. Now that loop-hole has been sealed permanently or for now. The only option is to compete in 2016 and this time not to concentrate on two regions, not to feel entitled, not to denigrade other tribes, not to threaten other Ghanaians, and ofcourse to learn the lessons from Arthur K's "Chasing the Elephant to the Bush". Please Arthur K, don't go back to your vomit. And one would wonder whether the NPP were estopped from joining in the Bernard Mornah's case at the SC, as the NDC did in the ongoing petition.

That is where trials take place. he losing party could then appeal to the Court of Appeal, and finally, the Supreme Court. In all the common law jurisdictions in the world (US, UK, Canada, Australia, South Africa, NZLD, etc) the Supreme Court is for arguments.
And by the way, the gentleman is right. Nobody has the right to tell the Supreme Court that it cannot sit on weekends or holidays. If it thinks that the nature of the case before it requires that it sit on a weekend or a holiday it ahs every right to. Can you imagine Congress telling the US Supreme Court when it can sit? This is absurd.

When did Mornah realise there was something unconstitutional about the Court sitting on public holidays etc? And the timing for the ruling here perfectly paralleled the current Election Petition. And go down further to look for the political leanings of Mornah and the potential political sympathy of his counsel. Thirdly see the potential wrangling the nation faces whatever direction the final verdict goes providing one side puts the breaks on and say it's ok "I give up, I accept for the sake of the nation." Otherwise, we all would be sitting on tenterhooks. Appeal and counter-appeal could clog the wheels of economic progress and breed unnecessary social unrest and tension.
Even if Arthur K were not an NPP scribe one should still objectively see logic in his observation and wonder aloud with him, why all this confronting Ghana? Are we going to see an end to this sort of saga so soon?
I personally wish no one ever had any cause to substantially doubt the declaration of the 2012 Election! Unfortunately that's a wishful thinking. the reality is different!
Couldn't the court gauge the timing even if Mornah had all the rights to lodge the complaint?
