The supreme court told Ghanaians John Mahama was the president and sworn him as our president. Stupidly the very supreme court is saying the decision they made can be challage in the courts again. Supreme Courts dont have appeals.
NPP and Nana Addo are better and clever that our supreme court. Supreme court dont know what they are doing, think about it, our supreme court cant decide because of how corrupted they are, if they were not sure of John Mahama winning the elections why did the swear him in as our president.

The SC was absolutely right in its decision in favour of Mornah.

Below is a response I gave in support of my argument against the CI 78 stipulating that the sitting President can be joined in such an electoral suit as we have now. The same argument and principle apply in the SC reaching its decision. Likewise, Mornah will win the case if he brings the action against the No Verification by Biometric Machine No Vote nonsense!

I wrote then, among other things:

"3. No, the Const. does not grant Parliament any right to make legislation, even if a CI, to contradict it WITHOUT going through the appropriate amendment procedure!

In fact, even Parliament cannot make laws to contradict a previous legislation. See my response to a contributor on Ghanaweb who claims to hold a PhD in law who drew my attention to this principle in an attempt to support a suit against the President, just as you also argued here.

I've examined the principle thus referred to by you and found it in support of my stance.

For the sake of other readers, I've quoted a bit of what's out there.

"The rule is generalia specialibus non derogant. The general principle to be applied ... to the construction of acts of Parliament is that a general act is not to be construed to repeal a previous particular act, unless there is some express reference to the previous legislation on the subject, or unless there is a necessary inconsistency in the two acts standing together. And the reason is ... that the legislature having had its attention directed to a special subject, and having observed all the circumstances of the case and provided for them, does not intend by a general enactment afterwards to derogate from its own act when it makes no special mention of its intention so to do...."

Unquote.

In simple English, Parliament cannot even be allowed to pass another law which contradicts or, in practice, repeals a previous special act, unless reference was explicitly made to that special act that it was being amended in such and such manner.

Now, we've an act of Parliament which attempts to amend or contradict with the Const, a far superior body of laws, without specifically referring to the Const'nal clause/s to be so amended, and you are suggesting that the MPs that botched up with the CI 78 might've thought or got in their minds the immunity Article when botching up, and so we should accept that the Const. was amended by a simple majority of incompetent MPs?!

I am sorry, this argument falls flat on its face. Not worth further consideration.

So, was Parliament, while making the CI which mandated the SC to sit on public holidays to hear an electoral dispute or repeal the right to a review of a SC decsion, mindful of these legal provisions to avoid making another law which contradicts a previous law, or a const'nal provisions? It it were, the SC wouldn't have thrown the CI out, even if only on technical grounds!

I concluded that response thus:

""The President's lawyers haven't entered a plea yet, so we can't conclude that this discussion is a moot one. As we are all agreed, they must go to the SC, even if to make only a case of immunity for the President, which some of us are pushing for. They may decide to show-boat and make mockery of the whole legal system in a bid to show that they are better legal luminaries than the NPP team, since the case itself is clearly incompetent and lacks merit, and so they are sure of winning this time around. That'll be just a political circus in the SC, in line with the frivolous mission the NPP has embarked upon. I hope the Justices of the SC have enough integrity and respect for the posts they occupy and throw all of them out as the clowns that they are!

Well, the President has since then entered a plea and the circus is on, with lawyer Amekudzi making a recent appearance as a spoiler clown!
