All parties have copies of all the documents and there is absolutely no way that anyone can 'doctor' any documents at this stage. How can such eminent judges rule, halfway through a case, that the affidavits being used for the case were probably short changed! In this case, we learn that during the distribution, council for two of the three respondents contacted the court registry to complain that they had been short-changed after auditing the packs that had been delivered to them, and the court registry obliged with the missing delivery. Now we were all witnesses to all three groups of respondents' counsel requesting an audit because they claim they were short-changed. And none of the nine justices could recall from their minutes that two of the complainants are contradicting themselves. That is justice by the timid justices.
Moreover, how come the petitioners have to contribute towards the cost of the auditing? One would have expected that the respondents who asked for the audit be responsible for the costs since they are calling for the process. The petitioners submitted the correct number of documents, as testified by records of the court registry, and even if there is any short fall after the audit, which we all believe will not happen if the court registry is not implicated in this, the petitioners cannot be blamed because they could not have kept watch over the package after it was delivered to the court registry. Or should that not be the legal position? Nobody goes to the supermarket, purchase a bundle of phone-cards, and two months later go back to the store to complain that he had been short changed!
Each passing day, some of us got concerned about the administration of justice in our society. Our judges should sit up, else people will not stop accusing them of timidity and all.
