No,the NPP has always proved its democratic credentials and by choosing to go to the Supreme Court instead of taking to the streets it reaffirmed its commitment to democracy. It's the NDC and its violence prone supporters who raided the EC offices in 2008 and threatened to cause mayhem like what happened in Kenya if their candidate Mills was not declared the winner. Cool heads prevailed because the EC declared Mills as the winner. It's the NDC that needs to prove itself. In 1992 Mr Rawlings, the NDC founder and President at the time publicly declared his aversion for democracy because according to him it was too restrictive and rigid.You see democracy is a very difficult if not an impossible learning curve for the violence prone NDC.

THAT THE SUPREME COURT HELD UNANIMOUSLY THAT THE PRESIDENT RIGHTFULLY EXERCISED HIS CONSTITUTIONAL AUTHORITY UNDER ARTICLE 57 SECTION 4 OF MAKING SUCH APPOINTMENTS.
THAT IT WAS IN THIS CASE THAT A MEMBER OF THE PANEL RAISED A PRELIMINARY OBJECTION "WHETHER A SITTING PRESIDENT OF GHANA WHILE IN OFFICE CAN OR COULD BE SUED OR JOINED TO A LAWSUIT AS DEFENDANT?" THAT THE SUPREME COURT HELD 3-2 MAJORITY THAT "A SITTING PRESIDENT OF GHANA WHILE IN OFFICE CANNOT BE SUED OR JOINED TO A LAWSUIT AS DEFENDANT".
THEREFORE SETTLED THE LEGAL POSITION OF THE QUESTION IN VIEW OF THE FIRST PRINCIPLE OF THE RULE OF LAW WHICH PROVIDES THAT "THE SUPREMACY OF THE LAW IS AS ADMINISTERED BY THE ORDINARY COURTS OF THE LAND AND IN THE INSTANT CASE THE SUPREME COURT OF GHANA AND HAS THEREFORE GIVEN EFFECT TO THE LAW AS SUPREME".
IT IS AT THESE RELATED BACKDROP THAT BEFORE THE SUPREME COURT ENTERTAINED THE PETITION AGAINST A SITTING PRESIDENT OF GHANA WHILE IN OFFICE WHETHER OR NOT A PRELIMINARY OBJECTION HAS BEEN RAISED IT BEHOOVES ON THE COURT TO MAKE A DETERMINATION OF THE ISSUE FIRST AND FAILURE TO MAKE A DETERMINATION OF THE LEGAL ISSUE OFFENDS BOTH GHANA 1992 CONSTITUTION ARTICLE 57 SECTIONS 4,5 & 6 , CASE LAW AND THE RULE OF LAW, JUSTICE AND FAIR-PLAY.

(ii) WHETHER OR NOT A PREPARER OR MAKER OF A DOCUMENT WHO MAKES A MISTAKE ON THE FACE OF THE RECORD IS THE DUTY OF THE COURT TO CURE SUCH DEFECTS IN VIEW OF THE BODY MAKING THE DOCUMENT CONSTITUTIONAL AUTHORITY IS SUBJECT TO THE CONSTITUTION ONLY AND ALSO INDEPENDENT AS THE JUDICIARY ITSELF?

IT IS THEREFORE MY RESPECTFUL AND CANDID SUBMISSION THAT AT THE END OF IT ALL GHANA SUPREME COURT WOULD DO JUSTICE SINCE I HAVE EVERY TRUST, CONFIDENCE AND FAITH IN THE SUPREME COURT THAT THE COURT WOULD DO JUSTICE.

Present day Ghana is not what it used to be in the '60's. Murder other than guns are associated with our country. Comparing the size and population of Ghana with US, I think the current rate of murder cases is also not encouraging in Ghana if they are all put in the media domain.

Depending upon how the US and the world sees the judicial merit of the Supreme Court's final judgment (NB. in the US, the majoraity of the voters desagred with the US Supreme Court's ruling in Gore v. Bush in a similar ruling. We shall see how the world sees Ghana Supreme Court's judgment.
