Tsatsu's stumbling struggle to end his lengthy cross examination, the disappointing somber looks of his learned friends and a sigh of relief from the bench, were expressive epitome of time wasted and failure to deliver a punch weighty enough to derail a determined opponent from a position fortified with consistency and youthful resilience. The Bawumian spirit was undoubtedly dominant in a battle of words, repetitious demands for answers and adamant display of arrogant persistency by a counsel whose apparent demeanour exhibited signs of frustration and anger; popular characteristics of senile fatigue.
Tsatsu's digression into a territory reserved for summation quickly subjected him to riducle from the audience and rebuke by the bench. In all indications the scale tilted when he droped his lastwords out of frustration and exhausted facts - but they were words to suggest a come-back for more cross-examination, a distasteful expectation met with chagrin of the audience. How could such an intelligent mind overlook the necessity to wear helmet of facts before jumping into a gruesome legal traffic ? Why must this personality defy all odds to take us beyond horizons of roller-coaster expectations, all in search of tools to defend the indefensible ?
At some point it was hard to believe if this was that long awaited legal luminary, under so much expectation to be armed with some high-tech legal weapons to cause terrifying inferno, enough to make witnesses burn in their seats and make petitioners run helter skelter in search of hiding places. From the looks of events it was a complete disillusion. Tsatsu was such a disappointment that the court room which was initially jammed with his fans in audience when he began mounting a defense settled with half empty seats as he bored them with his pink sheets and humdrum orthodox style of cross examination. In the end he emerged tamed and gored into submission.
Today he is court pleading with hopes to cross-examine vulnerable witnesses with unrelated relevance to the issue at heart. All to redeem his lost glory. Pitiful
I terribly miss Johnny Cochrane : may he rest in peace.

The question was that Jake made a press conference and announced to the world that the NPP has come across "widespread and consistent fraud" by the EC. In their submission in court, the word fraud was omitted. Tsatsu was after a simple answer in that fraud suggests criminality as opposed to irregularities, malpractices and violations. The import is that the NPP had no legal basis to charge fraud therefore they stepped away from it. All Bawumia had to do was that the NPP could not substantiate those allegations coming from Jake and was said in the heat of that moment. he danced around the question as he has done throughout the proceedings.
The female judge was being partisan and was wrong to openly disagree with the chair of the panel.

The first petitioner said we can’t really ultimately go by allegations so let’s examine the primary records of the elections, and this is why we put a committee together, which I headed, to examine the records because it's only the records that we can bring to court, and so we cannot just go by allegations, and this is why we brought this to court. After examining the records, we brought the allegations of over-voting, voting without verification, no signature, duplicate serial numbers and so on; that is our case [which] we’ve brought to Court”." This means that becaus eNPP could not prove allegation of 'fraud' they settled on gathering the hard evidence. That's all. I think that panel members on a case are human too, and can disagree on understandings of issues.

I was recently a witness in a criminal case in the UK and although not the same here making the slightest comparison of general court process and the pursuit of justice makes me find this one farcical. If a witness who is in court to get a judge(s) to agree with them ‘refuses’ to answer a question would it not be to their own detriment ? If indeed their action would not help the determination of their case in their favour who does it affect? If Bawumia’s evasiveness doesn’t make his case for him, why is the defence worried? Wouldn’t the judges who are deem intelligent at face value be able to tell and factor it into their decision making? I just don’t get it! The judges have set the parameters and all concern are aware of it so why the faffing around. To top it off, this is a case of facts not conjecture or circumstance so should be easy to deal with. The way things are, how the hell can anybody bring a petition of electoral deficiency and make any progress if they were not the calibre of Bawumia who has the ability to digest figures etc. To be asked to recall information on pink sheets etc , the whole system is so unfair to anyone interested in justice. I just despair!

Akua, I was just thinking aloud the same way you have written. This is purely an election petition and you are out to prove the credibility of witness? If we had one or two months period to solve an electoral petition before a president is inaugurated, do we think we can make progress looking at the way this case is progressing. For me, the most important issue should be are the documents or records submitted credible and do they support the claims of petitinoners? That are the legal parameters do we confine ourselves in arriving at a verdict eg statutory violations, irregularities, malpractices etc? If this is done rather than this civil suit cum criminal procedures way of doing things then we still have a long way to go. God bless us.

He made an extremely damaging POLITICAL statement at the opening of the case, when the NPP legal team tied to make an objection to which they were perfectly entitled. The trouble with Ghana is that when people reach positions of power, they tend to forget that there are rules of behavior that should bind them. It must be hoped that other judges are watching and will ask him to desist from his authoritarian bullying. After all, this is no ordinary case. Security agents want to "guard" (read "steal/commander")pink sheets; the offices of the NPP's lawyers are broke into and stuff removed (twice); General Mosquito and his flock give their own judgements everyday without being rebuked! Tsikata goes on and on,cajoling a witness and instead of the witness being offered any protection; indeed, the president of the court deliberately adds to the bullying and discomfiture of the witness. This SC president ads to the difficulties being faced by the petitioners. But he is only one of 9, thank God. The others are not asleep I am certain.

He must be pleased he was made the head of the Justices? An unseen Counsel of the respondents? Someone should please go through every single pronouncement of this Judge and you won't go far to clearly see the blunt bias he has copiously dished out against everything Petitioners!
I don't care if he did the same against the Respondents; it would amount to the same slackening of fair-play and justice! I think if care is not taken the man would mar the smooth course of justice in this case and cast the final judgement in serious doubt!
I thought he is there to literally oversee proceedings. Why has he persistently demonstrated objection and disdain to everything the Petitioners say? Why did he gloss over Tsatsu's long, convoluted lecturing interspersed with "shut up",and "dishonesty", slang and off-tangent questioning and copiously boring and repetitive questions?
Now he is up against his own on the Bench? An intimidating tactics to cow some of his own?
Oh Africa! No, Oh Ghana! Where did we go wrong? May be the best thing any Judge of the Highest Court should not do is to be political both at home and public; they must be pure apolitical, have no unblemished leaning towards any political party. Only that can the nation be sure of true objectivity, fair play and naked justice! A tough requirement this is, I admit. But for the sake of peace of the nation and freedom to develop all our Justices must remove any scum of political passion and be OBJECTIVE and help save the country. That's the only way to come out with a "justifiable JUST judgement". If NDC deserves to rule because there's no significant merit in the claims of the NPP so be it they should declare it in the end! And so long as it comes from fair assessment, devoid of bias from the Bench it would stand the test of time; the opposition would still cry foul but the nation would never hurt. We would get over it! But if the facts presented by NPP objectively carries significant merit nothing should be placed in the way of justice; they should gather courage and reverse the decision of the EC! But the road to this is hitherto not rosy; there is cause for concern and I cherish the hope our distinguished Justices including the Head would see beyond the politicians in the courtroom and think about Ghana!
Ghana has suffered for so long! She must be hurting so much! A nation blessed with abundant resources, both natural and human, is yet to strike the golden pot to make her children sigh sustainable socio-economic relief.

This is a case of precedence and the petitioners by this case are seeking to redefine, first of all, the role of polling agents. On this bases alone I believe the case should be dismissed. Otherwise in subsequent elections the polling agents' role will be diminished to naught. This important role cannot be over-emphasized and great importance MUST be attached to their training and the role they play to authenticate the elections. Their most important role is to quell conflicts at the very source. ONCE THEIR ROLE HAS BEEN PLAYED WELL IT BECOMES THE FOUNDATION OF DECLARATION OF ELECTION. The petitioners are primarily trying to basically undermine these roles for the sole purpose of their selfish interest. It must be told them in NO uncertain term that their polling agents did not find anything wrong with the elections BASICALLY. This is evident by their "attesting to what happened at the polling station" and not filling any complain forms. PERIOD! If there were no complaints filed at the polling station and their collation center agents endorsed the results as presented to them from the polling stations, then THEIR CASE IS DEAD ON ARRIVAL. "You and I were not at the polling stations" but the agents were there and attested to the proceedings without objections.

I don't care if Mahama or Akofo Ado is the president, I want the EC to be held responsible for their shoddy job. Remember Afari Gyan was hinting of prosecuting some people for embezzling money meant for training of personnel for the just ended election, meaning all was not well with the people that represented the EC.

He has by every indication by shutting down the NPP lawyer to sit down in the open court and telling Bawumia how to answer silly unrelated questions from the criminal unkept old crook, Tsatsu Tsakata prove that, Ghanaians are likely not to have fair judgement on the ongoing historic politcal Supreme Court case.
I think it's about time the leadership of the NPP raise this serious concerned matter up with the authorities that be, as all evidence proves that Atuguba is adopting tactics of intimidation after realizing his "akomfem" "woyomenized" criminal NDC kinsmen are the losers in the election case before him.

He gave an evasive response which was a deviation from a simple question asking him whether he still maintained that there was "fraud" as claimed in the letter from the NPP chairman to the EC.
The other justice shoul;d not have done what she did, and in my opinion she tried to undermine the authority of the chair of the panel when she was clearly in the wrong.
