Indications are clear that Tsatsu Tsikata, counsel for the National Democratic Congress, 3rd respondent in the ongoing election petition hearing at the Supreme Court, is banking his hope on exploiting technicalities in his desperate bid to save his client from defeat. Mr Tsikata’s NUMEROUS BORING DAYS of cross examination appears to have failed in mounting a strong challenge to the case of the petitioners in the context of the two issues being determined by the court. The issues are whether there were statutory and constitutional violations, irregularities or malpractices in the conduct of the December presidential election and whether, if any, they affected the outcome of the election.

The NDC’s counsel has mainly focused on defects in respect of labelling of exhibits by the petitioners, as well as those identified in respect of the pink sheets and affidavits. These defects, according to legal experts, are ‘curable’ and do not have significant effect on the case of the petitioners.

It beats my imagination that a professional body like KPMG contracted to conduct a check which is more or less an investigation to authenticate the status of a disputed contents of an exhibit takes over the job, looks at the boxes containing the exhibits and goes away without knowing how many boxes of goods they are being tasked to audit. And now they are proud to come and tell Ghanaians that they did not take inventory and so cannot tell whether the boxes have increased or not. If this story is true then such a situation can only not be a professional lapse or failure but smacks of some deliberate act of omission that has left room for manipulations and tempering with the exhibits to muddy the waters the more and hide truth and as such the confidence of parties in the pending case. I am highly disappointed in the KPMG ..If really what is being reported here is true.

How is it possible to believe an idea so simple could be overlooked? It is impossible, yet that is what they're straining hard to tell us: they didn't even dream it because the judge's assignment didn't include a command clause asking them to document the boxes. That's pathetic.

They're corrupt. It is not oversight. What we can say about it all is that, like is always in Ghana, they took money and sidestep the fact that they should have counted the boxes.

The cop askes for his registration and the guy says, "It's in the glove compartment, but it's not in my name because I stole this car in a car jacking and I killed the woman that owns the car and stuffed her in the trunk and the gun I used is in the glove compartment. At this point the cop tells the guy to keep his hands in sight and he radios for back-up.
When a supervisor shows up, the cop tells him the story and he walks up to the guy in the car. The supervisor asks to see the guy's drivers license and the guy hands it over and it is valid with the guys real name and information.
The supervisor asks for the registration and the guy says, "It's in the Glove compartment." The supervisor tells the guy to keep his hands in sight and walks around to the passenger side and opens the glove compartment. There is the registration in the guys name and everything seems in order.
Next the supervisor asks the guy to get out and open the trunk. The guy opens the trunk and the only thing there is a spare tire.
At this point the supervisor tells the guy what the other cop had told him. The guy says "I'll bet that lying S.O.B. told you I was speeding too!"

If that happens, the declared president (Mahama, in case you have already stopped reading) ceases to be President. If the evidence is sufficiently clear, the Court can declare a new President or order a run-off, if no candidate got 50%. Or, they can order a new election to take place within 3 months. How do I, a humble, foreign friend of Ghana, know this? Because I have read the Constitution.

From all what Mr. Addison said in the court yesterday it is all clear that he knows all about the 7 extra boxes that have been added to the 24 boxes to make them 31. We shall also ask what were the two representatives of the petitioners doing at the auditing, which they were ordered by the court to be present at.
The petitioners do not care if the number of pink sheet they presented got short and they are also not interested in if the number has been increased.

Put its own seal on them before transporting or moving them to where the audit is to take place. If the above is not done, then it means that KPMG is not a good auditing company. It is also true that Mr. Winful does not know his job or his telling lies.
An investigator does not take samples and just leave them in the air and does not say that he did not know the number of samples he or she took.

This really shows that neither KPMG nor the Ghana Supreme Court are suited for serious examination and resolution of an issue of this magnitude. For NPP and KPGM to inform readers and listeners in the entire world that KPGM, a so-called "world renowned" accounting firm would take possession of evidentiary materials from a legal court but did not take inventory to establish chain of custody and number and for the NPP not to have counted to ascertain the true quantity shows how inept and unfit the NPP, the Supreme Court and KPMG are.
If the NDC took count of the number of boxes presented/submitted to KPGM and neither the NPP and or KPGM counted the items how would that make NDC out to be liars? it only shows the contempt and incompetence of KPGM, the Courts and NPP. Only a fool from the NPP communications team would make such a silly statement and be proud of their collective folly.

The number of boxes should have been counted in front of all parties in this case and each box sealed only to be opened when representatives of the parties are present and counting is about to begin. Apart from that the copies of the EC, NDC and at least one of the judges should also be counted just to make sure all sides have the same number of boxes and equal number of pink sheets in dispute. This will settle matters on whether individual boxes had more pink sheets in some than others so it was not a case of each box containing a maximum of 100 sheets and therefore it should have been a set number of boxes. This will bring to rest the actual number of sheets that each side claims to have and what they should actually have. This is what happens when the judiciary is so corrupt and the civil servants do not pay attention to detail and no seriousness is attached to any project. All you are seeing is the characteristics of Ghana being used by KPMG employed Ghanaians to do such an important audit that can lead the nation to war. How do you pick up boxes without taking inventory? The first basic principle has been violated so who do you expect to believe you when you claim to have the over 11000 sheets claimed by Bawumiah or the just over 7000 by Tsikata or the just around 8000 by Lithur or the EC saying they have far less than the Bawumiah figure? Shoddy and Sloppy in action!!!
