Addison says the regulation spelt out by the second respondent was that if one person went through the voting process without being verified the results be annulled, is that right?

Nketia says he is unaware of that regulation. Besides electoral laws are not given by the Chairman of the second respondent at press conferences.

Recording

Addison asks witness if he can recall an interview he granted on Citifm soon after the elections. Nketia says he grants a minimum of two interviews per day and so cannot immediately tell.

Addison offers to play him a recording of the interview to refresh his memory. He says he is ready if only the recording is his voice.

Addison asks the permission of the court to play the recording. Court grants him the opportunity to.

Paraphrase of the interview

In the interview Nketia talks into detail about the no verification no vote maxim. He said in the interview that there is no way people will vote without verification. He added there is no such evidence that people voted without verification. He challenged people to come out and prove instances in polling stations where people voted without verification. He said if that evidence is made available the results of that polling station be cancelled. He says people who presided over voting without verification should be jailed.

Addison asks if the voice in the recording is his. He admits it is voice.

Addison then suggests to him that contrary to his claim that he did not know the penalty for the no verification no voting it is clear in the recording that he knew it and even called for the annulment of results if it can be proven that people voted without biometric verification.

Nketia denies. He says his call for the annulment of results are for irregularities and not biometric verification.

Addison reads portions of the transcripts of the interview in which the witness stated categorically that figures generated as a resulted of voting without verification be annulled and taken out of the national figure.

From my little knowledge, biometric is far more reliable that photo ID. We now have biometric passports to avoid fraud. It is fair to say NFNV implies biometric.

He is phoney, simple as! He doesn't even have the courage of his own blatant conviction. Yesterday, he was supporting Asiedu Nketia's pay-in-slip vrs cheque analogy, devoid of all reason. He came across so pathetic to me, considering he holds himself out as knowing a thing or two about something.He is happy to support the argument that the practise of serial numbering on pink sheet can in the case of the EC be purposeless as opposed to all reasonable people the world over knowing it is a control feature. In the case of the pink sheets the purpose would be to prevent a fraudulent EC official or any stakeholder in the election from faking one or simply for easy identification in an unintentional mix up of documents at any stage. I am not even going to engage him from now on, as he is off-putting.I really dont mind those who nail their colours to the mast as it is their prerogative but as for people like him, who crow endless about being open-minded and objective, he ought to be ignored!

You don't have to call the witness dishonest like Tsatsu was doing. I believe all the rational and objective NDC supporters would be very concerned about how Asiedu Nketia has performed. In fact who was coached throughout on what question and how to ask the question by his aids. What really was the purpose for playing that recorded tape? In the end, the tape rather played to the advantage of the witness because the council could not ask any sensible question from it. Rather the questions asked seemed to have consolidated all that the witnessed has been saying in the court room

On the issue of NDC agents or other political party cannot forced the presiding officer to do what is right, the general said the agents can however show the presiding officer did not follow the law by raising an objection to that by not signing the declaration column of the pink sheet and also indicate the reason why he/ he did not sign. And that provision had be made clear on the form. Again there is also a complaint form there that you filled to challenge that results. However none of the polling agents of the NPP challenge the results at polling station or the collation centre. We know NPP gave hot lines that any agent that suspect a misconduct by anybody including the presiding officer should call that hot number during the day of election and that one too, no agent called. Again on whether the agents signed or not the results will be declared the general said they still could have objected by refusing to sign and indicating on the pink sheet the reason why and the particular pink sheet can also be challenged at the collation centre. The Provisional register, the general said that the daily printouts during the registration was compelled to form that. Indeed the registration officials of both the parties were available at the various polling stations during the registration. In addition the general said that contains age, sex, name however Philip Addision said by making general to read a section of election guideline said provisional results should also include pictures of which the general said that since 1992 it has always contained sex, age, name and ID number. On creating on new polling station 42 days to election the general said he is not a lawyer to interpret the law but Addision got temperamental and said general assertion that of all his certificates he has never claimed he has a law certficate was offensive to the bench but not him because he know the circumstances sorrounding the first pettioners law certificate. Meanwhile he was the first to say it is surprising his 34years of election he doesn't know that. On bad faith the general still asserted that the polling stations whose vote that the petitioners seeks leave of the court to annul is concentrating on the strong holds of the first respondent even in Asante Region the petitioners carefully selected where those polling stations which are strongholds of the NDC. It is true general said the polling stations that first petitioner won was not many but he also had asserted in the in evidence in chief that they are several polling stations in the strongholds of the NPP where these happened but because it goes against them they did not include that in the evidence. In any case if you want justice as the petitioners claim why didn't they analysed all the 26002 polling stations and say out of that total figure this number do not have the irregularities we are talking about but this % has voting without biometric machine verification, this % has over voting, this % has same serial number and this % has no signature of the presiding officer. But you rather select 11842 polling station with only about 1000 from your strongholds where you won though you know election did not take place in 11842 polling stations but 26002 polling stations across the country. I thought NPP directorate would have talk about the Citi FM CD that was played but fortified the general's case and made lawyer Addision Escoba of our time. Complete own goal. I thought that was of the most insightful highlights in today's hearing.

NPP can save their lies to themselves. We all saw Philip Addison wasting everybody's time by playing a tape that conly emphasized what Asiedu Nketia has been saying in the witness box. Asiedu Nketia insisted that results can POSSIBLY be declared if agents sign or not. POSSIBILITY IS NOT CERTAINTY. This is consistent with what the law says. NPP Agents certified all the results for their candidate without any complaints so this is even straight forward validation of the declaration
