It's not the size alone that scares people in life now. It's the brain power!! The NDC and the Presidents legal brains are of their own class and ilk!!! The Supreme Court Judges are creating problems for themselves. The rule that was set by the Judges on 2 April 2013 was that any person who woul like to testify, either for himself or on behalf of an entity should file an affidavit and outlined his evidence in the affidavit. If two other persons filed an affidavit for and on behalf of the Electoral Commission, then by the rules set by the Judges, Afari Djan cannot give oral testimony. Such incidents erodes the confidence the public have in the Judiciary.

The witness identified a collation form from the Akuapim South Constituency and indicated that he was familiar with collation forms.

However, Mr Tsikata again objected to that line of cross-examination, saying the witness could not tender a document of that nature, since the form was produced by the EC.'

This is an extract from a Graphic article yesterday. It confirms that, counsel for the NPP tendered in an EC document and tried to use it in his cross examination. The implication is that, we need to know how he got hold of such a sensitive document. Imagine your opponent in a land dispute getting hold of your documents through a source from the Lands Office. I can imagine the same source selling them ( both parties) ballot papers to be given to party die-hards to use when voting. I believe the EC are only trying to do a good job in a bad and difficult environment. Simple.

But this ruling from the justices seems to confirm my thinking that since Dr Afari Gyan "Is the Party", although he may have 'surrogates' who swear affidavits in the case, since he has been served notice to appear in court "as accused" (because he was SPECIFICALLY NAMED BY THE PETITIONERS" IN THEIR SUIT, he should be allowed to 'defend' HIMSELF and by the same token, his ORGANISATION which has two of his staff SWEAR AFFIDAVITS. What does one need in order to qualify for law school? And why was counsel trying to 'block' Afari Gyan?

Is it because he has such a wealth of knowledge or that he can clarify issues in such a way as to influence the judges' understanding of the issues better than the other EC representatives? Does Addison want to know the TRUTH and the whole TRUTH and nothing but the TRUTH (so help us God)?

However, since they have not been registered as players themselves and in the cause of a game when the odds are against them and no matter how good the coach or team manager is, he cannot pull a player off and take his position. That is against the rules.

So my point is if the Court by their own directives or decision on April 2nd categorically made it clear that without a sworn in affidavit no privy to the case would be allowed to testify during the hearing, then the SC ruling is wrong.

Legal matters dwells on facts and also the very words used in every sentence or an opinion. Considering Mr. Addison's quote "a directive given on 2nd April to the effect that parties MUST SWEAR AN AFFIDAVIT to be allowed to testify" and the ruling by Mr. Atuguba - quote " Afari-Gyan was representing the EC as a party to this case and returning officer of 2012 elections of Ghana. He can therefore pursuant to the directive given on this case on 2nd April give oral evidence on behalf of the respondent". The ruling is wrong because Mr. Afari Djan didn't swear an affidavit neither on the April 2nd nor any other date to be eligible to testify. Anyway this is a layman point of view. E&OE.

I happen to believe that Counsel Addison tried to misinterpret the "directive" about affidavits and my guess is that the supreme justices picked that up. However they needed to have a vote to demonstrate fairness in analysing and interpreting the very directive that Addison referred to. That is my take on this one.

If the NPP General Secretary, Mr Kwadwo Owusu Afriyie knew of the painful frustration that Nana Addo Dankwa Akufo-Addo, the first petitioner in the on-going Supreme Court (SC) challenge of the 2012 Presidential Election results went through and how he reacted in court on Wednesday May 29, he will never have waved his blue handkerchief when the case was adjourned.

The frustration was so glaring and huge that Akufo-Addo could not contain himself, so he sprang on his feet and verbally attacked his lawyers in court. Nana Akufo-Addo was seen venting his spleen especially on Mr Philip Addison for failing to stop Mr James Quarshie-Idun, the lead counsel of the Electoral Commission (EC) from asking certain questions during his cross-examination of Mr Johnson Asiedu Nketia, NDC's General Secretary.

Nana Akufo-Addo angrily blurted out, 'Why are you allowing them to take a second bite at the cherry without protesting.' He threw his arms in the air and told them that they were allowing the respondents to have a field day.

The incident happened when the justices of the SC went on a short recess to deliberate on the objection raised by Philip Addison on the line of questioning by Mr Quarshie-Idun during his cross-examination of Asiedu Nketia, who is popularly known as General Mosquito.

Nana Akufo-Addo could not understand why Philip Addison did not raise series of objections to the questions which he Akufo-Addo considered as re-examination by the EC counsel. He told them that it was plain wrong and unacceptable for them not to have raised objections to several of the questions posed by Mr Quarshie-Idun.

The twice defeated flagbearer of the NPP told his lawyers that he was very much disappointed in them for allowing General Mosquito to rehash his answers in order to repair the damage to some of the questions posed to him by Philip Addison.

Nana Akufo-Addo insulted his lawyers for doing a lousy job and his words were captured by several people around. This behaviour by Nana Akufo-Addo clearly demonstrates his feelings as he has witnessed his weak case and the way it has been torn apart by respondents.

If Akufo-Addo is angry with the way the case was going and could therefore question the competence of his own lawyers whilst openly berating them in court, it seems amazing to see Kwadwo Afriyie also known as Sir John waving his handkerchief in front of the court premises when the case was adjourned.

This is a clear example of a confused Sir John who does not even know what is happening around him let alone know the dynamics of the case before the SC. He has made it his habit of throwing a party any time he feels that the case is going the way of the NPP.

Otherwise how can Nana Akufo-Addo be angry with his lawyers and berate them for doing a poor job in court and less than 30 minutes later see Sir John jubilating that the case is going good for the NPP?
