Today, at 12:15, Dr. Afari Gyan announced the election results again. If and only if the NPP had won at all the constituencies that had been cancelled, with JDM getting 0 votes, Akufo Addo still had no chance to be president. He emphasized that Mahama actually won the elections. Surely, these guys should stop pursuing the case and strategize for the next elections. Akufu Addo is a good politician but he surrounded himself with the wrong folks. I’m sorry for him that his dreams were shattered by the kind of cheap politics his team resorted to. They can make him a vice presidential candidate next time. I saw tears in his eyes but Jake still had a smile on his face probably saying “I’ll start thinking of the next person to support for the NPP flag bearer slot”.

One example of an overvote would be voting for two candidates in a single race with the instruction "Vote for not more than one." I think any issue on over voting MUST, as Afari Djan said, consider the Register, The ballot papers, and the BVM. Anything outside this is useless and baseless. Pinksheets depend on the above to be AUTHENTIC.

For the petirtioners everything is over voting. Even when the invalid votes are not counted as valid votes issued, it is over voting. Duplicated serial numbers which have no bearing on the votes are even considered over voting. That is how desperate you have become.

At the polling station, ballot papers are issued to voters who're already verified to vote. These people proceed to vote, and let's say that number of people is 150. If at the end of the counting, officers have 200 ballot papers in the box, don't you think OVERVOTING by 50 has occured? If you disagree, would you explain why you disagree?

You said Pres. Kufour was also elected on overvoting, if it was true that would have been WRONG, but why the NDC did not take NPP or EC on in the court of law?

Ghana is developing a DEMOCRACY, so even if you feel Kufour got voted by foul means, that MUST be collected and NOT allow to take root as if it's acceptable. In election it's NOT PRACTICABLE that everybody that registered during registration will be there to vote at election time. This is because a registered voter might have DIED before election, might be too SICK to go to vote at election or might have TRAVELLED and cannot make it to his/her designated polling station to cast his vote, or simply UNWILLING to vote. This why in determining an OVERVITING you DON'T depend on those REGISTERED to vote but rather those who actually VOTED, because as i said, registered to vote does NOT mean one actually VOTED!! Therefore the number of ballots papers in the box ( those who actually voted) should NOT exceed the number of ballot papers countered. If it does, then there's over voting, otherwise somebody responsible for the election MUST explain!!

One hundred (100) people have been duly registered at a village polling station. Out of these registered voters, twelve (12) died before the elections.
On the election day, eighty (80) people went to cast their votes, and the recorded number of 'ballots issued' on the pink sheet is 80.
The total sum of votes counted for the parties add up to ninety-two (92).

Do we have over-voting here? Or,
What do we have here? What is your definition? Knowing that indeed, 100 people appear on the register, and also knowing that only 88 people are alive. and knowing also, that only 80 people showed active interest in the elections.

Suppose there are 100 voters on the roll at a polling station. Records show that 70 people actually voted on that day. On counting we find the total number of votes to be 85.

In the NPP's definition, this is over-voting. In the NDC and EC's definition this is not over-voting.

Any fair minded person will know that the scenario above is over-voting. I can now understand why they always bloated the electoral register, because they can always find additional votes regardless of how many people actually voted.

First the NPP Polling Agents signed the Pink Sheets. Thery would not have done so if there had been incidence of people stuffing more than one ballot into the trasparent boxes. Second if you factor in soiled ballot and invalid ballots and the several records and tabulations to be m,ade on the pink sheet it is not unreasonable to say that there were bound to be arithmetic mistakes.

More importantly the NPP case hinges on 9000 plus pink sheets with duplicated serial numbers and others with no Presiding Officers signature. Are those cases of over voting?
What the petitioner is yet to prove is that the EC and the NDC conspired to rig the elections.

This man is tell us that for example: if you have 100 registered voters and 80 voters shows up to vote, meaning 80 ballot papers are issued and you count the ballot in the ballot box and you see 100 ballots, then there is no over voting. This is sad. EC boss and a PHD holder and he attended University of Ghana, the so called premier university in Ghana.

This is matter does not need a rocket science analysis. Clearly this means that overvoting can occur at different levels and depending on which level inquisition could be made to certain group of people to explain the anomaly. Simply put overvoting occurs when the output exceeds the input.

At the first level when the names on the national register falls below what is submitted at poling stations on the day of election then overvoting has occured and EC will have to answer to this.

Secondly when the total votes cast exceed the submitted list on the day of election then another form of overvoting occurs, once again the case of output exceeding what was put in. Stop the unnecesary politics and address the issues all the stakeholders involved

One example of an overvote would be voting for two candidates in a single race with the instruction "Vote for not more than one." Robert's Rules of Order notes that such votes are illegal: "If he votes for too many candidates for a given office, however, that particular section of the ballot is illegal, because it is not possible for the tellers to determine for whom the member desired to vote."[2]

Undervotes combined with overvotes (known as residual votes) can be an academic indicator in evaluating the accuracy of a voting system when recording voter intent.[3]

While an overvote in a plurality voting system is always illegal, in certain other electoral methods including approval voting, this style of voting is valid, and thus invalid overvotes are not possible.[4]

In the corporate world, the term "overvote" describes a situation in which someone votes more proxies than they are authorized to, or for more shares than they hold of record.[5]

So if RV=100
and BC=120
then by his definition, there are 20 votes over.
But this is the scenario the judge is trying to point out:
What if RV is the 100, but facts are not all these 100 voters might vote. So if out of the 100 RVs, only 90 people actually were CHECKED/MARKED as turning up to vote but the BC is 100?
Possibility of this situation arising could be finding duplicate ballots in the ballot box, people coming from other polling stations to vote because they have twice been registered. Someone may ask, the existence of biometric machines would not allow this scenario. But bear in mind that the EC Boss testified that verification could also be by face, and the numbers he gave far exceed that provided by the NPP. And so the possibility of registering multiple people at different polling stations to biometrically face-vote cannot be ruled out.

2. When the number of ballots cast exceed the number of people registered to vote at a polling station because both situations amount to the same thing i.e. that there are more votes counted in the box than should have been (beyond expectations).

What happened here was that the witness for petitioners and the one for respondents chose to define over-voting to suit their particular needs or arguments, hence the EC chairman basically saying - "well, I don't really know what the definition is anymore".

Is this something too abnormal to ask for to ensure the integrity of the polls? You tell me.? If the respondents know of any instances where over-voting occured as per their deinition, they can also come forward and ask for the annulment of such votes. At the end of the day we need our elections to reflect the will of the people and that will be good for me and you citizens of the country who will enjoy good governance because politician will know they cannot take us for granted.

The next step would be for the justices or the court to examine the imoplications of that within the constitutional provisions and ecide whether votes should be "annulled" on account of that. I would have thought the most sensible thing to do in those circumstances would be to review and cross-check and match votes with actual persons, then discard the ballots that are not right.

Indeed another category of ballots is the "spoilt or rejected" ballot where due to tampering of the ballot paper, e.g. someone making a mistake and marking two instead of one candidate, the ballot is automatically rejected.

Also bear in mind that extra ballot papers reserved at polling stations is also for replacement where a ballot paper is damaged inadvertently and has to be replaced. This is where some of Dr Bawumiah's analysis has become muddled (although we haven't got to that stage of the case yet.

My impression is that the respondents want to tell the court that the petition does not merit even those detailed examinations of the vote. Let's wait and see,

This clearly gives room to manipulate the figures: As the custodian of the registered, he knows the 200 and can be sure to add enough to bump the actual number who voted but will be careful not to exceed the 200. This can clearly happen in transmission. Use the Taifa Dome case: even though the NPP canadidate won, enough votes were added to the loser to bring the number of voters up..but not enough to exceed the total registered voters for the location. If the "bridged all the gaps" or as many as they could, it will affect the results. I was in Ghana when the registration excercise occured but could not go home to vote. So if the results shows that 100% turned out at my station then someone voted for me right? Will that be termed overvoting or not? It is clearly an irregularity. So theinformation on the pink sheet is crucial: Num. of registered voters plus who actually turned out and how many sheets were issued are all important figures and must be entered accurately!

Justices are expected to probe further for clarifications on statements and positions of witnesses in order to form an oppinion for their written judgement.It is seriously wrong to be emphatic on a statement in open court and continue to advance reasons for it.It casts doubt in the minds of many as to whether such a judge can be truthly impartial. If later there is another convincing position it becomes difficult to convince protagonists that the new opinion has not been 'influenced'.Personally I have come across a cheque booklet of fifty one leaflets istead of fifty simply because one leaflet was duplicated serialy.A ballot booklet can suffer same and lead to extra ballot. What about that? I would want to suggest that Justice Baffoe Bonnie keeps his opinions for his judgement and spare us the agony of judgemental positions now.

Any sensible person will find the Dr`s explanation more plausible,because irrespective of the voter turn-out,so lond as eligible voters are properly processed in full glare of election officials and party agents,then any 'ballot-stuffing'- more votes being n the ballot box than those entititled to vote - will become appaent. He promised Ghanaians of free and fair elections, but now it's clear that the deceived the nation, by helping NDC rig the elections. It's all an orchestrated plot from the beginning, up to the court. We have 3 lawyers up against Dr. Bawumia and the NPP. They're still finding ways to lie to the Court, Ghanaians and the whole world. Their plot won't succeed anyway. Afari Gyan has refused to say the TRUTH concerning what OVER VOTING is. By opting for the vague definition given by the respondents just to appease them, he has helped the judges by making it easier for them to declare the PETITIONERS as winners of this case.

When Justice P.B. Bonnie realized that Dr. Afari Gyan was not being truthful on the deifinition of OVERVOTING, he "forced" him to admit that both definitions given by the two parties were valid: "where ballot cast exceed the number of voters eligible to vote at the polling station( respondents definition), or on the biometric register(petitioners definition).

Any critical thinking person like Justice Bonnie, will tell you that the definition given by the petitioners is more accurate because it takes into account that in practical terms, NOT all those who registered to vote during registration turn out to vote during election, reasons being, DEATH,SICKNESS,TRAVELLED, UNWILLING TO VOTE, etc.. Therefore, the BEST way to determine the ACCURATE definition of OVERVOTING MUST be limited to the actual people who went to the polling stataion,verified by the machine, and ISSUED with a BALLOT PAPER and VOTED. If the number of votes counted at the end of voting EXCEEDS the BALLOT PAPERS issued to voters, it's then a clear OVERVOTING case!!!

Afari Gyan MUST be prepared to be taken back to this LIES when counsel for petitioners resume his questioning!

How can he be EC boss since 1992 and can't define what over voting means? What is he there for? It is now coming to light that not titles make some one intelligent. That is a gift from God. You can go to school and be smart in books but that do not constitute intelligence. His actions emphasize the adage - "A fool will be a fool either he goes to school or not."

I will advise him to retire immediately after this election debacle and go and enjoy all that he has acquired peacefully till his dying day. He is a disgraced individual not only in the presence of Ghanaian community but the world at large. This is an individual who said the other day that, he was assisted by 130,000 election officials in 26,002 polling station who were not properly trained. Does this sound logic? The trust we had in Afari Djan have completely diminished and had it not been God's guidance to the good people of Ghana, the nation could have been plunged into aftermath turbulence.

I wish the next EC Boss will take this as an important lesson and not let partisanship be part of him but have love of country and country at heart to discharge his duties without any favor. E&OE.

It means if the Presiding Officer gives many ballot paper to somebody to vote up to the total number of the names in the voting register; it means with Afari Gyan's definition there is no over voting. There is no doubt that more votes countered than registered voters is wrong so is more votes countered than ballot papers issued. The question is which one applies here.In my humble opinion the two should be put together to make one definition of over voting. In this case over voting did occur.
