Why isn't the Respondents lawyers focusing on the constitutionality of allowing every citizen who is qualified to vote and had valid identification be allowed to vote- which could be justification or a valid argument as to why the Petionners cannot ask a court of competent jurisdiction for validly casted votes to be annulled in favor of another's incessant quest to become president at all cost!

Wouldn't such a request be tantamount to a Court usurping an important provision of the Constitution of Ghana that these very Jurists are tasked and mandated to be the interpreters of, as guardians of the law of the land?

I mean the Respondents lawyers should have quoted the Constitution and Apaloo v. EC as legal rationales as to why the biometric machines CANNOT be the end all be all for voter identification- is that NOT a possible violation of the Constitution itself, to have such a "by all means, only" mandate for voter verification? What happens if a voter for whatever reason cannot be verified by a biometric machine? Does that mean such a person's constitutional right is denied because of some arbitrary machine?

Thus, whereas as Dr. Afari Djan is correct in stating the above example, it need not apply to only known "Nanas" but to every citizen that had validly qualified to vote, but for some arbitrary malfunction of a machine- SHOULD THEIR RIGHTS BE DENIED?

This is what is baffling me in these court proceedings. I must admit, that I have NOT been listening, only reading from the media... I wanted to read that competent persons from both the Petionners and the Respondents side have been arguing on behalf of the Citizens rights as granted by the Constitution, the right to vote, cannot be invalidated by machine malfunction, including some arbitrary EC laws which must comply with the tenets of the Constitution as the law of the land?

The man said he will allow Nana to vote only after he has been verified by the polling agents and EC official and a host of town folks who knows him well. This is after the biometric machine has failed to verify. Failure of the biometric machine to verify Nana is no fault of his, therefore should not be used to disenfranchise Nana.

The NPP just want to use petty technicalities to install Akuffo Addo as president. Only a fool will think that there was a deliberate and systematic attempt to rig the elections. NPP needs to prove their case with concrete evidence beyond doubt that rigging was done grand style in all parts of the country or even in the 22,000 polling stations they have selected. Not doctored computer generated evidence put on CD-ROM any body can easily produce first hand.

What he did not add was that this would be an exception rather than the rule, and that he was merely citing that extreme example to buttress his argument about why the biometric machines were introduced:
1. to eliminate IMPERSONATION and
2. Prevent MULTIPLE voting.

Where is the "smoking gun" here? Propaganda can be very soothing to your "die-hard" supporters but they do not translate into 'winnable arguments' in a court of law.

Oh boy, what does one need to qualify to go to law school these days?

It introduces an element of bias which the Biometric verification machine was supposed to address. Did we waste money importing them then?

Not just certain people but anyone plus if FO's do not go through the finger print procedure then I don't see why someone should be turned away just because the machine wont take his or her finger print if indeed his or her information showed up that he or she is valid voter.

I think you are missing the point. The information of a voter can only be shown up on the screen of the device only when the voter's finger print is verified. With the exception of the FO's you can not have any other voter's ...

What the petitioners are saying is that, even if you registered and your name is in the voter register but your finger print could not be captured by the machine you should not be allowed to vote; the reason Afari Gyan cited that example and I commented on it. I believe you now agree with me and Afari Gyan. Otumfuo is registered and his name is on the register but unfortunately, he gets to the polling center and his finger print could not be captured by the Verification Machine and a presiding officer sends him away. Would that be fair?

Gyan is not denying the were errors and these errors were made by EC, if he knew there were errors in the voting WHY did he make Mahama the President. The whole world is watching ghana supreme court. 8 judges fail ghana by allowing Gyan to file a document after the court told everybody they would take any more file. If Addison is saying the document wasnt the original, WHY did the judge over rule he when he object. Why didnt the 8 judges ask Addison to bring the original one the EC gave to all the parties instead over rule Addison. They made the Law and broke it. They said no more filing yet Gyan was about to file a new register with the help of 8 judges.

What is in Afari Djan's mind? Is he trying to bend the General Election Regulation 30(2)of the C.I 75 to suit some class of people or what is his motive?

I will say it again that it is his fool hardiness that has plunged the whole nation into this quagmire had he reasoned from the onset to have allowed a recount when NPP raised the question of election malpractices but he chose to make his famous line to the Petitioners "to go to court to sort out the issues." The recount would not have taking 2-months to complete but his stubbornness has and dragging this issue to 6-months now which is making it impossible for Mr. Mahama to have peace of mind to stamp authority in his administration. Shame on you and a disgraced - Afari Djan. E&OE.

Simply, it is to help to identify voters properly and adequately. So if Nana Otumfoa Opoku Ware comes to the polling station, Nana is known to every person in the town; and normally, Nana will not join the line and his name is seen on the voters register and if the BVM is not functioning, that should not disenfranchise the Nana. To allow some people to vote without verification as against the spirit and laid down rules of the electoral game indicates that, in EC's minutive guinea fowl brain, some people in Ghana are above the laws forgetting that the Supreme Court Judges he stood before are more technical on the laws of the land than some ones perceived ideas to go round the laws of the land in favour of some.

In fact the NDC's general mosquito and the EC have shockingly killed and destroyed every tool available for their defence team. Technically the case is finished and dead on paper. It's just a matter of time to declare NPP the winners and ask the crook and self confessed immoral Mr Dumso-Dumso Dross Maha-mad and his criminally corrupt guinea fowls team to embarrassingly pack their dogs, goats and cows kits from the seat of Presidency before they sink the image of the country beyound recovery.
