In a surprising turn of events at the ongoing residential election petition at the Supreme Court, Chairman of the Electoral Commission of Ghana, Dr. Kwadwo Afari-Gyan ended the second day of his cross-examination by lead counsel for the petitioners, Philip Addison, by accepting finally the petitioners definition of over-voting which he had earlier denied in his examination in chief.

Counsel Philip Addison in ending his cross-examination on the day presented Dr. Afari-Gyan with a pink sheet from Temporary Booth Jinpenhi with polling station code K030405, on whose face over-voting could be seen as the total ballots cast totaled 67, though the number of registered voters on the polling station register indicated on the pink sheet was 21.

My friend, look, your ballot paper used at the polling station at where you voted is intact in the box and deposited at the police station.Any challenge to an election result should be aimed towards the re-count of votes.Any other means is VOID.We have used about 28 days at the Supreme Court hearing.If the NPP genuinely thought that the won the elections,why did they not seek a relief in their application to the Supreme Court for the entire votes to be counted.According to the NPP, they investigated 24,000 polling station results out of the 26,002 polling stations.However, they are asking the Supreme Court to annul the 2012 Presidential election results based on the entire 26,002 polling stations and declare that man president!They are implying that if you plot the number of votes in each polling station on a graph, it would indicate a straight line phenomenon, i.e if 24,000 is 5 million then 26,002 would be 26,002 divided by 24,000 =5.42 million.You see how stupid some people are? They are comparing a Polling Station at Manhyia in the Ashanti Region with a small polling station at Huhunya a village in the Eastern Region.I genuinely pity Dr.Bawumiah, a PhD holder making such an analysis.He has destroyed his own image.How can you appoint such a person with this mindset to head an International Organization.He should remember that the whole world is watching. Win the election at all cost!. The consolation that I have is that the 9 Supreme Court Judges are highly learned and experienced intellectuals.The day for the verdict would surely come.

There is an over voting when 66 ballots paper were issued to 66 voters in Jinpenhi polling center but at the end of voting 67 ballots papers were counted as tendered in court. There is an over-voting when this problem occurs in 1926 polling stations with 791,423 votes in question.

This is what NPP lawyer confronted the EC chairman with and this is what he attest to by affirming that it is over voting while you were napping throughout the court proceeding …….

If I may remind you, the EC Boss had said earlier that apart from the classical, he had problems with other definitions of over voting because one needed to scrutinize the entries on the pink sheet carefully before arriving at any conclusion of over voting.

But tell me, why have you refused to talk or write about the case of bad faith on the part of the Petitioners in view of the fact that Addison tried to mislead the court about 250 ballots being issued to a polling station with 12 registered voters when he knew too well that the figure on the pink sheet was 25(one booklet containing the least number of ballots). It took the vigilance one of the justices to expose this thievery. You certainly do not want the truth to be known by the Court. Shameless people.

He may well have answered Yes to Addison but what has been declared for the entire world to note is that the Register states the number of registered voters at that polling station as 71 and not 21. Handwriting is difficult to decipher and any reasonable person will understand that a 7 can easily be scribbled as 2. Even the type face of these numbers look similar.

I fail to see how Addison or the NPP think they have shown over voting. No doubt in further closing cross examination the EC counsel will debunk this notion. Why is Addison sticking to this pedantic "on the face of the pink sheet argument" He even said with a zero crossed out the figure on a pink sheet was 250 instead of 25,

He identified the lop holes in the system and tried to exploit them for his personal benefit. But he has forgotten he was toiling with innocent Ghanaian blood. He also took advantage of the peaceful nature of the larger Ghanaian population and one could see his posturing before and during the election. What I found so fickle about his presentation during his first appearance was his explanation on 10% extra ballots which I think a JHS student will not be convinced by such explanation. 10% of 25 ballots in a booklet will be 2.5 and round it up to 3 extra making 28 ballots in a booklet and the rest will not be difficult say 50 and 100 and his definition of over voting as well as the scenario created by him on the NO BIOMETRIC VERIFICATION NO VOTE with the paramount chief so there is something mischievous about such arrangement. I pray that the Justices can see through all these. At your age you allow Mr. Asiedu Nketiah and President Mahama to lure you into such a disgraceful act.

It still remains a mystery to the effect that Judge Atuguba is the president of the 2012 Election Petition at the Supreme Court of Ghana.
A close relative of Judge Atuguba serves the first respondent, Mr. John Dramani Mahama. On account of this fact, the honourable Judge Atuguba should have stepped down based on "Conflict of Interest" and to the benefit of the practice of parliamentary democracy in Ghana.
What is still unclear is the fact as to whether or not this hourable Judge Atuguba himself understands the implications of remaining on the committee? As a learned legal personnel, Mr. Judge Atuguba should have known this basic fact and should, therefore, have step aside long ago.
Another mysery person is Mr. Tony Lithur, the Counsel for the first respondent, Mr. John Dramani Mahama. Everybody in Ghana and now, many people outside Ghana know that Mr. Lithur's wife serves as a cabinet Minister under Mr. John Dramani Mahama. Again, Mr. Tony Lithur should have stepped aside based on "Conflict of Interest" issue. Rather, Mr. Tony Lithur continues to lead the team for the respondent.
To sum up, there is the clear evidence to the effect that, the NDC will forge the results of the ongoing petition.
This behaviour is detrimental to democracy, especilayy if Ghana claims to be practising democracy.
Let everybody in Ghana and the rest of the people outside Ghana realise that Mr. Juustice Atuguba and Mr. Tony Lithur have both successfully earned their respective degrees in law, and that both of them understand this basic matter, even though many people who have never been to school before understand this "Conflict of Interest" matter better.
Show the road towards democracy.

If as you say, the pink sheet said there were 21 ballots issued and the numbe of ballots CAST column said 67 (as you have stated, on the face of it, there was over-voting yet as you have also stated, the EC chairman ASKED for the VOTER REGISTER for that polling station and as you have stated, he stated that according the voter register, there were 71 registered for that polling station!!!

So, where is your point? what is more important? - tallying the voter register (71) with actual ballots (67) or the clear clerical error on the pink sheet (21). Why is it that this NPP propaganda group can't simply get it? How "dramatic was this except to say that the EC commissioner has been consistent in teaching all of us including your lead counsel that unless you combine a number of pieces of entries and voter register information, clerical errors can make the info onpink sheets misleading!!!

You are still trying to 'squeeze water out of stone' and it only goes toi suggest that even you know the case is not going in your favour.

If we find nothing wrong in breaking the key rules today,then we are seriously saying that no electoral rules set by any electoral commissioner, be it Dr Afari or any other commissioner can easily be overlooked.Therefore there can never be any credible election in Ghana again.He should not leave that bad condition for his predecessors.

Let's know who is the best or most intelligent lawyer among the counsels? Afterall the NDC bragged that Tsatsu, being a very intelligent person, was just going to nail Bawumia. What happened after all those long empty days of his cross-examination? He flopped...Bawumia rather made a mince meat out of him. And what happened afterwards? The rank and file of the NDC vented their spleen on him. He poor showing forced an angry and disgruntled NDC youth wing to hit the street to protest against Tsatsu continuing with the cross-examination. The noise, the hue and cry, that he would deliver Mahama and the NDC from dakness, was totally useless. His performance was no better than garbage! Lithur, the EC lawyer had better not come! He's a disgrace to the bar for his unruly behaviour, flinging a document onto the floor in open court. An unschooled village boy won't do this. Asiedu Nketsia, the number one fool and comic character in Ghanaian politics, believed to be the one to save situations, after Tsatsu 'the GNPC thief', failed to live up to expectation, also ended up realising that he had contradicted himself, when his voice was played from a tape recorder. You see, these people, even when they know they're losing the case, will still make so much noise. Afari Gyan, being their last hope, yesterday admitted the petitioners' claim of overvoting, an allegation he has so vehemently refuted, justifying with useless claims and analogies like what he said about Akufo Addo being his former roommate. Such stupid talks don't win a case in court, but rather facts and figures. And Addison has done just that. The judges must be fair, firm, unbias and impartial in their verdict. Finally, in trying to find favour from his own Party people, after muddying themselves up, Rawlings characteristically condemned Mills and Kufuor for Ghana's woes today, saying that Mahama 'the women bonker', is the one to fix Ghana's problems. I say a big NO because already Mahama is in a confused state of mind. He's aware it's a stolen verdict, and he's aware his presidency will be shortlived. He really feels haunted. Sometimes I wonder why this bastard of a man called Rawlings continues to live, brag and denigrade everybody in a fashion that seeks to make him an untouchable Messiah. Oh yes! no wonder, because there are of course millions of charlatans today who still sing his praise. They clap hands when he dares to say damnable things in public. Here's a man who under his regime, many heinous crimes were committed, some in broad daylight. Then cleverly he succeeded in 'purging' himself with an 'indemnity clause' that prevents him from being prosecuted in a court of law for any criminal offences. If this clause is scrapped off now, Rawlings won't survive a criminal prosecution for staging numerous coups, and masterminding the tortures, killings and deaths of many innocent Ghanaians, including those three Judges and top high-ranking
Military Officers, some of whose wives and children are still alive.
This is just a brief profile of the true picture of recent, on-going events. Once the EC boss has admitted to overvoting at certain places, we know that an iota of admission of overvoting/guilt culminates in outright cancellation. PERIOD!
