The Chiefs are never supposed to be owners of anything but rather GUARDIANS or TRUSTEES, if you like, of COMMUNAL property. Stool lands belong to the entire community of the traditional area where the land is. Nowhere in our tradition laws is a Chief authorized to sell land or any other "stool" property. He/she protects the property on behalf of the people, and can on the advise of the Council of Elders give land to a member of the community. Any sale of land has to be by agreement of the entire community through consultation with all the clan leaders (ebusua mpaninfuo), then approved by the national gov and the proceeds should, in principle, benefit the entire community.
Unfortunately, traditional law has been ignored, perverted or misapplied. The national government needs to step in and force a major land reform process that will see the creation of Community Development & Social Welfare Trust Fund accounts at a local banks, the proceeds of which will be used for additional development programs and social welfare purposes e.g. school fees for needy kids, scholarships, help for the elderly and disabled, struggling widows/widowers etc.
