This is a treatise premised on the assumption that the memorandum of understanding fashioned by the court for the adjudication of the petition had been established by the petitioners.All his other rantings are just an exercise to justify the treatise.The sad thing about his flowed logic is his insinuation of mayhem should the judges decide otherwise.
His treatise reminded us of this memorandum of understanding at which the Supreme Court set for itself two issues to be determined: (i) Whether or not there were violations, omissions, malpractices and irregularities in the presidential election held on December 7 and 8, 2012; (ii) Whether or not these violations, omissions, malpractices and irregularities, if any, affected the result of the said election?
His argument is that this is basically what constitutes their work.In fact he asked the court not to do any interpretation by balancing the right of the voter against any clerical error or competing claims on the constitution.In effect he said the constitution should not look at the law disfranchising four million qualified voters just because a presiding officer made a clerical error.Occasionally he tries a balancing argument but the motives are there foe all to see.
Otchere Darku had always seized the opportunity to play politics even on his tv panel shows at the least opportunity and some of those comments border on contempt.As a lawyer he must give the process a chance and stop his politics of bias which lacks balance and objectivity.

In the second paragraph of the section titled "Potential post-trial conflict" of your commentary, you quoted Lord Denning in R v Commissioner of Police of the Metropolis [1978] 2 All ER 319[;] ‘We [as judges] must rely on our conduct itself to be its own vindication. Exposed as we are to the winds of criticism, nothing which is said by this person or that, nothing which is written by this pen or that, will deter us from doing what we believe is right.’
I would respectfully draw your attention to the concluding sentence of that quotation, and I ask "might that wisdom counsel YOU, my "Learned Legalistic?"
Secondly sir, although I wholeheartedly agree with you on the need for a broad based agenda to preserving the peace in Ghana after the fact, I believe your claim that that will "gain broad legitimacy," is pure fantasy.
No matter where this verdict falls, the country would remain divisive. Historical political tendencies in Ghana supports this assertion. One side will always claim that the victor utilized some mechanism to achieve that end; and I believe that you sir can attest to this fact.
As I said, I do not intend to scrutinize this entire article. My intent here is to caution this "learned Legalistic" to consciously look before he leap.
