I am not a lawyer but I can say with all the conviction that the advocacy of Hon Atta Akyea was very porous and even made the judges angry before his client could talk. Of course his client made things no better by his belligerent stance pf questioning if he had been formally charged before the court and if so wanted to see the charge sheet so that he could respond to same. I am sure these were some of the amateur discussions that Atta Akyea had with Ken Korankye and the latter being so naive, decided to come and spill those at the judges. Indeed if you say to a judge that he had difficulty in seeing a wrong doing, you have indeed insulted him or reduced his esteem. Let all of us get this point clear. There is nothing wrong if we choose to criticize a decision of any court. The caution is that the criticism must e decorous and related to the issue that is being criticised. I can say that the sentencing of Ken orankye is not fair or is illegal and advance points to support it. But where I go at the person of the judge by decribing him as being wicked or hypocritical, I would not be seen as criticising the decision but attacking the personality of the judge. That is where I will be wrong and that is where the law will punish me for that. Please et us be mindful of not supporting the wrongful cause. I think that Hon Atta Akyea failed his client and he should accept that instead of hiding behind the sentence to save his face. See, I have not insulted him but I have made my point and my point is that he could have come on a more apologetic note intead of coming to argue and justify the publication.

It is really funny to hear a supreme court judge summonsing an alleged comtemnor to court, coercing him into apologising to the court, before finally sentencing him on a charge that was not previously read to the accused.
And this Supreme court is expected to dispence justice on a petition that is expected to determine the leadership of the country ?

I watched the proceedings and even though I am not a lawyer, I must say that I did not see any justice being done in the trial.
Much as we would not like people to show disrespect to the SC, it is worth mentioning that the judges approach truly gave the impression that Ken had already been tried and found guilty even before he mounted the stand.
This is really disturbing because if our young democracy should grow, then they (judges) should accept criticism, the same way the citizens have to accept their judgements on cases brought before them even though they might not agree with them.
The whole process reminded me of the secondary school days when students were found guilty even before they were called before the teaching staff and subsequently punished without giving them the opportunity to defend themselves.

However, his sentence is appropriate in so far as it sets an example to demonstrate the fact that The LAW OF THE LAND, THEREFORE ITS CUSTODIANS, JUDGES, IS NOT TO BE TOYED WITH. As for Ken Kourankyie, he was totally unrepentant and appeared almost defiant before the Judges. In the face of his defiance, what must the Judges do? The axe must fall and it fell heavily on his head. The Judges had no option but to jail him. Personally I doubt if he is a properly qualified journalist. If he were, in the very first year of his journalism course, his lecturers would have taught him one of the most important tenets of his trade- The Laws of Libel and Defamation and Contempt of Court issues particularlly in connection with the practice of Journalism. Hopefully, he would spend his time in jail profitably by reading books on Journalism and the Law and eschew the gutter journalism that people like him practice.

Despite the lack of due process, maybe it is the way to do it in Ghana in order to put a stop to all the side commentaries which are disrupting the Supreme Court proceedings. In my view the open letters by Arthur Kennedy and Otchere Darko are far more contemptuous pieces in so far as they appear to want to "educate" the Supreme Court Judges on how to adjudicate on the petition.
For the purposes of educating ourselves, perhaps these culled articles may help.
To prove contempt, the prosecutor or complainant must prove the four elements of contempt:
• Existence of a lawful order
• The potential contemnor's knowledge of the order
• The potential contemnor's ability to comply
• The potential contemnor's failure to comply
Contempt of court generally refers to conduct that defies, disrespects or insults the authority or dignity of a court. Often, contempt takes the form of actions that are seen as detrimental to the court's ability to administer justice.
Judges typically have much discretion in deciding whom to hold in contempt and the type of contempt. Those held in contempt can include parties to a proceeding, attorneys, witnesses, jurors, people in or around a proceeding, and officers or staff of the court itself.
There are two types of contempt of court: criminal contempt and civil contempt.
Civil contempt often involves the failure of someone to comply with a court order. Judges use civil contempt sanctions to coerce such a person into complying with a court order the person has violated.
Criminal contempt charges, on the other hand are punitive, meaning they serve to deter future acts of contempt by punishing the offender no matter what happens in the underlying proceeding. Someone incarcerated for criminal contempt cannot secure their own release by deciding to comply with the court.
Judges use different factors when deciding whether to hold someone in civil or criminal contempt, including the nature of the underlying court proceeding (criminal or civil) and the severity of the contemnor's behavior.
Criminal Contempt Charges
Criminal contempt charges become separate charges from the underlying case. Unlike civil contempt sanctions, criminal contempt charges may live on after resolution of the underlying case.
One charged with criminal contempt generally gets the constitutional rights guaranteed to criminal defendants, including the right to counsel, right to put on a defense, and the right to a jury trial in certain cases. Charges of criminal contempt must be proven beyond a reasonable doubt.
However, incarceration for contempt may begin immediately, before the contempt charge is adjudicated and the sentence decided. Depending on the jurisdiction and the case, the same judge who decided to charge a person with contempt may end up presiding over the contempt proceedings.
Criminal contempt can bring punishment including jail time and/or a fine.
Direct and Indirect Contempt
Contempt of court can take place either "directly" or "indirectly."
Direct contempt happens in the presence of the court. For example, someone could commit direct contempt by yelling at the judge in a way that impedes the court's ability to function and brings disrespect on the court.
Indirect contempt occurs outside the presence of the court. Examples include improperly communicating with jurors outside the court, refusing to turn over subpoenaed evidence and refusing to pay court ordered child support. Be aware that not all of these examples illustrate criminal contempt.
Conclusion
Criminal contempt of court refers to behavior which disobeys, offends or disrespects the authority or dignity of a court. It can occur directly, in the presence of the court, or indirectly when it happens outside the presence of the judge. Criminal contempt charges become separate charges from the underlying case. Adjudication of charges and punishment for criminal contempt may continue after resolution the underlying case.

I hope it is going to be a big lesson for lawyers and the general public at large. This case has proved that our learned friends are not infallible. May God have mercy on alleged culprits.

They should stop using phrases like "Look at you" and " You see your size now?" I think they just abuse the powers vested in them. Haven't you heard the SC Judges sounding insulting? The Ghanaian training from infancy where the youth is always judged to be wrong and the elderly judged right even when it is very glaring that the elderly is at fault is what is giving us problems. SC judges are also not perfect and tend to mete out their own form of jutice as deem fit in anger.

I wondered why Kuranchie would pick such a lawyer to defend him. Akyea offended the judges himself with his idiotic language. Furthermore, Akyea's bad advise to his client Kuranchie was also seen and heard in his demeanor towards the judges. He disrespected the judges and claimed that they were wrong in summoning him. He felt he had done nothing wrong.
To that, he got a longer sentence than Atubiga. Had Akyea and Kuranchie been apologetic like Atubiga and Tsatsu Kuranchie would have been sentenced to 3 days or less because his publication in the Daily Searchligt for which he was in court was far less damaging than that of Atubiga. My judgment is that Akyea was responsible for Kuranchie going to jail. Case closed!

Their brief was not to challenge the authority of the Supreme Court, but purposefully to seek clarity on a rather ambiguous contempt directives. Experts on legal thinking would question the jail sentence an its intended consequences on the PRINT FRATERNITY. The bench yesterday showcased its inflated ego and unflinching determination to stifle authentic and requisite discussions on the petition hearing. Atubiga was right to apologise for his partisanic comments, fuelled by irresponsible adherence and allegiance to their PLAN B;to instigate and prepare foot soldiers for mayhem and instill fear and panic in the wider population. Ken was right to ask for guidance and distinction in a rather grey area of contempt. Some of us do not subscribe to the one way traffic apology suggested by others. It is a recipe to compromise PRESS FREEDOM.
We need journalists of conscience like KEN KURANCHIE and straight thinking lawyers like ATTAH AKYEA to defend our constitutional rights, irrespective of any prejudices. Unfortunately the haemorrhage of anger and vengeance from the bench could not be staunched by either the wise and candid legal points initially put across by Lawyer Attah Akyea or the selfless commitment of a celebrated journalist doing his professional job. Free debate is the loser, the legal profession in Ghana is the loser and the citizens of Ghana are the losers.
May God give the JUSTICES the courage to pronounce the RIGHT VERDICT on the GREAT DAY.

You did an extremely poor job (1/10) and had ample opportunity to prepare your client properly before appearing in court which you didn't do. You and your client took a stance which pored further scorn on the the discipline the supreme court sought to impose.

Unfortunately, the haemorrhage of anger and resentment from our LAW LORDS could not be staunched either by the wise arguments initially downloaded from AKYEA'S legal repository and put across to our tenacious and steadfast JUSTICES or by the tactful use of words from KURANCHIE to appeal to their stance.
This piece is not an attempt in any way to undermine the focus of our great LAW LORDS. IT IS JUST TO ILLUMINATE A POINT. The JUSTICES tenacity is a huge consolation for most of us; an ASSET which will be enormously required on FINAL JUDGMENT DAY.

The justices pestered him with some intimidating questions, but the man ignored those questions or he simply continued begging that his statement was irresponsible and he begged for forgiveness. I suspect that of he was to only person appearing he would have been spared. But then came Ken. I took marks off him already because of the way he dressed. He probably gave the impression to the court that he did not give a damn about the case, white shirt over trousers.Then came his counsel who at the initial stages started behaving as if he was going to take the judges on. The judges simply wanted a straight forward answer, "I am sorry". Or "i am here to show you that I also know the law".But suddenly Ken started behaving as if he hoped to get the applause of the American professors who are writing against the justices. He posed as if he wanted to,teach the justices a few lessons about the law. This,is where I started praying for Mr. Atugiba. The judges were going to punish Ken and they could not spare him completely because they would have been seen to be unfair. Then Ken finally appeared to start his prison sentence and he was smiling. I did not like his manners. Then some sympathizers shook hands with him or embraced or showed solidarity. After this those SYMPATHIZERS went home to their wives to eat a good,supper while Ken went to prison, I hear it was the HO prisons, to drink Hausa KOKO. I hope after his sentence he will not come giving funny comments on his sentence.
